LAST WILL & TESTAMENT OF DANIEL FAIDLEY COURT RECORD To the honorable the judges of the Orphans Court of Somerset County. Your auditor appointed as per the foregoing commission to distribute the fund in the hands of Susan Faidley administrator of Daniel Faidley, late of Lincoln Township, deceased, after due notice by publication in the "Somerset Standard" and "Somerset Herald" two weekly newspapers published in the borough of Somerset, of the time and place of meeting sat at his office in the said borough of Somerset on Saturday the 25th day of February 1899, attended by Susan Faidley administrator as aforesaid and by his councel F.J. Kooser Esquire., - Sarah Faidley widow of Daniel Faidley deceased, now wife of John J. Casebeer, Lewis Trimpey husband of Ellen Faidley and Samuel Faidley were also present. From the testimony there taken and hereto appended, and from the records your auditor finds as FACTS 1. Daniel Faidley died on the 12 day of July 1897, intestate, leaving to survive him a widow Sarah Faidley since intermarried with John J. Casebeer, and issue ten children, towit: 1. Simon Faidley, of upper Turkeyfoot TWP, Kingwood P.O. 2. Samuel Faidley, of Lincoln TWP, Edie, P.O. 3. Sevilla wife of Daniel Henry, upper Turkeyfoot TWP, Scullton P.O. 4. Alexander Faidley, Lincoln TWP, Edie P.O. 5. Elizabeth wife of John D. Arnold, Greenville TWP, Pochantes P.O. 6. Nelson Faidley, Upper Turkeyfoot TWP, Kingwood P.O. 7. Hiram Faidley, " " " 8. Susan wife of David Sanner, " " 9. Harvey Faidley, " " 10. Ellen wife of Lewis Trimpey, Lincoln, Sipesvill, P.O. 2. The heirs by an agreement in writing hereto appended have agreed that the note of Hiram Faidley shall not bear interest. 3. The note of Samuel Faidley to Walter & Jones and assigned to Daniel Faidley, dated Aug 31, 1874 calling for $13.50 at 1 day is defeated by virtue of the agreement made between Samuel Faidley and Daniel Faidley in 1889 or 1890 when Sanuel purchased about twenty acres of land from his father Daniel Faidley, by which said agreement their note was to be regarded as having been paid. 4. The administrator is entitled to credit for the additional items, as follows: for acknowledging deed 50 cents, Joseph Crise account $1.00 and Elias Griffith account $4.07. .
