Where as the said Jacob Schreiner was in his lifetime lawfully seized in fee interalia of and in a certain three story Brick Messuage or Tenement and lot or piece of ground thereunto belonging situate on the East side of Second street from Delaware in the said City between Mulbery and Sassafras street containing in breadth twenty feet and four inches and extending in length One hundred and fifty five feet, bounded southward by a Messuage and lot formerly in the tenure of Joseph Drinker, Eastward by ground formerly in the possession of Samuel Fisher. Northward by ground formerly in the possession of Aquilla Jones and westward with Second street aforesaid. And the said Jacob Schreiner being so thereof seized died leaving a widow and eight children having first made and published his last Will and Testament in writing dated the fifth day of December One thousand seven hundred and ninety two wherein among other things he did give unto his Wife Elizabeth One thousand Pounds/ which has since been paid unto her. And also did give unto her the one third of the yearly rent or income of the said messuage or tenement during her life deducting taxes and necessary repairs and directed that his mother Catherine Meng should be maintained out of the rents or income of the said messuage so far as boarding and lodging and that the remainder part of the said rent or income should be put to the maintenance of his three minor children, Samuel, Henry and Rebecca and further directed that his executors should let out the said messuage or tenement for as much rent as it would bring and be kept in sufficient repair until his youngest child should be of age that then the same should be sold at public sale to the highest bidder and the money arising from such sale to be equally divided amongst his said children share and share alike. But if his said wife should then be alive one third of the money arising from such sale to be put out at interest for her to receive the same interest during her life and after her death the said one third of the money so put out to be equally divided amongst his said children share and share alike as in and by the said Will duly proved and recorded in the Registers office at Philadelphia more fully appears. Now know ye that the said Samuel Enos Davis and Catherine his wife for and in consideration of One hundred dollars lawful money of the United States unto them at or before the sealing and delivery hereof by Jacob Schreiner of the City of Philadelphia Merchant well and truly paid the receipt whereof is hereby acknowledged have granted bargained and sold assigned aliened enfeossed transferred and set over released and confirmed and by these presents do grant bargain and sell alien enfeoss assign transfer and set over release and unto the said Jacob Schreiner his heirs executors administrators and assigns all the Estate Right Title Interest share dividend property claim and demand what so ever which they the said Samuel Enos Davis and Catherine his wife in right of the said Catherine now have or hereafter may have as one of the children of the said Jacob Schreiner deceased of and in the aforesaid Messuage or Tenement and described lot of ground and the rents or income of the same and of and in the money which may arise from the sale of the said premises which is to be made by the executors as aforesaid and also of and in the money that may be put out for the use of the said Elizabeth as aforesaid. To have and to hold receive and enjoy all and singular the estate Hereditaments and Premises hereby granted with appurtenances unto the said Jacob Schreiner his heirs, executors, administrators and assigns to the proper use and behoof of the said Jacob Schreiner his heirs, executors, administrators and assigns forever. A the said Samuel Enos Davis and Catherine his wife do make constitute and appoint the said Jacob Schreiner his heirs, executors, administrators and assigns their and each of their true and lawful attorney irrevocably for them and in their or either of their names but for the only use and benefit of him the said Jacob Schreiner his executors, administrators and assigns to ask demand sue for recover and receive of and from the executors of the said Jacob Schreiner deceased the monies which now are or hereafter may be due to or in right of the said Catherine Davis on account of said messuage arising from either the income or rents of the said messuage and described lot or from any sale or sales to be made of the same in pursuance of said will and upon receipt of all such monies for them and in their or either of their names to give receipts or other sufficient discharges for the same. And one or more attorney or attornies under him the said Jacob Schreiner his executors, administrators and assigns for the purpose aforesaid to constitute and appoint and hereby ratifying and confirming all and what so ever the said Jacob Schreiner his executors, administrators or assigns or their attorney or attorneys shall lawfully do in the premises. In Witness whereof the said Samuel Enos Davis and Catherine his wife have hereunto set their hands and seals this fifth day of November in the Year of our Lord One thousand seven hundred and ninety nine. Received the day of the date of the above written instrument of writing or assignment of the above named Jacob Schreiner the sum of One hundred dollars lawful money of the United States of America being the full consideration money above mentioned . Sam’l Eneos Davis Catherine Davis Witness- - - - The fifth day of November A.D. 1799 Before me the subscriber one of the Justices of the Peace for the County of Philadelphia came the above named Samuel Enos Davis and Catherine his wife and in due form of law acknowledged the above written instrument or assignment their and each act and deed and desire the same might be recorded as such. She the said Catherine being first by me separately and apart fromher said husband examined and declaring she is fully acquainted with the contents of the said instrument and that she executed the same voluntarily of her own free will and accord without any compulsion or undue influence whatsoever.
