Petition for Citation: Now December 19th, 1910, filed the petition of James Ryan, setting forth as follows: That he is a son of Jeremiah Ryan, late of the Township of Apolacon, deceased, who died on the second day of October, one thousand eight hundred and seventy five, testate, and by the terms of his will and testament bequeathing One Hundred (100.00) dollars to each of his children Ellie, Elizabeth, Ann and your petitioner, James Ryan, to be paid as soon as they become of age, without interest. Your petitioner represents that he is now aged thirty-eight (38) years and has never received the said sum of One hundred (100.00)Dollars or any part therefore; that under item fourth of said will, the real and personal estate of the said Jeremiah Ryan, deceased, was devised to Catherine Ryan, his wife, during her natural life, and upon her death to go to her two sons, Jeremiah and William, if living, conditioned upon thier payment of certain bequest in said items mentioned, among them the sum of One hundred (100.00) dollars to your petitioner as herinbefore set forth; a copy of the said last will and testament of Jeremiah Ryan, deceased, is hereto attached and made a part of this petition. Your petitioner further sets forth that the said Jeremiah Ryan, son of the decedent and testor, is now resising in Buffalo, N.Y., and William Ryan , another son the said decendent and testator, is now resideing in Apolacon Township. Your petitioner therefore prays your Honorable Court to grant citation agreeabley to the terms of the Act of Assembly in such case made and provided for the purpose of enforcing this charge upon the real estate aforesaid. And yourpetitioner will ever pray. And now, Dec. 19th, 1910, on the within petition of James Ryan and on motion of W.D. B. Ainey his attorney, Court order a citation to issue in the above entitled matter directed to Patrick Walsh and William Hartigan, executors of the last will and testament of Jemeriah Ryan, deceased, and to Jeremiah Ryan and William Ryan, heirs and devisees of the real estate sought to be charged; citation to be returnable to second Monday of January, 1911.
