John A. WARNER, Will and Probate, 1875 page 1 In the matter of Probate of Will of John A. Warner dec'd And now to wit May 15, 1875 was presented for Probate an endorsment of writing perporting to be the last Will and Testament of John A. Warner, late of the township of Jessup in the said county deceased, and at the same time came A. W. Bertholf and John H. Lake the subscribing witness to the said instrument of who being duly sworn according to law did say that they were present and saw and heard the said John A. Warner sign, seal and publish, pronounce and declare the said instrument of writing as and for his Last Will and Testament and at the time of his so doing he was of sound and disposing mind and ensuring to the best of their knowledge & belief, Whereupon said instrument of writing was admitted to Probate as duly proven to be the Last Will and Testament of John A. Warner and is in the words following to wit. I John A. Warner of the township of Jessup, County of Susquehanna and State of Pennsylvania. Yeoman being of sound mind, memory and understanding do make and publish this my last Will and Testament hereby revoking and making and all former Wills by me at any time hencefor made. And first I direct that my body be decently interred in a neat plain Casket without extra expense and that my funeral be conducted in a manner corresponding with my estate and situation in life. As to such estate as it hath pleased God to intrust me with I dispose of the same as follows, viz: Item. I give and bequeath to my beloved wife Catherine F. Warner the sum of one hundred fifty dollars absolutely to be paid immediately after my death or so soon thereafter as may be without injury to my estate. Item. I give and bequeath to my daughter Mary Warner the sum of one hundred dollars, said sum to be put out at interest, and the interest thereof added each year to the principal and kept as one common fund until she shall arrive at the age of eighteen years. when the same shall be paid to her without reserve. Item. I give and bequeath to my daughter Clarra Warner the sum of one hundred dollars, said sum to be put out at interest, and the interest thereof added each year to the principal and kept as one common fund until she shall arrive at the age of eighteen years, when the same shall be paid to her without reserve. Item. I give and bequeath to my daughter Julia Warner the sum of one hundred dollars, said sum to be put out at interest. and the interest thereof added each year to the principal and kept as one common fund when until she shall arrive at the age of eighteen years, the said principal and interest shall be paid to her without reserve. Item. I give and bequeath to my son Benjamin Warner the sum of one hundred dollars, said sum to be put out at interest, and the interest thereof added each year to the principal and kept as one common Page 2 fund until he arrives at the age of eighteen years when the same shall be paid to him without reserve. Item. I give and bequeath to my son Harry Warner the sum of one hundred dollars, said sum to be put out at interest and the interest thereof added each year to the principal and kept as one common fund until he arrives at the age of eighteen years when the same shall be paid to him without reserve. Item. I give and bequeath to my son Edward Warner the sum of fifteen dollars to be paid out as soon after my decease as may be without injury to my estate. Item. All the real and residue of my estate whatsoever and wheresoever of what nature, kind and quality soever the same may be and including the household furnature, after paying my just debts and funeral expenses I give and bequeath unto my said wife Catherine F. Warner the same to be considered as a fund and placed at interest, said interest to be paid to my said wife annually and so much of the principal thereof annually as she may see to procure the necessary comforts of life for herself and minor children. Provided that if after my decease my said wife shall again marry, then in that event the proceeds of whatever there may be remaining of said last mentioned fund if any shall be applied toward the support and scholling of the minor children until they shall all respectively come of age, and when the youngest of my said children shall become of age or when all of my said surviving children are of age then what remains of said fund to be divided equally among them share & share alike. And if my said wife shall remain a widow. then she to have exclusive use of said fund as a above set forth for and during her natural life. That a certain Life Insurance Policy No 429, issued to me by Odd fellows Mutual Life Insurance Company of Montrose Pa. be taken, considered and treated as a part of the general assets of my estate and applied as above decided. I will, deed and decree the Cow and and Pig be kept undisposed of for the use of the family. And lastly I do hereby constitute and appoint A. W. Bertholf of Montrose, Susquehanna County, Pennsylvania, Executor of this my last Will and Testament. In Witness whereof I John A. Warner the Testator have to this my Last Will and Testament set my hand and Seal this fourth day of March A.D. one thousand eight hundred and seventy five. Bertholf the Executor named in the last Will and Testament of John A. Warner late of Jessup in said county dec'd upon all and singular the goods and Chattels rights and credits which were of the said decedant. The said A. W. Bertholf having first been duly sworn. And the affidavit of John H. Lake duly filed firming the date of death of said decedant on the 3rd of May 1875 May 20 1875 filed inventory accounting to $1891.00 August 20 1875 filed vendor paid $140.53
