That Christena Rembold widow of Henry Rembold deceased, died at her late residence in said Greenville township on the 18th day of June 1893 intestate, leaving to survive her the following named children towit: 1. Christiana who was intermarried with William Faidley of Colfax, Jasper County, Iowa, deceased, leaving issue four (4) children towit: 1. Annie Faidley of Colfax, Jasper Co. Iowa. 2. Levi Faidley " " " " " 3. Henry " " " " " " 4. Simon " " " " " " 2. Joseph Rembold of Eglon, Preston County, West Virginia. 3. Mary wife of Nicholas Dieddle of Greenville TWP, Somerset County, PA. 4. Amelia wife of Frederick Durr of Greenville TWP, Somerset County, PA. 5. Nancy wife of William Bittner of Garett County Maryland. 6. Elizabeth wife of William Wagner of Salisbury, Somerset County PA, deceased. Leaving issue 6 minor children, towit: 1. Joseph Wagner of Elklick, Somerset Co, PA. 2. C____ " " " " " " 3. Mary " " " " " " 4. Jacob " " " " " " 5. Albert(?) " " " " " 6. Martha " " " " " " for all of whom Dr Spircher of Salisbury Somerset Co, PA is guardian. 7. Christena (D_____) wife of John Wright of Elklick, Somerset Co, PA. That the interest of your petitioner is that of a daughter of said deceased. That said decedent died seized of a certain tract or piece of land situate in Greenville township, Somerset County, Pennsylvania, described as follows, towit: Beginning at a pile of stones corner of land now or late of Salome Custers, thence 1/2 deg East 228.3 prs to a stake on line of Peter Engle land, thence S. 78 deg, West 44 prs, to post corner of John Englis Leins, N. 41 deg, East 88 prs to post, thence------ E.15 perches to post on line of Daniel Lepley, thence with said line N. 1/2 deg. west 177.1 perches to post, thence S. 89 1/2 deg. west 100.9 perches to the beginning containing 128 acres & 68 perches & allowance. That no partition of said land has been made, nor can a jury to make partition be selected by agreement of all the parties interested. Your petitioner therefore prays your honor to award an inquest to make partition of the premises aforesaid to and among the said parties interested, in such manner and in such proportions as by the laws of this Commonwealth is directed, if such partition can be made without prejudice to or spoiling the whole, but if such partition cannot be made thereof, then to value and appraise the same and make return of their proceeding according to law.
