We encourage links to the state and county table of contents. ____________________________________________________________ NOTICE OF PROBATE AFTER DAVID ZIMMERMAN DIED May Term A.D. 1857 To the honorable Judge of the Orphans Court of Westmoreland County. The Petition of Robert Zimmerman, eldest son of David Zimmerman dec'd respectfully represents, That said David Zimmerman, lately died intestate leaving a Widow named Mary and issue 10 children to wit (1) Maria: married to Abraham Hixon, (2) Robert, (3) Jane: deaf and dumb, (4) Levi, (5) Noah, (6) Susanna: married to Thompson Mclean, (7) John, (8) Amy: married to Samuel Shupe, (9) Matthias, and (10) David Zimmerman all of whom reside in Westmoreland County except Matthias who resides in the State Of Iowa. Your petitioner further represents that said Intestate died Seized in his demesne as of fee of and in a tract of Land situated in South Huntington Township of said County adjoining Lands of John Love, land of your petitioner Abraham Hixon, Jacob Billheimer containing One hundred Sixty Acres More or less about one hundred and twenty acres cleared having a brick dwelling house, hewed log house and other buildings thereon erected. Your petitioner therefore prays your honors to award and Inquest to make partition or valuation of the same according to law and he will pray. Robert Zimmerman 11 May 1857 inquest awarded personal notice to all the heirs residing in Penn and by publication in Westmoreland Republican. I do hereby certify that by virtue of the within writ to me directed (having first duly warned the parties) I took with me twelve free honest and lawful men of my bailiwick and went to the lands & premises therein and there by their Oaths and Affirmations finding the same could be parted and divided to and among the parties in said writ named without prejudice to and spoiling of the whole have valued and appraised he same as by the within writ I am commanded as by the Schedule thereunto appears. So answers V. Elliot Shff Inquisition indented and taken at the dwelling house late of David Zimmerman deceased in the Township of South Huntington in the County of Westmoreland in the State of Pennsylvania on the Eighteenth Day of July in the Year of our Lord one thousand eight hundred and fifty seven before Valentine Elliot High Sheriff of the County of Westmoreland aforesaid by virtue of a writ of Partition and Valuation to him directed and to this Inquisition annexed by the Oaths of Samuel Bryan David Lowe Esq.. William Foster John S. Parker John Love Joseph Fulkreth William Weaver Jacob Smith Joseph G. Weaver Simon Cope John W. Hough and George Mechling twelve free honest and lawful men of his bailiwick who on their oaths aforesaid respectively do say that on the day and year aforesaid they went to and upon the lands and tenements of which David Zimmerman in the said writ mentioned died seized and then and there did find that the same lands & tenements with their appurtenances could not be parted and divided to and among all the children of the said deceased without prejudice to or spoiling of the whole thereof, and the inquest aforesaid on their oaths aforesaid did then and there further find that the said lands and tenements with their appurtenances will accommodate two of the children of the said deceased that is to say that that part of the said lands and tenements containing eighty three acres and 97, perches (83 ac 97) strict measure included in and described by the diagram annexed marked ("a") will accommodate one of the children of the said deceased That that other part of the said lands and tenements containing seventy six acres & one hundred and three perches (73ac 103pr) strict measure included in and described by the annexed diagram marked (b) will accommodate one other of the children of the said deceased and the inquest aforesaid upon their oaths aforesaid do value and appraise that part of the said lands and tenements contaned in and describe by the diagram hereto annexed and Marked (a) at and for the sum of twenty two dollars ($22.00)lawful money of the United States for each and every acre thereof strict measure of the said lands and tenements contained in and described by the diagram hereto annexed and and marked (b) at and for the sum of Eighteen dollars ($18.00) money aforesaid for each and every acre thereof strict measurre. In witness whereof as well the said Sheriff as the Inquest aforesaid to the inquitistion have interchangeably set their hands and seals the day and year aforesaid. V.
