Was presented for Probate an Instrument of Writing purporting to be the Last Will and Testament of Ellery Washburn late of the Township of Thomson in said County deceased; and at the same time came J. D. Miller and W. W. McNamara, the subscribing witnesses to the said Instrument of writing who being duly sworn according to law did say: that they were present and saw and heard the said Ellery Washburn sign, seal, publish, pronounce and declare the said Instrument of Writing as and for his Last Will and Testament, and at the time of his so doing he was of sound and disposing mind and memory to the best of their knowledge and belief: Whereupon the said Instrument of Writing was duly admitted to Probate as fully proven to be the Last Will and Testament of the said Ellery Washburn Deceased: and is the words following, to wit -:- I, Ellery Washburn, of the Township of Thomson, in the Couty of Susquehanna and State of Pennsylvania do make this my Last Will and Testament hereby revoking and making void any other WIlls by me at any time hereto fore made. FIRST- My will is that all my just debts and funeral expenses be paid as soon after my decease as convenient SECOND: All the rest of my estate real personal and mixed of whatever kind or whereever situate at the time of my decease I give devise and bequeat as follows:- (a) The use thereof for Fifteen(15)years after the date of my death - I given devise and bequeath to my two children - Lela Bell and Ralph Harold, share and share alike (b) At the expiration of Fifteen years from the date of my death I give devise and bequeath the residue to my children Alice Gertrude Sampson, WInnie Pearl Jacobs, Roscoe S. Washburn, Arthur Franklin Washburn, Lela Bell Washburn and Ralph Harold Washburn, share and share alike: Provided however if my son ROscoe during the said term of fifteen years will reside on and work my farm in Thomson Township and provide thereon a good home and suitable maintenance for my two children Lina Bell and Ralph Harold, (also for my wife as long as she remains a widow) There and in that case my said son Roscoe at the expiration of the fifteen years shall have one half of the said Residue, and the other half to be divided between the other children above named, in equal shares: should he fail to perform these conditions, then the said residue to be equally divided as stated in the beginning of this section. THIRD: I nominate and appoint F. D. Wrighter of the Township of Thomson to be the Guardian of my minor children and direct -that should my sn Roscoe desire to reside on my farm in THomson Township and provide thereon a home and sutable maintenance in accordance with the provisions of section (b) clause second hereof, for my two children Lela Bell and Ralph Harold, and my wife Eva, during the period she remains my widow, there and so long as my son Roscoe performs these conditions, I direct the said Guardian to allow him to occupy the said farm free of rent - he to pay however the entire taxes assessed thereon. In order to avoid disputes, the said Guardian is to be the sole judge as to the faithful performance of the conditions aforesaid. And LASTLY, I nominate and appoint my friend F. D. Wrighter of Thomson to be the Executor of this my Last Will and Testament. In witness whereof I have to this my Last WIll and Testament, written on one sheet of paper, suscribed my name and affixed my seal this 15th day of March A.D. 1897 Ellery Washburn [seal] Signed Sealed and Acknowledged by the said Ellery Washburn as and for his Last Will and Testament in the presence of us, who at his request and in his presence and in the presence of each other have hereunto subscribed our names as the witnesses unto G.D.
