We encourage links to the state and county table of contents ____________________________________________________________ Deed for Philip and Eve Dietrich and James and Nelly Bixler From the Schuylkill County Archives and Frecords, Schuylkill county Courthouse, Pottsville, Pa. 17901 This indenture, made the second day of April in the year of your of our Lord one thousand eight hundred and sixty-six. Between Philipp Diedrich and Eve, his wife, and James Bixler and Nelly, his wife, of the County of Schuylkill and State of Pennsylvania, of the one part, and Henry Wanner of Washington Township, County and State aforesaid. Witnesseth, That the said party of the first part, for and in consideration of the sum of eight hundred and fifty DOLLARS, lawful money of the United States of America, unto him well and truly paid by the said party of the second part at and before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, hath granted, bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents DO grant, bargain, sell, alien, enfeoff, release and confirm, unto the said party of the second part, his Heirs and Assigns. ALL THAT CERTAIN, Messuage, Tenemant, Grist Mill and Tract of Land, Situate in the Township of Wayne, County and State aforesaid, Bounded and described as follows, to wit: Beginning at a White Oak, thence by lands of Jacob Wagner, North twenty-seven degrees West Sixty-four perches to a post; thence North Seven and a half degrees West, Nine perches to a post in a public Road thence along the road, North fifty-seven and a half degrees West Six perches to a post; North Seventy-Seven degrees West Seven perches to a post, and North eighty-seven and a half degrees West, Fourteen perches to s spruce; thence South eight and a half degrees West, Six perches to a post, thence South one half degree West, thirty perches to stones; thence South twenty-five degrees West, Six perches to a Hickory; thence by land of Samuel Wanner, South ten degrees East, Forty-two perches to a stone; thence South Eighty degrees East, firty-eight perches to a white oak, and North thirty-six degrees East, twenty-two perches to the place of Beginning Containing Twenty-Five Acres and ten perches of land, Strict measure; It being part of larger tract of land which G. H. Eichert and Catharine his wife, by their Indenture, bearing date the 6th day of April A. D. 1840, granted and confirmed unto Henry Heil and Jacob Wagner as tenants in Common, And wheras by a Deed of Partition made between said Harry Heil and Jacob Wagner, bearing date the 28th day of February 1844, a certain portion of which said larger tract 27 Acres, 110 perches strict measure, including the hereby granted and conveyed Messuage, tenement, Grist Mill and tract of land was released and confirmed unto the said Henry Heil, who by his Deed duly executed the 3rd day of April A. D. 1844, granted and confirm the same unto Lewis Reeser & Reuben Reeses, who with their wives, and joint Indenture bearing date the 13th day of March A. D. 1846, granted and confirmed a certain Strip of land containing Two Acres and 100 perches strict measure, out of the above mentioned 20 Acres and 110 perches Strict measure, leaving it now, as described above 25 Acres& 10 perches strict measure, as by the said deed of partition & other Indentures referred to referances being there unto had more fully and at large may appear. ALSO ALL THAT CERTAIN Lot or piece of Land Situate in the Township of Wayne, County and State aforesaid, Bounded and desribed as follows, to wit: Beginning at a stone, thence by land of Benj'..Heimbach, North eighty degrees West, Eleven perches to a stone, thence South one half degree East, forty-four perches to a Hickory; thence by the other land hereby granted, Conveyed and described above, South sixty-five degrees East, Nine perches to a stone thence by the same North three degrees East, forty-five and a half perches the place of beginning. Containing Two Acres & one 100 perches Strict measure, It being part of the same premises which Christian Heimbach and Catharine his wife, by their Indenture, Bearing date the 10th day of March, A. D. 1842, granted and confirmed unto Benjamin Heimbach, who with Sarah his wife, by their Indenture bearing date, the 13thday of March, A. D. 1846, did grant and confirm the same unto Lewis Reeser and Reuben Reeser, and the said Lewis Reeser, and Reuben Reeser and their wives, by their Indenture dated the 31st day of March, A. D. 1849, granted and confirmed unto Philip Dietrick and James Bixler the party hereto. TOGETHER with all and singular, the Buildings, Improvements, Ways, Waters, Water- Courses, Rights, Liberties, Privileges, Hereditaments, and Appurtenances, whatsoever thereunto belonging or in anywise appertaining, and the Reversions and Remainders, Rents, Issues and Profits thereof, and all the estate, right, title, interest, property, claim, and demand whatsoever, of them the said party of the first part, in law, equity, or otherwise, however, of, in, and to the same and every part thereof. TO HAVE AND TO HOLD, the said Messuge, Tenement, Grist Mill and Two Tracts of Land, Containing 27 Acres 110 perches Hereditaments, and Premises, hereby granted or mentioned or intended so to be, with Appurtenances, unto to the said party of the second part his Heirs and Assigns, to and for the only proper use, and behoof of the said party of the second part, his Heirs and Assigns forever. AND the said Philip Dietrick and James Bixler and their wives, and their Heirs, Executors, Administrators, DO, by theses presents covenant, grant, and agree to and with the said party of the second part, their Heirs and Assigns, that they the said Philip Dietrick, James Bixler, and their wives and to heirs, all and singular the Hereditaments and Premises herein above described and granted, or mentioned and intended so to be, with the appurtenances, unto the said party of the second part, Heirs and Assigns, against them the said Philip Dietrick & James Bixler, their wives, their Heirs, and against all and every other person or persons whomsoever, lawfully claiming or to claim the same or any part thereof, by, from, or under him, them, or either or any of them, shall and will WARRENT and forever DEFEND. IN WITNESS WHEREOF, the said parties to these presents have hereunto interchangeably set their hands and seals. Farbes James Bixler Schuylkill County. ss: ON THE Second day of April Anno Domini, 1866 before me the subscriber one of the Justices of the Peace in and for said County, personally appeared named Philip Dietrick and James Bixler, and Eve & Nelly, their wives, and in due form of law acknowledged the above Indenture to be their act and deed, and desired that the same might be recorded as such. AND THE SAID Eve and Nelly being of full age and separate and apart from her husband, by me examined and the full contents of said Indenture being by me made known to her, did declare upon such separate examination, that she did voluntarily and of her own free will and accord, sign, seal, and as her act and deed deliver the said Indenture, without any coercion or compulsion of her said husband.
