Merriman presented an instrument in writing purporting to be the last will and testament of Roswell Smith of the township of Franklin in the County of Susquehanna, deceased, for probate, and produced by J.L. Merriman and Mercy Merriman Subscribing Witnesses to said instrument who after being duly sworn according to Law, say that they were present at the execution of and did see and hear the testator therein named, sign, seal, publish, pronounce and declare the said instrument as and for his testament and last will and that at the time of his so doing he was of a sound disposing mind memory and understanding to the best of their declaration and belief. Whereupon the instrument or paper Writing is admitted to probate as proven to be the testament and last will of Roswell Smith late of Franklin in the said County and is in the words following to Wit: Will I Roswell Smith of the township of Franklin the County of Susquehanna, State of Penna. Do make and publish this my last Will and Testament hereby revoking and making void all former Wills by me at any time heretofor made. And first I direct that my body be decently intered in the burying gound of the Presbyterian Church of Franklin aforesaid according to the rites and ceremonies of the said Church and that my funeral be conducted in a manner corresponding with my estate and situation in life. And as to such worldly estate as it hath pleased God to intrust me with I dispose of as follows. First I direct that all my debts and funeral expenses of myself and wife be paid as soon after our decease as possible, out of the first money that shall come into the hands of my executor, from my portion of my estate real or personal. Secondly, I also hereby Will and bequeath all my real and personal property (with the exception of enough to purchase and set up at the graves of myself and wife suitable tombstones) to my son Harry Smith, A(sic) - I do hereby make and ordain my esteemed son Harry Smith Executor of this my last Will and Testament. In Witnesss Whereof I Roswell Smith the testator have to this my will written on one sheet of paper set my hand and seal this ninth day of December in the year of our Lord one thousand eight hundred and forty seven.
