Winnemore et al to Thompson Westcott This indenture made between Thomas Montgomery Winnemore of the City of Lancaster, State of Pennsylvania, House Carpenter, acting herein by his Attorney in fact, William C. Flanigen of the City of Philadelphia, Dry Goods Merchant, duly constituted and appointed by Letter of Attorney bearing date March 5, 1851 and recorded in Letter of Attorney Book GWC No. 2, page 229 and Jacob Wilson Winnemore of the City of Mobile and State of Alabama, Clerk, also acting herein by his letter of attorney, in fact, the said William C. Flanigan, appointed by letter of attorney on March 26, 1851 and recorded in letter of attorney book GWC No. 2 Page 228 of the first part, the said William C. Flanigen Guardian of Ezra Stiles Ely Winnemore and Samuel Egleston Winnemore, minors of the second part and Thompson Westcott, Philadelphia, Attorney at Law, of the third part. Whereas James Hopkins by indenture dated May 5, 1846, Deed Book AWM No. 9, Page 171 conveyed unto Joseph Lee in fee all that certain lot or piece of ground situate on the west side of Schuylkill, Sixth Street between Chesnut and Market Streets in the City of Philadelphia, beginning at the distance of fifty two feet six inches southward from the South Side of Barker Street and containing in front or breadth on the said Schuylkill Sixth Street seventeen feet six inches and in length or depth westward sixty six feet. Bounded north and south by other ground granted by the said James Hopkins to the said Joseph Lee in ground rent. On the west in ground now of late Stephen Collins, and on the east by Schuylkill Sixth Street aforesaid. Under and subject to the reservation of a yearly rent or sum of seventy dollars unto the same James Hopkins in equal half yearly payments and provided that if Joseph Lee should at any time within seven years pay James Hopkins the sum of $1,166.66, the property will be his On the 9th day of December 1846, James Hopkins conveyed the yearly rent to Margaret Winnemore in fee in Deed Book AWM #20 page 375. Margaret Winnemore made her last Will and Testament bearing date of December 8, 1848, which was duly proved and registered in the Registers of the Probate of Wills in Book 76B, No. 3 page 261 pages 139 and 40. After sundry devises and bequests devised by Margaret Winnemore, all the residue of her estate of which said residue the said yearly ground rent of seventy dollars is a part of in manner and form following to wit: Fourth, I give devise and bequeath to my four youngest sons, Thomas Montgomery Winnemore, Jacob Wilson Winnemore, Ezra Stiles Ely Winnemore and Samuel Egleston Winnemore, all the rest and residue of my estate, real and personal. In case either or any of my said four children just named shall depart his life without lawful issue before the age of twenty one years, then his or their share or shares shall go to the survivors of them. Whereas the said Thompson Wescott on January 10, 1852 presented his petition to the Court of Common Pleas setting forth the above facts and that the said Ezra Stiles Ely Winnemore and Samuel Egleston Winnemore are minors under the age of twenty one years and that the said William C. Flanigen was appointed their guardian by the Orphans Court of Philadelphia on June 21, 1850 and praying that a release and discharge of the said ground rent might be executed to him by the said William C. Flanigen. The Court considered and ordered that Thompson Wescott pay to William C. Flanigen, guardian of Ezra Stiles Ely Winnemore, the sum of two hundred and ninety one dollars sixty six cents and two thirds of a cent and arrears of ground rent to him as payment of any was due and he is also to pay the sum of two hundred and ninety one dollars and sixty six cents and two thirds of a cent with arrears of ground rent, if any was due for Samuel Egleston Winnemore. William C. Flanigan should give Thompson a Deed of Release for the yearly ground rent of seventy dollars Signed: Thomas Montgomery Winnemore Jacob Wilson Winnemore by their attorney in fact. Wm. C. Flanigen appeared and acknowledged that he represented Thomas Montgomery Winnemore, Jacob Wilson Winnemore, and as Guardian for Ezra Stiles Ely Winnemore and Samuel Eggleston Winnemore, and acknowledged this indenture to be his act and deed.
