I James SCOTT of Scrubgrass township Venango County Pennsylvania, Farmer, being weakly in body, but of sound mind and memory and understanding, blessed be God for the same, but considering the uncertainty of this transitory life do make and publish this my last will and testament in manner and form following, to witÉ Principally and first of All, I commend my immortal Soul into the hands of God who gave it, and my body to the earth to be buryed [sic] in a decent and Christian-like manner at the discretion of my Executors hereinafter named Ñ And as to such worldly estate wherewith it hath pleased God to bless me with in this life First, after my just debts and buryal [sic] expences [sic] are paidÑ It is further my will that my son James SCOTT shall have that tract of land in the county & township aforesaid on which he now resides except forty acres reserved by me (see the written agreement entered into by us) Further, it is my will and desire that my son Alexander SCOTT shall have the east end of my hometract (situate as aforesaid) to be laid off as follows. Beginning on the north side of said tract where the county road crosses the same in a direction to Franklin thence in a South direction on said road so far as to include the new medow [sic], thence east until it passes the said medow [sic] five perches thence South ward by a strait line until it strickes [sic] the line between Elizabeth RIDDLE & my line, ten perches east of the lower horse pasture field. In consideration of the aforesaid lot of land & money I expended in erecting a sawmill on said landÑIt is my will & I do order and direct that my son Alexander SCOTT shall furnish all the materials for a frame barn twenty two feet wide & fifty feet long & eight feet of a Over shot sixteen feet posts all to be of sufficient timber (hewed), planks, nails, pine, shingles, furnished and delivered at a suitable place to be selected on the north west corner of my old farm & this bequeathed to my son Samuel. All to be delivered by the first day of April one thousand eight hundred & thirty six and on said Alexander delivering said materials for said Barn as aforesaid will entitle him to said land on which he now resides and not otherwise. Further it is my will & desire that my son John SCOTT shall have the said forty acres of land reserved and articled for with my son James situate in the county and township aforesaid in addition to the lot of land heretofore given and patented in his own name and now residing thereon. And further I give to my son John that hundred acres of land I hold by Article with my son William being part of the tract I conveyed to him the said William situate in the county and township aforesaid for and in consideration of the aforesaid bequeaths. It is my will that my said son John is to pay my daughter Mary SCOTT her heirs or assigns one hundred dollars on the first day of February one thousand eight hundred & thirty seven. And further for the aforesaid It is my will that my said son John shall find sufficient hewed timber sawed timber boards nails pine shingles necessary to build a frame house sixteen feet wide and thirty two feet long and one & a half story high and to lay all the said materials aforesaid at such a place on the lot of land this day Willed by me (to my son Samuel as may be required of my Son William or his legal representative by the first day of April one thousand eight hundred and thirty six. Further I give until my son William SCOTT one hundred & twenty five acres of land with the usual Allowance off of the South side of the tract of lands I now reside on after my son AlexanderÕs land is laid off by a strait and parallel line to him. Further I give until my son William all my personal Estate together with my Bonds Notes and accounts [illegible] Except as follows one Brown coalt [sic] & saddle which is to be kept free on the place of [illegible] to my son Samuel to be his entirely when he arrives to the age of twenty one (also I except for & give to my daughter Mary SCOTT one mare & saddle, two cows & one calf, ten sheep to be kept free of expense on said farm by my son William until my daughter Mary is of age or remains single further I give to my said daughter Mary the use of one half of my present dwelling house and kitchen for the time aforesaid, that is while she remains single (also all the household & Kitchen furniture except one bed and bedding the old bureau & table one large copper kettle, kitchen cupboard one set of shovel and tongs & hand irons (which I reserve for my son William further it is my will & do require my son William to provide stone and lay a sufficient foundation with one half thereof to be for a cellar and raise and finish the house, of which materials said John SCOTT is to furnish when delivered in a substantial and workmanlike manner on a proper site on said SamuelÕs lot of land. Further it is my will & desire that my son William do and provide Stone sufficient for a bank barn dig the foundation for the same lay the stone or cause the same to be done (on a suitable site for the same on the aforesaid lot given to my son Samuel & raise and finish said barn with said timber that said Alexander SCOTT is to provide and deliver in a substantial & workmanlike manner in a reasonable time after said Materials are delivered and further it is my will that my son William SCOTT do pay to my son Samuel SCOTT five hundred dollars cash when he said Samuel does come of age. Also my son William is to sow the new medow [sic] with Timothy seed, also to clear fence & sow in timothy seed ten acres more in addition to what is cleared on SamuelÕs lot within three years from this date. And further it is my will and I do allow to be given until my son Samuel SCOTT the balance of my old tract of land after Alexander & Williams lots are laid off to them agreeably to this will sitate in the north west corner of said Tract. Further it is my will that my daughter Margaret SCOTT alias Margaret JAMISON that she shall have one half of the legacy due and coming due from the estate of Alexander LEMON, late of Westmoreland County (PA) decÕd to his daughter Elizabeth or her legal representative when collected except fifty dollars thereof to be for my son William. Also I give unto my said Daughter Margaret an obligation I hold on Joseph HARGAN & John WITHERUP Esqr. of Venango County, the balance due thereon to be for her own use. And further I give unto my daughter Mary SCOTT the other half of the legacy due & coming due from the estate of Alexander LEMON, late of Westmoreland County (Pa) due to his daughter Elizabeth or her legal representative when collected to be for her own use. Lastly I nominate and appoint my loving sons John SCOTT & William SCOTT of Scrubgrass township Venango County (Pa) to be the executors of this my last will and testament hereby revoking all wills and legacies & bequeaths by Me heretofore made, and declaring this and no other to be my last will and testament. The 31w5 October 1834 appeared before me William CRAWFORD And Mary P CRAWFORD the witnesses to the foregoing will who on their solemn oaths doth depose and say that they were present on the 15th day of September 1834 and saw said James SCOTT sign the foregoing instrument of writing and [illegible] him acknowledged the same as his last will and testament and at the time of signing the same appeared to be of sound mind memory and understanding to the best of their knowledge and that they signed their names as witnesses in their own proper hand writing at the request of the Testator.
