Esqr High Sheriff came into Court and made the following return to said Writ, "Not Executed", So answers David Newingham, Shff And now to wit February 22d 1843 The Court award a Plurias Inquisition notice as before Whereupon a Writ was made out and directed to the Sheriff Commanding him as before and to make return of his proceedings to the next Orphans Court to be held At Greensburgh in and for Westmoreland County the fourth Monday of May next. At which time David Newingham Esqr High Sheriff came into Court and made the following return to said Writ. The Execution of this Writ appears in a schedule hereto annexed. So answers David Newingham, Shff Inquisition indented and taken at the dwelling house of Mathew Carnahan in the Township of Washington in the County of Westmoreland and State of Pennsylvania on the twenty fifth day of April in the year of our Lord one thousand eight hundred and forty three Before David Newingham Esqr High Sheriff of the County aforesaid By virtue of a Writ of Partition or Valuation to him directed and to this inquisition annexed by the oaths of Alexander Thompson Esqr, William Thompson, Adam Bowman, Jacob Kuhns, David Carnahan, Henry Bash, William Muffley, Christian Bush, David Walter, James Mansfield, Peter Claason and William McCauley, twelve free honest and lawful men of his bailiwick who on their oaths aforesaid respectively do say that on the day and year aforesaid they went to and upon the lands and tenements of which Adam Carnahan in the said writ named died seized and then and there did find that the same lands and tenements could not be parted and divided to and among the heirs and Legal representatives of the said intestate without prejudice to or spoiling the whole thereof and the inquest aforesaid upon their oaths aforesaid did then and there find that the lands and tenements aforesaid would not conveniently accommodate more than one of the children and heirs of the said deceased and therefore the inquest aforesaid upon their oaths aforesaid have valued and appraised the same at and for the sum of Eleven dollars lawful money of the United States for each and every acre thereof. In testimony whereof as well the said Sheriff as the Inquest aforesaid to this inquisition have interchangeably set their hands and seals the day and year aforesaid. Carnahan (SEAL) Adam Bowman (SEAL) William McCauley (SEAL) In persuance of a Writ of Partition or Valuation I surveyed the above described tract of Land for the heirs of Adam Carnahan, Decd. on the 25" day of April A. D. 1843 Containing One hundred and seventy eight acres and a half Strict Measure, Situated in Washington Township in the County of Westmoreland. S. L. Carpenter At an Orphans Court held at Greensburgh in and for Westmoreland County the 23d May 1843 Inquisition Confirmed, And on Motion of Mr. Cowan Rule on the heirs and Legal Representatives of Adam Carnahan to appear at our next Orphans and accept or refuse the Real Estate at the valuation. Notice as before. Issued 5th June 1843 And now to wit August 21st 1843, Mathew Carnahan, the eldest son and heir at Law of Adam Carnahan, Late of Washington Township in said County Decd. came into Court and elected to take the real Estate of his decd. father at the valuation thereof by the inquest. The Court therefore assigns to the said Mathew the said Real Estate at the valuation thereof by the inquest, He to enter into recognizance with security to pay to his brothers and sisters their distributive shares of said Real Estate within 12 months from this date with Interest. And Samuel Shaw of Salem Township being offered as security he is approved of. By the Court. Mathew Carnahan and Samuel Shaw held to Mary Carnahan, Margaret Carnahan, James Carnahan, John Carnahan, James Carroll in right of his wife Ellen, George Campbell, in right of his wife Sarah, Elizabeth Carnahan & Margaret who is intermarried with Michael, heirs and Legal Representatives of Adam Carnahan, Decd. in the sum of $272.73 each, upon condition that Mathew Carnahan pay or cause to be paid twelve months from the date with Lawful interest unto the said heirs or their Legal Representatives the sum of $136.36 1/2 each, it being their respective shares of the real Estate of the said Deceased. As per Separate Recognizance filed August 22d, A. D. 1843.
