I. Laudenslager a Justice of the Peace within and for the County and State aforesaid, John L. Malick, aged 52 years, a resident of the Township of Hegins County of Schuylkill, State of Pennsylvania, who, being duly sworn according to law, declares that he is the identical John L. Malick, who was enrolled on the 16th day of October, 1862, in Private Co "K" 172" Regiment Penna Drafted Infantry in the service of the United States in the war of the rebellion, and served at least ninety days, and was HONORABLY DISCHARGED at Harrisburg, Penna, on the 4th day of August, 1863. That he is Partially unable to earn a support by manual labor by reason of suffering from Rheumatism, Miners Asthma, Defection sight of both eyes, Also Weakness in both legs. That said disabilities are not due to his vicious habits, and are to the best of his knowledge and belief permanent. That he has not applied for pension. He hereby appoints, with full power of substitution and revocation, Davis M. Mellon, of Tremont, State of Penna, his true and lawful attorney to prosecute his claim, the fee to be TEN DOLLARS as prescribed by law. Malick, the claimant, sign his name (or make his mark) to the foregoing declaration; that they have every reason to believe from the appearance of said claimant and their acquaintance with him for 40 years and 25 years respectively, that he is the identical person he represents himself to be; and that they have no interest in the prosecution of this claim. Malick Application # 916546 Pulse rate 84, respiration 20, temperature 97.2, height, 5 feet 8 inches, weight 150 pounds, 53 years, Chest 34 inches ------------------------------- DECLARATION FOR WIDOW'S PENSION State of Pennsylvania, County of Schuylkill; SS; On this 12th day of November, A.D. one thousand eight hundred and ninety six personally appeared before me a Justice of the Peace within and for the county and State aforesaid, Leah Malick aged 54 years, a resident of the township of Hegins county of Schuylkill, State of Penna., who, being duly sworn according to law, declares that she is the widow of John L. Malick, who enlisted under the name of John L. Malick, at on the 16th day of October, A.D. 1862, in Co "K" 172nd, Regt. Penna Inf. as a private and served at least ninety days in the late War of the Rebellion, in the service of the United States, who was honorably discharged August 4th 1863, and died November 5th 1896, That she was married under the name of Leah Houtz to said John L. Malick on the 12th day of March, 1865, by Rev. Isaac Stiely, at Eldred twp. Schl. Pa, there being no legal barrier to said marriage. That neither the claimant nor her husband had previously been married. That she has not remarried since the death of the said John L. Malick. That she is without other means of support than her daily labor; that names and dates of birth of all the children now living under sixteen years of age of the soldier are as follows: J. Harvey, born Feb. 16, 1881. That her husband has not been employed in the Military or Naval service otherwise than as state above. That she has not heretofore applied for pension and the number of her former application is But that her husband was a pensioner Cert#838993 Act June 29, 1890. That she makes this declaration for the purpose of being placed on the pension-roll of the United States under the provisions of the Act of June 27, 1890 She hereby appoints, with full power of substitution and revocation Davis M. I Laudenslager Justice of the Peace --------------------- RECORD PROOF OF MARRIAGE OF WIDOW TO SOLDIER State of Pennsylvania, County of Schuylkill, SS: On This 18th day of November, A.D. one thousand eight hundred and ninety six personally appeared before me a Justice of the Peace within and for the County and Sate aforesaid Lydia Haas age 59 yrs., who being duly worn according to law, declare that she resides in Mt. Carmel County of Northumberland Sate of Pennsylvania; That she was present at the marriage of John L. Malick and Leah Malick whose maiden name was Leah Houtz, who married at her residence in Eldred Township, Schuylkill Co. Pa on the 12th day of March A.D. 1865. That the only witnesses to the marriage were herself, her husband, Isaac Haas and the Pastor, Isaac F. Stiely, that her husband and the Pastor are now dead. That the said John L. Malick and his wife Leah have lived together as husband and wife from the date of their marriage up to the time of the death of the said John L. Malick, who was accidentally killed in the mines at Brookside Colliery on the 5th day of Nov. A.D. 1896. That this testimony was written by C. I. Laudenslager on Nov. 18th 1896 in the presence of the witnesses and only from her oral statements then made. That she was not aided or prompted by any written or printed statements except the marriage certificate hereto annexed from which she obtained the date of the marriage that her PO address is Mt. Leah Malick for Widows pension ----------------------- RECORD PROOF OF DEATH OF SOLDIER State of Pennsylvania, County of Schuylkill, SS: ON THIS 18th day of January A.D. one thousand eight hundred and ninety seven personally appeared before me a Justice of the Peace within and for the County and State aforesaid Frank S. Bossler, who, being duly sworn according to law, declares that he resides in Valley View, County of Schuylkill, State of Pennsylvania; and that he is an Undertaker; That he was the undertaker at the funeral of John L. Malick, who was accidentally killed in the mines of Brookside Colliery on the fifth day of November A.D. 1896 and was buried on the 8th day of November A.D. 1896. That the testimony was written by C. I. Laudenslager at Valley View Jan 18,1897 and only from his oral statements these made. That he was not aided or prompted by any printed or written statement not hereto attached, and that the testimony was written in his presence. Affiant further declares that he has no interest in the prosecution of any claim on behalf of Leah Malick for widows pension. F. S. Bossler Sworn to and subscribed before me this 18 day of January, 1897. I have no interest in the prosecution of this claim for widows pension. ON THIS 18th day of January, A.D. 1897, personally appeared before me, a Justice of Peace in and for the aforesaid County, duly authorized to administer oaths, Leah Malick aged 54 years, a resident of Valley View in the County of Schuylkill and State of Penna. whose Post Office address is the same. That she is the claimant herein named. That she is possessed of the following property real personal or mixed. A lot of Household goods such as are used in ordinary housekeeping the value thereof is about one hundred dollars. That her late husband left her two lots valued about two hundred dollars. That there is still due and owing on said lots the sum of fifty dollars. That she owns in her own name a house and lot valued at about $600 on which there is still due and owing the sum of $100. That his house and lot is yet assessed in the name of Daniel Malick a former owner. That she is possessed of no property other than above named,. That no person is legally bound to support her. That her income which is derived from her own manual labor is inadequate to her and child's support. That she has no bonds stocks or other investments. That his testimony was written in her presence by C. I Laudenslager at Valley View Pa and only from her oral statements then made, and that in making the same she did not use, and was not aided or prompted by any written or printed statement or recital, prepared or dictated by any other person; and not attached hereto That this testimony was written Jan. 18 1897 she further declare that she has interest in said case and is concerned in its prosecution. Laudenslager Justice of the Peace -------------------------- GENERAL AFFIDAVIT State of Pennsylvania, County of Schuylkill, ss: In the Matter of pension claim of Leah Malick, Wid, John L. Malick, Co. K 172nd PA Inf. On this 15 day of February, A.D. 1897, personally appeared before me, a Justice of the Peace in and for the aforesaid County, duly authorized to administer oats, Monroe Malick aged 28 years a resident of Valley View in the County of Schuylkill and State of Pa whose Post Office address is Valley View, PA and Richard Malick aged 25 years a resident of Valley View in the County of Schuylkill and state of PA whose Post Office address is Valley View well known to me to be reputable and entitled to credit, and who being duly sworn, declare in relation to the aforesaid case as follows: That the following is a true and correct copy of the baptismal record of the birth of J. Harvey the minor child of the above named claimant. This certifies that Joseph Harvey a child of John L. Malick and his wife Leah, was born on the 16th day of February A.D. 1881 in Upper Mahanoy, Northumberland Co. Pa. and was baptized on the 23rd day of February A.D. 1881 by Rev. A. R. Hottenstein. Sponsors: Benneville Fetter Louisa Fetter We further testify, that we were living with the family of John L. Malick at the time of the birth of J. Harvey and that the said J. Harvey was born on the 16th day of February A.D. 1881 and that he is still living and that this testimony was written by R. H. Laudenslager at Valley View on Feb. 15, 1897 in the presence of the witnesses and only from their oral statements then made. That they were not aided or prompted by any printed or written statement (except the baptismal record a copy of which is above given) not being hereto attached or made a part of the same. They further declare that they have no interest in said case and are no concerned in its prosecution. Monroe Malick Richard Malick -------------------------- SWORN STATEMENT State of Pennsylvania County of Schuylkill SS On this third day of October, A.D. 1916, personally appeared before me, a Justice of the Peace in and for the said County, duly authorized to administer oaths, Leah Malick, of Valley View, in the County of Schuylkill, and State of Pennsylvania, who being duly sworn according to law, doth depose and say, that she is the widow of John L. Malick, late a private of Co. K, 172 Regt. Pa Drafted Militia, and that she is a pensioner under certificate #441950, and she was born on the 28th day of July 1843, and is now aged 73 Years.
