All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/susquep.html ________________________________________________ Transcribed from SAMPUBCO copy by Bruce Collier on February 10, 2004 Susquehanna County, Pennsylvania Will Book, Vol. 1, page 61-63 Last Will and Testament of Asa Lathrop, Deceased I, Asa Lathrop of the township of Springville in the County of Susquehanna and the State of Pennsylvania, do make and ordain this my last will and testament in manner and form following: I give and bequeath to my well beloved son James Lathrop, his heirs and assigns, one equal undivided fourth part of four hundred acres of unimproved land being and lying in the township of Auburn, county of Susquehanna, state of Pennsylvania, the said four hundred acres being a part of a tract of land I now own in said township containing seven hundred acres and lying on the southeast corner of said lot. Furthermore, I give my said son James, his heirs and assigns, the lot of land he now lives on in the township of Springville, county and state aforesaid, with all the appurtances thereunto belonging, which has been surveyed to him by Henry Parke, also another piece or tract of land of the same width of the tract which he now lives on running north to the north line of the lot of land, be the same, more or less. Also one third of the Grist Mill, one third of the Millhouse, one third of the lot of land which is now fenced out for the purpose of the mill, one third of an acre of the land where the mill now stands to be laid out in such a manner as shall be the most convenient to the mill and the least injurious to the owners of the lands adjoining it and all the ways, rights, liberties and privileges of bringing water from the lake to the Grist Mill which I myself now have. more it is considered and he is hereby bound to do his share or proportion And further towards supporting, maintaining and keeping the upper sawmill dam. I give and bequeath to my well beloved son, Walter Lathrop's children (vis.) Lucy Maria Lathrop, Leonard Heart Lathrop, George Leander Lathrop, and Lorinda Lathrop, their heirs and assigns one hundred acres of land in the township of Springville, in the County of Susquehanna and the State of Pennsylvania lying on the west side of my farm which I now live on the said hundred acres was surveyed by Henry Parke also one other tract of land on the east side of my farm which I now live on extending from my north line extending south to the state road and as far west as the line of the lot of land which I have given to my son James Lathrop be the same, more or less, with the buildings thereon excepting the millhouse and the lot which is fenced out for the purpose of the mills. But they, the said children, shall not have possession of the lot east of my son James lot until after the deceases of my dear beloved wife Allis Lathrop, but at her death they are to have peaceable possession of it without motestation. (sp?) I give and bequeath to my beloved son Asa Lathrop, his heirs and assigns one hundred acres of land where he now lives in the township of Springville in the county of Susquehanna, state of Pennsylvania which was surveyed to him by Henry Parke, also one equal undivided fourth part of four hundred acres unimproved land, being and lying in the township of Auburn in the county and state aforesaid. The said four hundred acres being part of a tract of land I now own in said township containing seven hundred acres and being on the southeast corner of said lot; furthermore I give to my said son Asa Lathrop, his heirs and assigns two-thirds of the Grist Mill, two-thirds of the Mill house, two-thirds of the lot of land now fenced out for the purpose of the mill, two-thirds of an acre of land where the mill now stands to be laid out in such a manner as shall be the most convenient for the mill and the least injurious to the owners of the land adjoining it. And all and singular the ways, rights, liberties and privileges of bringing the water from the lake to the Grist Mill, which I myself now have. And furthermore, it is considered and he is hereby bound to do his share or proportion toward supporting, maintaining and keeping in repair the upper sawmill dam. I give and bequeath to my well beloved daughter Abigail Edde, her heirs and assigns one equal undivided fourth part of four hundred acres of unimproved land being and lying in the township of Auburn in the county of Susquehanna and the state of Pennsylvania the said four hundred acres being part of a tract of land I now own in said township containing seven hundred acres and being on the southeast corner of said lot. Furthermore I give and bequeath to her the one equal and undivided half of all my lands lying south of the State road with all excepting what I have heretofore given to my other children. I give and bequeath to my well beloved daughter Allis Paige, her heirs and assigns one equal undivided fourth part of four hundred acres of unimproved land being and lying in the township of Auburn in the county of Susquehanna and the state of Pennsylvania the said four hundred acres being part of a tract of land I now own in said township containing seven hundred acres and being on the southeast corner of said lot. Furthermore I give and bequeath to her the one equal and undivided half of all my lands lying south of the State road with all appurtenances thereunto belonging excepting what I have heretofore given to my other children. I give and bequeath to my dear beloved wife Allis Lathrop feasible and quick possession of all the improvements of all that part of my farm which I now live on as far south as the state road and west as far as my son James Lathrop's land with all the appurtenances thereunto belonging for her own proper use and benefit together with as much of the household furniture, farming utensils and other personal property as she may think necessary and proper for her use and benefit during her whole lifetime, and when she shall have done with the personal property, she may dispose of it as she in her opinion may think proper and best, and all the rest and residue of my estate, goods and chattels, I put into the hands of my dear beloved wife Allis Lathrop, my well beloved sons James and Asa Lathrop ( for to pay my debts) whom I nominate, constitute and appoint my executors of this my last will and testament hereby revoking all other and former wills be me at any time heretofore made. And if anything remains after all my just debts are paid, I hereby order and direct my executors to make an equal distribution of the same among my legal heirs. In witness whereof I have here unto set my hand and seal the eighteenth day of August in the year of our Lord one thousand eight hundred and twenty seven. Asa Lathrop {S & S} Signed, sealed, published and declared by the testator Asa Lathrop as and for his last will and testament in the presence of us who have subscribed our names as witnesses hereto in the presence of the testator. Seth Taylor Dyer Lathrop John Young Susquehanna County: On the seventh day of September, 1827 came Seth Taylor and on the tenth day of the same month came Dyer Lathrop, two of the subscribing witnesses to the foregoing will, and being duly sworn according to law did dispose and say that they were present and saw and heard Asa Lathrop the testator, sign, seal, publish, pronounce and declare the forgoing instrument of writing as and for his testament and last will, and at the time of so doing he was of perfect and sound mind, memory and understanding to the best of their knowledge, observation and belief. Asa Dimock, Register for the probate of wills and granting letters and administration in and for the County of Susquehanna. I, Asa Lathrop of Springville township in the County of Susquehanna and State of Pennsylvania, do make this codicle to be taken as a part of my last will and testament as follows (that is to say) Where as I have signing said will given to my son Walter Lathrop's children (viz) Lucy Maria Lathrop, Leonard Heart Lathrop. George Leander Lathrop and Lorinda Lathrop their heirs and assigns certain real estate in my said will mentioned and as they, the said children are yet underage, and as I have not appointed anyone in my said will to see to or take care of the said estate which I have given to them, I now nominate, constitute and appoint my dear beloved wife Allis Lathrop, my well beloved sons James and Asa Lathrop executors in my said will mentioned to take all necessary and prudent care of said estate for them that they the said children may have all the profits arising there from after the decease of my beloved wife Allis. In witness whereof I have to this codicile annexed to my said will set my hand and seal the thirteenth day of August in the year of our Lord one thousand eight hundred and twenty seven. Asa Lathrop {S & S} Whereas sealed, published and declared by said testator Asa Lathrop as a codicle to be annexed to his last will and testament in the presence of us who have subscribed our names as witnesses thereto in the presence of the said testator. Seth Taylor Caleb Barnes John Palmer Susquehanna County: On the Seventh day of September 1827 personally came Seth Taylor and on the tenth day of the same month personally came John Palmer two of the subscribing witnesses to the foregoing codicile to be annexed to the last will and testament of Asa Lathrop, deceased, and being duly sworn did dispose and say that they were present and saw and heard Asa Lathrop the testator, sign, seal, publish, pronounce and declare the said instrument of writing as and for a codicile to be annexed to his testament and last will and at the time of his doing so he was of perfect and sound mind, memory and understanding to the best of their knowledge, observation and belief. Asa Dimock, Register for the probate of wills and granting letters and administration in and for the County of Susquehanna. And now on the tenth day of September AD 1827, The foregoing will and codicle is proven and registered according to Law and Letters testamentary and a copy of said will annexed is granted unto Allis Lathrop, James Lathrop and Asa Lathrop, the executors in the said will named. They the said Allis Lathrop, James Lathrop and Asa Lathrop having been duly sworn well and truly administer the goods and chattels, rights and credits of the said Asa Lathrop, deceased to make a true and perfect inventory thereof and exhibit the same into the Registers office at Montrose for the County of Susquehanna in one month from this date and a final settlement reckoning of the estate of the said Asa Lathrop, deceased in one year or when thereunto legally required, And also diligently and faithfully to regard and well and truly comply with the provisions of the act of assembly of this commonwealth of the seventh day of April 1826 entitled "an act relating to collateral inheritance" October 10th 1827 Filed Inventory.
