LDS Film#: 0929199, Page 367 Deed Andrew Haslet To James Smith This Indenture made the fourth day of July in the year of our Lord one thousand eight hundred and thirty four. Between James Hornell and John Hill Executor, of the last Will and Testament of Andrew Haslet late of Fairfield T. in the County of Westmoreland and State of Pennsylvania deceased of the one part and James Smith of the same Township County and State of the other part. Whereas the said Andrew Haslet by notice of divices good conveyance and assurances in the law duly had and executed became in his life time lawfully regard in his ??? as of ??? (among other lands of a certain misusage tenement and tract of land situate in asaid Township County and State adjoining lands of John Ramsey, Charles Donaldson, Hugh Lawson and others containing thirty three acres and 73 perches and being so thereof regard made his last Will and Testament in writing wherein and whereby (among other things) he ordered that the said piece of land should be sold by his exr therein after named of which will he appointed James Hornell and John Hill to take in and by said recited Will since his decease duly proved and remaining one this Registers office at Greensburgh recourse being thereto had appears Now this Indenture witnesseth that the said James Hornell and John Hill exrs. as aforesaid for and in consideration of the same of two hundred and ninety dollars to them in hand paid by the said James Smith at and before the ensealing and delivery hereof the receipt whereof is hereby acknowledged have granted bargained sold aligned released and confirmed and by theses presents by force and virtue of said recited Will do grant bargain and sell alien release and confirm unto the said James Smith the said mentioned and described messuage and tract of land bounded and described as follows. Beginning at a Gum in the lane of the township and Thence South seventy degrees West thirteen perches to a post thence by lands of John Ramsey North fifty one degrees West one hundred perches to a stone heap. Thence by lands of Charles Donaldson, North 77 degrees East 51 perches to a stone heap. Thence by the same North twenty one West, twenty _ perches to a Rock Oak. Thence by lands of Hughes Lawson North eighty degrees East sixty six perches to a post thence by other lands of James Smith of which this was once a part. South eleven degrees West seventy one perches to a white Oak, thence by the same South two degrees West thirty perches to the place of Beginning, containing thirty three and seventy three perches with the usual allowance. It being a part of the same tract of land whch was granted by the Commonwealth to Jenny Scott and Edward Halferty by Patent dated the 25th April, 1799, and was by deed dated the 14th day of December A.D. 1799 conveyed by said Scott & Halferty to William Lyons and was by deed dated the 26th day of November 1800 conveyed by said William Lyons and Margaret his wife to said Andrew Haslet. Reference to the said Patent and deeds being had more fully appears together with all & singular other the houses, buildings, woods, waters rights, liberties, hereditaments and appurtenances whatsoever there unto belonging & lie revisions rents, rents issues and profits thereof (except that said Smith is not to obtain possession nor receive any rent off said farm before the first day of September 1835) And also all the Estate right to the interest property claim & demand whatsoever of him the said Andrew Haslet at & immediately before the time of his decease in law or equity or otherwise whosoever of in to or out of the same To Have & To Hold lie messuage of tenement & tract of thirty three acres and 73 perches of land, there ??? & premises hereby granted or mentioned or intended to be with the appurtenances unto the said James Smith his heirs and assigns to the only proper use & behoof of the said James Smith his heirs and assigns forever. In Witness whereof the parties grantors do here unto set their hands & seals the day and year first above written.
