The morning trains brought many people to town all anxious to get a glimpse of the men charged with the murder of Policeman Yost at Tamaqua. By 10 o'clock the court house was filled to its utmost capacity, many being unable to gain admittance. Over two hundred witnesses have been subpoenaed. The case was not reached until 2 o'clock, when the prisoners were brought into court, looking well and cheerful. They were immediately arraigned, and the usual question, "Are you guilty or not guilty?" was answered by all, “Not guilty." When questioned how they would be tried, Roarty answered, "We want to be tried by God and our country." The empaneling of a jury then began, and up to 4 o'clock, the hour of adjournment, only one juror bad been obtained, the others examined having formed or expressed an opinion, and in one case, objection being made to a question as to whether the juror belonged to a vigilance committee formed in Tamaqua at the time of the murder, which the juror declined to answer, a long discussion followed, participated in by the leading counsel on each side, and will be resumed in the morning.
