This Indenture made the tenth day of Sept. in the twelfth year of the reign of our Soverein Lady Ann Queen of Great Britain, &c., in the year of our Lord 1713. Between James Shattick of the Co. of Phila. in the Province of Penn., Gentlemen, one part and John Pawling of Marbletown the Co. of Ulster in the Province of N.Y., Yeoman, of the other part. Whereas by certain Indentures of lease and releases bearing date respectively the 34 day of May in the year of Our Lord (1682) one thousand six hundred eighty & two was made between Wm. Penn of Worminghurst in the co. of Sussex Esq., Propriatry & Govenour of the s'd Province of Pa. of the other part & Samuel Tavernor or Lumerich in the Kingdom of Ireland, merch., of the other part he the said Wm. Penn for the consideration there in mentioned, did grant & convey unto the s'd Samuel Tavernor the full & such proportion and quantity of one thousand acres of land he be allotted & set out in said Province to hold to him the said Samuel Tavernor his heirs and assigns for ever as in & by the same recited indenture Recorded in the vool in office at Phila. in Book E-6, vol. 7, page 156 & the 12th Feb. 1713 relation being there unto had may more at large appear. and whereas the s'd Sam'l Tavernor by indenture of lease and release being date ght three & twenties and four & thwentieth day of Aug. in the year of Our Lord 1704 for the consideration therein mentioned did grant & convey the s'd One Thousand acres of land unto the s'd James Shattick & Ed Lane (Late of the city of Phila) to hold to them the s'd Edw Lane & James Shattock their heirs & assigns forever are in the last recited indenture recorded in the office afors'd in book afors'd P. 160 &c., relation being there unto had may more at large appear. By forced virtue of which s'd recited indenture or of some other good conveyance or announce in said duly had and executed the s'd James Shattick & Ed Lane became soundly siezed in the demesure are of fee som the s'd one thousand acres of land & being so thereof seized the s'd Edw died after whose decease the s'd one thousand acres of land did together with other lands in their Inventory wholly accrue to the s'd James Shattick by right of survivorship. And whereas by virtue of warrant from comimisiers of property bearing date the 26th day of the 2nd month 1708 there was surveyed and laid out on the 25 of March 1709 500 acres of land in the s'd County of Phila. in right of the above s'd purchase of 1000 acres. Beginning at a black oak at a corner of T_ Pagetts land & on the same land belonging to the free society of traders thence south west by Pagett's land 467 p to another black oak thence by Wm. Stanners land north west 172 p to a post thence N.E. by vacant land 467 p to a white oak thence by the society land S.E. 172 p to the place of beginning as by the s'd warrant & return thereof remaining at the s'd survey or generals office at Phila may at large appear. Now this indenture witnessith that the s'd James Shattick for & in consideration of the sum of 170£ lawful money of America to him in hand paid by the s'd John Pawling the receipt whereof the said James Shattick doth hereby acknowledge & thereof doth acquit & discharge the said John P. his heirs exec. adm. & assigns by these presents have granted bargained sold alined enfeoffed & confirmed & by these presents doth grant bargain sell alien enfoffed confirm unto the s'd John P. all that the s'd tract of 500 acres of land as the same is herein before set forth bounded & limited as afores'd together also with all & singular the meadows marshes swamps cripples ways waters water courses, woods timber & free fishing fowling hawking huntings rights subertur privileges Land rents & appurtenances whatsoever thereunto belonging or in any wise appurtaining and the reversion & reversious remainder & remainders rents issues & profits thereof & tru copies (as the charge of the s'd John P. his heirs or assigns) of all deeds writings & evidences concerning the same to have & to hold the s'd 500 acres of land, hereditants & premises hereby granted or mentioned or intended to be hereby granted with their appurtenances unto the s'd John P. his heirs & assigns to the only proper use & behoof of the s'd John P. hes heirs and assigns for ever under the yearly quit rents from hence forth to become due & payable for the same to the lord of the fee thereor and the s'd James Shattock and his beirs the s'd 500 acres of land, hereditants & premises hereby granted or mentioned to be hereby granted with their appurtenances unto the s'd John P. his heirs and assigns against him the s'd James Shattock their heris and against the s'd Saml Tarvener & his heris and assigns and against the heirs & assigns of the s'd Edw Lane dec'd and against all other persons whosoever lawfully claiming unto claim by from or under their or any of them shall & will warrant & forever defend by their presents and the s'd James Shattick for himself his heirs exec. adm. & assigns doth convenant promist & grant to & with s'd John P. his heirs & assigns by those present that he the s'd James Shattick & his heirs & all & every other person & persons whosoever lawfully lcaiming or to claim the s'd 500 acres of land & premises hereby granted or mentioned to be granted or any part thereof by form or under him or the s'd Saml Taverner or Edw Lane or any of them shall & will at any time or times hereafter upon the reasonable request cost & charge in an of the s'd John P. his heirs & assigns make execute & acknowledge & cause or produre so to be all & every such further & reasonable act & acts deed or deeds device or devices in same whatsoever for the farther & better assurance & confirmation of the s'd land hereditants & premises hereby granted or mentioned to be granted with the appurtenances unto the s'd John P. his heirs & assigns as by his or them or by his or their councel learned in to thaw shall be reasonable devised advised or urged.
