Indenture: Daniel [Isaac] Walton to Thos Potts, 1741 This Indenture, made the Twenty fourth day of September in the year of our Lord God One thousand seven hundred and forty one. Wherein Isaac Walton of the township of Byberry in the County of Philadelphia in the Province of Pennsylvania Yeoman and Sarah his wife of the one part and Thomas Potts of Southampton in the County of Bucks & Province aforsd Freeman of the other part Whereas William Penn Esqr Proprietor & Governour of the Province of Pennsylvania by Letters Patents dated the seventh day of the ninth month Anno Domini 1684 Recorded at Philada Patent Book A Vol 4 page 216 etc did grant nine thousand Eight hundred & fifty acres of Land situate in the County of Philada aforesaid some time called or known by the name of Mooreland and being as in the sd Letters Patent specified unto Nicholas Moore sometime of Moreland aforesaid deceased to hold unto him the sd Nicholas Moore his heirs and assigns forever as by the sd recited Letters Pattents in that behalf appear By Force and Virtue of the said Letters Patent or some other good Conveyance or Assurance in the Law duly had and executed he the said Nicholas Moore became in his lifetime lawfully seized in his Demesne as of Fee of and in the aforesaid Grant Tract of land called Mooreland with the appurtenances and he the said Nicholas Moore being so thereof seized died intestate Where upon a certain parcel thereof of about six hundred acres being set apart for the payment of debts partition _____ _______ of the residue of the aforesd great tract called Moreland was made among the Children and ________ _____heirs of the sd Nicholas Moore whereby Elias Keach in right of Mary his wife (which Mary was one of the daughters of Nicholas Moore) and the sd Mary _____ together for their part _____ at Certain Seven hundred and seventy six acres of land near a Certain long slip of Land then reputed to be in the Township of Warminster but since a Division of the Two Townships the same slip of land is recorded in the Township of Mooreland which Partition & division was approved at an Orphans Court at Philada the 7th day of the 1st month 1688/9 and the same with the ____ of ____ particular part annexed is recorded in the Secretaryís Office at Philada in Book No _____ page 8 _____ the same partition appears And the said Elias Keach & the sd Mary his wife both died intestate whereupon the aforesd seven hundred and seventy six acres of Land Descended unto Hannah Harrison formerly Hannah Keach daughter and sole issue of the said Mary Keach by her husband Elias Keach And Whereas the sd Hannah Harrison then of Stanford in the County of Lincoln in Great Britain Widdow in and by a certain Instrument of Pr_____ation or Letters of Attorney of the 10th day of January 1738/9 Did Constitute John ______ only son & heir apparent of her the sd Hannah Harrison the lawful attorney thereby granting unto him full power and lawful authority for he the said Constituent in his name and to her use to enter into and upon or take Possession of all & any the Messuages Lands Tenements Hereditaments & Estate whatsoever of he the said Constituent situate in Pennsylvania aforesaid and Possession and seizure thereof to take and after Possession and seizin so had and taken of the premises the same and every or any part or Parcel thereof Together with the right & Title of her the sd Constituent thereto to contract for & also grant bargain and sell Alien Enfeoff release and confirm And to give lawful possession ________ thereof to such Person or Persons & for such Estate or Estates upon such terms & for such considerations and by such Deeds Conveyances in the law with such Warranties and Covenants & in such manner and form as the said Attorney shall from time to time think fit and needful And for the making such contracts for or sale or Conveyance of the Premises aforesaid or any part thereof to enter into any Agreement or Deed in Writing for & in the name of the sd Constituent or otherwise as the case may or Shall require and sign seal deliver and duly execute the same as the Act or Acts Deed or Deeds of her the sd Constituent also to record and take all & every such sum and sums of money as can be had for and in sale of the sd Lands & premises or any of them. And Generally to do and execute or cause to be done and executed all & every such lawful & reasonable Act & Acts thing and things for in and about the Conveying Assuring and Confirming the premises and every part and parcel thereof unto & upon the person or persons purchasing the same his or their heirs & assigns as his sd attorney think fit as in & by the sd recited Letters of Attorney duly proved relation being thereunto had at large appear And Whereas He the said John Harrison by force and virtue of the sd recited Letter of Attorney did grant convey and Confirm by his Deed bearing date the Eleventh day of March Anno Dom 1739/40 duly executed under his hand and seal or under the hand & seal of the sd Hannah Harrison by her said Attorney John Harrison unto the said Isaac Waltin a Certain piece or parcel of land Containing Sixty Four acres three quarters of an acre & twenty five perches part of the aforesaid seven hundred & seventy six acres as aforesd __ ___ allotted for the part of the sd Keach and wife to hod to him the sd Isaac Walton his heirs and assigns forever as by the sd Deed relation thereunto being had will more fully appear. Now this Indenture Witnesseth that for and in Consideration of the sum of nineteen pounds and six shillings lawful money of Pennsylvania unto the sd Isaac Walton will and truly paid at or before the sealing and delivery hereof by the sd Thomas Potts the receipt whereof to the sd Isaac Walton & Sarah his wife doth hereby acknowledge & forever discharge the sd Thomas Potts his heirs & assigns by these presents they the sd Isaac Walton & Sarah his wife hath granted bargained sold aliened enfeoffed and Confirmed and by these presents Doth Grant Bargain sell alien enfeoff release and Confirm unto the sd Thomas Potts and his heirs a Certain price or Lot of Land part of the aforesaid Forty four acres three quarters & twenty four perches of Land beginning at a post for a corner by the York Road & extending thence by John Crosleys Lot south East seventy five perches and a half to a post thence by a Lot of Margaret Loofborrow south West Twelve Perches to another post thence by the sd Loofborrows other Lot North West seventy five perches & half to a post by the aforesaid Road thence by the same Eleven Perches to the first mentioned Post the place of beginning Containing four acres & sixty eight Perches of Land Together also with all and singular the ways woods waters watercourses Rights Liberties Privileges Improvements hereditaments & appurtenances whatsoever thereunto belonging And the Reversion and Remainders rents Issues and profits thereof To have and to hold, the last described Lot or Piece of Land hereditaments and premises hereby granted or mentioned to be granted with the appurtenances unto the sd Thomas Potts & his heirs to the only proper use and behoof of him the sd Thomas Potts his heirs and assigns forever Under the proportionable part of the yearly quit rent hereafter accruing for the hereby Granted premises to the Chief Lord of the Fee thereof And the sd Isaac Walton & Sarah his wife doth Covenant for them and their heirs that they and their heirs the sd piece or Lot of Land & premises hereby granted or mentioned as to be with the appurtenances unto the sd Thomas Potts his heirs and assigns against him the sd Isaac Walton & Sarah his wife and their heirs and against the sd Hannah Harrison and her sd Attorney John Harrison & their hers and against the heirs of the sd Nicholas Moore Elias Keech & Mary his wife respectively and against all and every other Person and Persons whatsoever lawfully claiming or to claim by form or under him them or an of them shall and will warrant and forever defend by these presents And the sd Isaac Walton for himself his heirs Executors and Administrators & for the sd Sarah his wife do Covenant promise & Grant to and with the sd Thomas Potts his heirs and assigns by these presents in manner following That is to say That he the said Isaac Walton now at the time of the sealing and delivery of this present Indenture is the true sole and lawful owner & Proprietor of the sd Last described piece or Lot of Land & premises and is lawfully rightfully & absolutely seized thereof & of every part and parcel thereof as of good power absolute and undifeazible Estate of Inheritance in Fee simple without any Condition Contingent or other cause to alter change make void or determine the same And that he the said Isaac Walton shall continue as seized of the premises Every part and parcel thereof until as like good Estate in Fee simple shall be thereof vested in the sd Thomas Potts or his heirs according to the purport and true meaning thereof and that freed and discharged or otherwise well and sufficiently saved harmless and indemnified of all manner whatsoever & the aforesaid proportionable part of the proprietary Quit rent as hereafter to accrue only excepted and further _______ In Witness Whereof the sd parties to these presents have interchangeably set there hands and seals hereunto dated the day and year first above written. The 13th day of August in ye year 1742 Before me Septimas Robinson Esqr one of the Justices of the Case for the Courts and County of Philadelphia Came ye within named Isaac Walton and Sarah his wife and acknowledged the within written Ind e_______ to be their Deed & desired that the same may be received as their Deed the sd Sarah thereunto voluntarily consenting she being of full age _______ and part Examined and the Constructs of the sd writing read unto her Witness my hand and seal ye day and year abovesaid.
