Burrows presented an instrument in writing purporting the last Will and testament of Thaddeus Whitney with a codicil thereunto annexed, and pronounced U. Burrows and J. Smiley subscribing witnesses to said instrument, who after being duly sworn according to law say that they were present at the execution of and did see and hear the testator therein named, sign, seal, publish, pronounce the said instrument and also the codicil thereunto attched as and for his last WIll and testament that at the time of his so doing he was of a sound disposing mind, memory and understanding to the best of their observation and belief. Whereupon said instrument or paper Writing is admitted to probate as Sworn to be the testament and last will of Thaddeus Whitney late of Gibson in said county decesed. and is in the words following, to Wit: In the name of God, Amen. I Thaddeus Whitney of the Township of Gibson in the County of Susquehanna and State of Pennsylvania being of sound mind, memory, and understanding by weak in body and admonished by fading health of the uncertainty of life, the certainty of death, and the uncertainty of the time thereof, to the end I may be better prepared to leave this world whenever it shall please God to call me hence, do therefore make, ordain, publish and declare this to be my last Will and testament. That is to say, first and principally I commend my soul into the hads of Almighty god, my creator, hoping for free pardon and remission of all my sins, and to enjoy everlasting life in the heavenly kingdom, through Jesus Christ my redeemer and Savior. And as to such worldly goods as it hath plesed God to intrust me with I dispose of the same as follows First I direct that all my just debts be duly paid as soons they conveniently can be after my decease. I give and bequeath unto my dear wife THIRZA all of my beds, beding household furniture, and housekeeping articles. Also one undivided half of all of the cattle (excepting one pair of fat oxen now on hand) hourses, carriages, wagons, sleighs, harnesses, and all farming tools, and utensils, grain and provisions that may be owned by me at the time of my decease, also one undivided half of all my land, and the appurtenances thereon, Excepting the sixteen acres hereinafter bequeath to my son HARLAND S. I give and bequeath to my son WILBERFORCE R. the other undivided one half of all my lands with the appurtenances thereon, Excepting the before mentioned Sixteen acres. Also the other undivided half of all the cattle (excepting one pair of Fat oxen now on hand) horses, carriages, wagons, sleighs, harnesses, and all farming tools and utensials, grain and provisions that may be on hand, and owned by me at the time of my decease. And all upon the following conditions, to wit, that he shall pay my daughter HENRIETTA M. any balance bequeathed to her remaining upaid after other means of paying her, and the other heirs are exhasted that the sum so to be paid by him does not exceed three hundred dollars and I direct that any excess over that sum, that shall be required shall be paid by my wife THIRZA, and that HENRIETTE M. shall be entitled to interest on the amount to be paid to here to commence six months from the time of my decease provided also that the farm shall be carried on jointly by Wilbreforce R. and his mother as long as she may prefer so to do, and that HENRIETTE M shall have a home with them so long as she remains unmarried. Having paid to my sons JOSEPH E. and FRANCIS M. three hundred dollars each which is all that I prepose to give to them, and to my son FREEMAN P eighty dolars. I give and bequeath to my son FREEMAN P unless the same shall be paid previous to my decese (I having signed an obligation with him for the payment of two hundred dollars) two hundred and twenty dollars. I give and bequeath to my son HARLAND S. Sixteen acres of land, to be taken from the back end of my farm adjoining PRESERVID PICKERINGS land the line to run across the farm and parallel with the back line of the same. I estimate the amount that I have given to my three married daughters at the time of their marriage, and since to be as follows, to wit JULIA ANN since deceased, Eighty dollars JANE M. and HARRIET A. one hundred dollars each and I give and bequeath to them and to my daughter HENRIETTE M. as folows to with To the heirs of JULIA ANN deceased. One hundred and seventy dollars. TO JANE M & HARRIETT A one hundred and fifty dollars each, and to HENRIETTE M Two hundred and fifty dollars making with amounts previsouly paid two hundred and fifty dollars to each. In consideration of something more than eight years faithful services of my daughter Henrietta M. in the family I give and bequeath to her the further sum of Two hundred dollars. I give and bequeath to my dear wife THIRZA all the residue of my estate, Likewise I make consititute and appoint N.E. KENNEDY and SAMUEL S. INGALLS both of Gibson, sole executors of this my last will and testament hereby revoking all former WIlls by me made In witness whereof I Thaddeus Whitney the testator have hereunto to set my hand and seal this tenth day of January in the year of our Lord one thousand eight hundred and sixty Thaddeus Whitney [seal] The above written instrument was signed, sealed, declared and published by the above named Thaddeus Whitney as and for his last will and testament in presence of us, who at his request and in his presence and in the presence of each other have subscribed our names as witnesses there to Urbane Burrows John Smiley CODICIL WHereas I Thaddeus WHitney of the Township of Gibson in the county of Susquehanna, and State of Pennsyl nia have made my last will and testament in writing bearing date to the tenth day of January in the year of our Lord one thousand eight hundred and sixty in and by which I have given and bequeathed to my son Freeman P two hundred and twenty ($220) dollars. to the heirs of my deceased daughter Juila Ann one hundred and seventy ($170) dollars and to my daughters Jane M and Harriet Al one hundred and fifty ($150) dollars each. Now therefore I also by this my writing, which I hereby declare to be a codicil to my said last will and testament, and to be taken as a part thereof, order and declare that in consideration of my protracted sickness and of the expences nessarily attending the same and of the sum of two hundred ($200) having been paid to my son Freeman P since the making of my said will that the remaining sum of twenty ($20) not be paid to him and that to the heirs of my deceased daughter Julia Ann, and to each of my daughters Jane M and Harriet A there shall be paid fifty ($50) dollars less than the sums severally bequeathed to them, and that there shall be paid to them instead of the same named in my said Will as follows to with to the heirs of Julia Ann deceased One hundred and twenty ($120) dollars and to Jane M and Harriet A one hundred ($100) each.
