He was never in the service. It was shown that he obtained a pension by falsely swearing that he was Levi Burkett, a member of Co. D 63rd Regiment Pa. Infantry, and served through and was wounded in the Rebellion. He was tried in U. S. District Court in Pittsburgh. * He has not yet been sentenced and his age may plead powerfully in his case for the mitigation of his sentence.
