The step- father, William Durst, 65, of the Dry Run section, near Swanton, was lodged in the Garrett County jail, charged with murder. The shooting was the climax of an argument between Filsinger and his wife, Virginia. Mrs. Filsinger is said to have been running in the direction of the Durst home to escape from her husband, who is alleged to have been intoxicated. Mr. Durst warned Filsinger not to come nearer to his house, and when he disobeyed the command he shot him with a single-barrel shotgun. The buckshot charge struck Filsinger in the abdomen. The wounded man was rushed to the Reeves Clinic in Westernport where he died early Monday morning. Filsinger was a native of Deer Park, a son of Mrs. Pearl Filsinger Durst and the late Otto Filsinger. His mother was married to Durst several years ago, after her husband's death. Surviving, besides his mother and wife, are two small children, Paul Edward and Robert Martin; two sisters, Mrs. Kathryn McCracken, of Cumberland, and Mrs. Marie Nicklow, of Terra Alta, W.Va.; a brother, Edward Filsinger, of Cumberland, and a half-brother, William C. Durst, of Swanton. The body was removed to the Winterberg Funeral Home at Grantsville. Meyersdale Republican, July 18, 1940
