John MacPherson & others Administrators of John MacPherson late dec'd Deed to Jesse Cawley This Indenture made this nineteenth day of May in the year of our Lord one thousand eight hundred and thirty six between John MacPherson and Archibald MacPherson Administrators of all and singular the goods and chattels rights and credits which were of John MacPherson late of Union township Union County and State of Pennsylvania deceased of the one part and Jesse Cawley late of the County Of Northampton, but now of the Township of Union in the County and state aforesaid Witnesseth. Whereas the said John MacPherson deceased in his life time became lawfully seized in his demand as of fee by virtue of a deed dated the 4th day of December 1778 of and the following described tract of land beginning at an Ash on the South side of the West Branch of the river Susquehanna thence along the said branch South forty five degrees, East seventy eight perches to a post, thence along the said branch South twenty seven degrees East eighteen and half perches to a post, thence by William McCloskey, now Cowden & Merrill land South fifty seven degrees & half West two hundred & seventy eight perches to a post, thence North sixty seven degrees West ninety one perches to a Spanish Oak thence South seven degrees East fifty two perches & half to a White Oak, thence by land of John Lee North fifty seven & half degrees East two hundred & fifty four perches to a post, thence South forty degrees East twenty six & half perches to a Black Oak thence North fifty degrees East thirty four & half perches to beginning containing two hundred acres and allowances and the said John MacPherson in his life time was further seized by virtue of a deed from Robert Lee and wife of the following piece of land beginning at a marked Ash on the bank of the West Branch of the river Susquehanna thence by land surveyed for Alexander Craig South fifty degrees West thirty four perches and half to a marked Black Oak North forty degrees West twenty six perches & half to a post thence by a line to a Locust marked on the bank of said river thence down the river to t allowances and the said John MacPherson was also seized by virtue of a patent dated March 25 1805 of a tract of land beginning at a Black Oak thence by land of Jacob Haines North twenty two degrees West forty one perches to a pine North sixty one degrees East one hundred & thirty three perches to a Hickory thence by land of Alexander Craig North seventy eight degrees West seventy six perches to a White Oak South sixty one degrees West seventy two perches to a post North sixty nine degrees West thirty five perches to a pine thence by other land of John MacPherson South eighteen degrees East ninety perches to a post thence by land of Daniel Rees South seventy six degrees East forty three perches to the beginning containing forty six acres and an half & allowances and the said John MacPherson in his life time was further seized of a tract of land by Patent dated March 25th 1805 beginning at a pine thence by improved land South twenty two degrees East one hundred perches to a post thence by land of Lewis Booker North sixty one degrees East fifty one perches to a Hickory thence by land of Daniel Rees South seventy six degrees East twenty perches to a post thence by other land of John MacPherson North eighteen degrees West ninety perches to a pine thence by land of Alexander Craig North sixty nine degrees West sixty seven perches to a Spanish Oak thence by land ofHironimus Augustan South seven degrees East thirty one perches to a White Oak and South sixty nine degrees West sixteen perches to the beginning containing forty three acres & half and allowances and being so seized thereof the said John MacPherson died intestate after whose death to wit at an Orphans Court held at New Berlin in February 1829 in & for the County of Union upon the petition of John MacPherson and Archibald MacPherson Administrators as aforesaid andbelonging to the said Court, that the personal estate of the said deceased was not sufficient for the payment of the debt of said intestate and praying the Court to direct a sale to be made of a land adjoining the West Branch of the Susquehanna land of Cowden and Merrill of the heirs of Abraham Eyer and others being the land more particularly described above it was considered and ordered by the said Court that the premises aforesaid should be sold at public sale, which said order was continued by the said Orphans Court and at the September Orphans Court 1835. The directed the said premises to be sold on the twenty first day of October 1835 those lots of one acre each more or less having been by order of the court in the meantime conveyed to David Steele and Abraham Kremer in pursuance of a parcel contract with the said John MacPherson in his life time in pursuance of which said order of Orphans Court of September 1835 the said John MacPherson and Archibald MacPherson Administrators as aforesaid after having given due public and timely notice of the time & place of sale did on the day and time therein mentioned expose the premises aforesaid to sale by public venue or outcry and sold the same to Jesse Cawley for the sum of six thousand nine hundred dollars lawful money of the United States, he being the highest bidder and that the best price bidden for the same, which sale or report thereof made to the Judges of the said Court on the sixteenth day of May 1836 was by them confirmed and it was considered and agreed by the said Court that the same should be and remain firm and stable forever as by the records and proceedings of the said Court relation being thereunto had will at large appears. Now this Indenture witnesseth that the said John MacPherson and Archibald MacPherson for and in consideration of the said sum of six thousand nine hundred dollars lawful money of the United States to them in hand paid by the said Jesse Cawley at and before the unsealing and delivery hereof the receipt whereof they do hereby acknowledge and thereof acquit and forever discharge the said Jesse Cawley his heirs Executors and administrators by these presents have granted bargained sold aliened released and confirmed and b pursuance and by virtue of the said order of the Court, do grant bargain sell, alien, release and confirm unto the said Jesse Cawley and to his heirs and assigns all that the plantation above described more particularly in the separate tracts adjoining the West Branch of Susquehanna lands of Cowden & Merrill lands formerly of Abraham Eyer now Nicholas Munch and the lots before mentioned as conveyed to David Steele and Abraham Kremer and others containing by estimation three hundred acres more or less together with all and singular the houses, out houses, buildings, barns, stables, ways, woods, water and water courses , rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto to belonging or in any wise appertaining and the reversions and remainders, rent, issues and profits thereof and also all the estate right title intent property claim and demand whatsoever of the said John MacPherson at and immediately before the time of his decease in law or equity or otherwise howsoever of in to or out of the same to have and to hold the said message or tenement and tract of three hundred acres more or less of land hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said Jesse Cawley his heirs and assigns to the only proper use and behoof of the said Jesse Cawley his heirs and assigns forever. And the said John MacPherson and Archibald MacPherson Administrators aforesaid for themselves their heirs Executors and Administrators do severally and not jointly nor the one for the other but each for his own acts only, convenants, promises, grant, and agree, to and with the said Jesse Cawley his heirs and assigns by these presents that they the said John MacPherson and Archibald MacPherson have not heretofore done or committed any action matter orusing whatsoever whereby the premises hereby granted or any part thereof is one or shall or may be impeached charged or encumbered in title charge estate or otherwise howsoever in testimony whereof these presents have hereto interchangeably set their hands and seals, John MacPherson ss Arch MacPherson ss Sealed & delivered in the presence of James Merrill, James F. Sims, received May 19 1836 of Jesse Cawley Six thousand nine hundred Dollars the ( not present James Merrill) consideration money in full Arch MacPherson, John MacPherson ^ Union County for. Be it remembered that on the 19th day of May A.D. 1836 that John MacPherson and Archibald MacPherson the grantors in the foregoing Indenture, and act acknowledge the foregoing indenturexxx xxx xxx & deed in order that it might be recorded.
