This file was submitted for use in the USGenWeb Project Archives by Norman Carnahan, < carnahan@rice.edu> At an orphans Court held at Greensburgh in and for Westmoreland County the 22d day Of August in the year of Our Lord one thousand eight hundred and forty two, Present the Honorable Thomas White, Esq President Judge and John Moorhead and James Bell Esquires Associate Judges of the same Court. ADAM CARNAHAN, Decd. Mathew Carnahan came into Court and presented the following Petition to wit: To the Honorable Judges of the Orphans Court of Westmoreland County, The Petition of Mathew Carnahan of Washington Township in said County, Humbly Sheweth, That your Petitioners father Adam Carnahan late of the township & County aforesaid decd. died intestate on or about the 1 Novr. 1815 leaving a widow named Sarah who also died since the 19th June 1842 and issue 14 children to wit, Ellen married to James Carrol, Esq of said township, James who went to Kentucky about 35 years ago and has not been heard from for 10 years or 12 years last past, John who went to Natchez about 35 years ago and has not been heard from since his departure, Margaret married to Michel of Mifflin County (near the Big Spring), Elizabeth, single woman, Mary also single, and Peggy, single who reside respectively in the township aforesaid, Robert who sold his interest in the estate hereinafter described to Petitioner, Adam who resides near Butler, Butler Co Penna, David K. who sold to your Petitioner, Kennedy who sold to your petitioner, Jane married to Samuel Shaw but having been previously married to Christopher Woods who with Jane his wife aliened to your petitioner, Sarah married to George Campbell of Loyalhannah Township in this County, and your petitioner. And that said intestate died seized in his demesne as of fee of & in a certain tract of Land situate in Washington Township aforesaid bounded by lands of Henry Bush, Christopher Bush, Jacob Kuhns, Adam Bowman and others Containing One hundred & sixty acres more or less with the appurtinances, Your Petitioner therefore prays your Honors to award an inquest to make partition of the premises aforesaid to and among the children and the representatives and the alienees aforesaid in such manner and in such proportions as by the Laws of this Commonwealth is directed if such partition can be made without prejudice to or spoiling the whole but if such partition cannot be made thereof, then to value & appraise the same, and make report of their proceedings at the next Orphans Court, and he will pray &c Mathew Carnahan Which petition being read and heard the Court award an Inquest agreeably to petition Whereupon a writ was made out and directed to the Sheriff Commanding him that taking with him twelve free honest and Lawful men of his bailiwick he should go to and upon the premises aforesaid and there by their oaths or Solemn affirmations he should make partition thereof to and among the heirs and Legal Representatives of said Intestate in such manner and in such proportions as by the Laws of this Commonwealth is directed if such partition could be made without prejudice to or spoiling the whole, but if such partition could not be made thereof as aforesaid then to value and appraise the same according to Law. And further to enquire and ascertain whether the said Real Estate with the appurtinances will conveniently accommodate more than one of the heirs or Legal Representatives of said Intestate and if so how many of the said heirs it will conveniently accommodate. That personal notice of the time and place of holding the inquisition should be served on all the heirs and Legal Representatives of said intestate resident in Pennsylvania who retain their interest, and also to all others by four publications in one Newspaper published in this County, and to make return of his proceedings herein to the next Orphans Court to be held at Greensburgh in and for Westmoreland County the 21st day of November next under his hand and seal and under the hands and seals of those by whose oaths or Solemn affirmations he should make the partition or valuation together with the Writ. At which time James Harvey Esqr High Sheriff came into Court & made the following return "Not Executed". So answers James Harvey, Sheriff And now to wit November 26th, 1842 The Court awarded an Alias Inquisition, notice as before Whereupon a writ was made out and directed to the Sheriff Commanding him as before and that he should make return of his proceedings to the next Orphans Court to be held at Greensburgh in and for Westmoreland County the third Monday 20" day of February next
