I Philip Weagley of Brothers Valley Township, Somerset County, State of Pennsylvania being sick but of sound mind memory and understanding (praised be God for the same) and being advised to settle my worldly affairs whilst I have strength and capacity so to do. Do make and publish this my last Will and Testament. And first and principally I commit my soul unto the hands of my Creator who gave it and my body to the earth and as to such worldly Estate wherewith it hath pleased God to entrust me I dispose of the same as follows to my first item I will that all my just debts and funeral expenses shall be paid by my Executors herein after mentioned. Second item I give unto my beloved wife Elisabeth the one half of all my Estate real and personal. Thirdly I give unto my friend George Knepper intermarried to Tracy Weagley five hundred dollars. Fourthly I give and bequeath unto Elisa Weagley the daughter of Polly Croft who has since been married and her husbands name not known the sum of five hundred dollars. Fifthly I give and bequeath unto my brother Frederick four hundred dollars. Sixthly I give and bequeath unto my sister Catharine Glessner's children each one hundred dollars. Seventhly I give and bequeath unto my brother John Weagley's each one hundred dollars. Further my Executors shall after my death proceed to sell all my personal property other than such as my wife may think proper to take at the appraisement which shall be considered a part of her share as soon after my death as she shall think proper. Further as to my real estate my will is that the plantation whereon I now live shall not be sold under five years after my death which my will is shall be farmed by Seth Weigley as usual and give my wife one third of all the grain, hay, apples and all that is raised on the plantation with such pasture and privilege in the barn and stable as she may want with such privilege with the house and garden, milk house and the yard and as she may want. Further the said Seth Weigley shall keep the fences in repair and make such new fences as shall be necessary. Further my Executors shall commence paying as follows as soon as conveniently can be done, first with Elisa Weigley, daughter of Polly Croft. Second then to George Knepper married to Tracy Weigley, then thirdly to my Brother Frederick all to be paid with the sums aforementioned then the balance bequeathed unto my Sister Catharine's children and my brother John's children. If it cannot be paid out of my personal property as before mentioned than in such case they shall wait for their sums until the real estate is sold. Further all the balance remaining after paying over and about legacy's I give and bequeath unto my Brother John's children. Further should the said Seth Weigley not agree to farm the said plantation then in such case my Executors shall rent it with the full intents and meaning as before mentioned. Further I do hereby appoint my trusty friends Tobias Miller and George Walker, Esquire my Executors of this my Last Will and Testament and revoking all other wills declaring this my Last Will and Testament. John Brubaker } Philip Weigley {seal} Michael Rheam } Somerset County SS: This first day of November A.D. 1836 personally came before me Jacob Kimmel, Register for the probate of Wills and granting of Letters of Administration in and for the County of Somerset Michael Rheam and John Brubaker the subscribers witnesses to the foregoing will who being sworn do depose and say that they were present and saw and heard Philip Weigley the within named testator sign seal publish pronounce and declare the within Instrument of Writing purporting to be his last will and testament and at the time of so doing he was of perfect and sound mind memory and understanding to the best of their knowledge and understanding and belief and have signed their names in witness hereto in his presence and at his request. Jacob Kimmel, Register John Brubaker Michael Rheam Registered 1st November 1836 Letters Testamentary Philip Weigley Estate Somerset County, ss: By the tenor of these presents, I Jacob Kimmel Register for the probate of wills and granting letters of administration in and for the County of Somerset in the Commonwealth of Pennsylvania, do make known unto all men, that on the day of the date thereof at Somerset before me, was proved, approved and insinuated the last will and testament of Philip Weigley late of said County deceased: (a true copy whereof is to these presents annexed) having whilst he lived and at the time of his death, divers goods, chattels, rights and credits within the said Commonwealth. By reason whereof the approbation and insinuation of the said Last Will and Testament, and the committing the Administration of all and singular the goods and chattels, rights and credits, which were of said deceased, and also the auditing the accounts, calculations and reckoning of the said Administrations and a final dismission from the same, to me are manifestly known to belong; and that the Administration of all and singular the goods and chattels, rights and credits, which were of said the deceased any way concerning his last will and Testament was Committed to Tobias Miller and George Walker, Executors in the said last will and testament named having been just affirmed and sworn well and truly to Administer the goods and chattels of the said deceased; and make a true and perfect inventory thereof and exhibit the same into the Registers Office at Somerset, on or before the 30th day of November next, and to render a just and true account, calculation and reckoning of the said Administration on or before the first day of November next ensuing. In Testimony whereof I have hereunto set my hand and the seal of the said County of Somerset, this first day of November in the year of our Lord one thousand eight hundred and thirty six.
