I John Speicher of Stony Creek Township County of Somerset and State of PA being sick and weak in body but of sound mind, memory and understanding, praised be God for the same and considering the certainty of death and the uncertainty of the time thereof, and to that end I may be the better prepared to leave this world whenever it shall please God to call me hence, do therefore make and declare this my last will and testament in manner following, that is to say, I commend my soul into the hands of Almighty God and my Creator, hoping for free pardon and remission of all my sins and enjoy everlasting happiness in the heavenly kingdom through Jesus Christ, my Savior. My body I commit to the earth at the discretion of my executors herein after named, and as to such worldly estate wherewith it hath pleased God to entrust me with, I disperse of the same as follows. I will that my beloved wife Polly shall continue housekeeping in the same manner as she has done heretofore and to pay the debts owing at the time of my death but if it should appear that it cannot be done in that manner then I will that my executer make paid so much as will satisfy or as much as she can spare all debts owing as aforesaid and when they are so paid then I will that my wife shall have full privilege of the place we now live in and continue housekeeping with her children as long as she may be pleased to do so or as long as she bears my name, but if she should be disposed to give up housekeeping then she shall keep her seat in the house we now live in or have a house built for her if she shall think it more convenient and have a full third of the income of the place during her natural life. After the death of my beloved wife or in case she should be again married in either case it is my will that my property be then sold by my executor both real and personal and the proceeds thereof be divided among my children namely Benjamin, Susanna, Milly, John, William, Daniel, Jacob, Anna and Peggy equal share and share alike. I do also empower my hereinafter named executor to make deed in (?) for the same when sold. And lastly I make and ordain Jacob Weigle executor of this my last will and testament - revoking all former wills by me heretofore made. In witness whereof I have to this my last will set my hand and seal the twenty-second day of May in the year of our Lord 1840. Signed, sealed and acknowledged by the testator in the presence of the subscribers as his last will and testament. Tobias Musser John Speicher Christian Bare Somerset County - Personally came before me, Samuel Elder Register for the probate of wills and granting letters of administration in and for said county, on the thirteenth day of June A.D. 1840 Tobias Musser and Christian Bare, the subscribing witnesses to the foregoing will, who being duly qualified do depose and say that they were present and saw and heard John Speicher, the within testator, sign, seal, publish, pronounce and declare the foregoing testament of writing as and for his last will and testament and that at the time of so doing he was of sound mind, memory and understanding to the best of their knowledge and beliefs. Affirmed and subscribed before me this 13th June A.D. 1840 Samuel Elder, Register Tobias Musser Christian Bare Letters testamentary upon the estate of John Speicher late of Stony Creek Township, Somerset County, deceased granted to Jacob Weigle, the executor appointed in the foregoing will on the 13th June A.D. 1840.
