The 1850 Census shows her living with her daughter and son-in-law Margaret and Robert Cunningham. This release may have been in return for the care Charlotte would receive from them as it is dated 1840. Charlotte "Lottie" Henderson died in 1853 _______________________________________________________________ Beginning of the document: Westmoreland county S.S. Before me one of the Justices of the Peace in and for said County personally appeared Thomas Henderson and Nancy his wife grantors of the foregoing Deed of Release who acknowledge the same to be their act and deed and desire that this same might be recorded as such She the said Nancy being of full age and by me seperate and apart from her said husband examined made know to her the full contents of the foregoing deed of release She did of her own free will and accord without any concern or compulsion on part of her said husband seal and as her act and deed deliver the same. Witness my hand and seal this 26th day of March A.D. 1840 Recorded May 19th 1851 A Graham In all people to Whom these presents shall come Charles Henderson & Mary his wife John McBee & Sarah his wife Alexander Henderson & Mary Jane his wife John Henderson & Elizabeth his wife and Insing (all heirs of Charles Henderson dec'd) or the Township of Fairfield of Westmoreland and State of Pensylvania Greeting Whereas Charles Henderson of this said County and State aforesaid died seized and possessed of a certain tract of land situate in Fairfield Township Westmoreland County & State of Pennsylvania Bounded as follows on adjoining lands of Phillip Harmon the heirs of Joseph Snodgrass dec'd Jacob West and Thomas Henderson and Whereas the said Charles Henderson did leaving issue ten children to wit Thomas, Sarah intermarried with John McBee, John, (Jane now deceased) Margaret intermarried with Robert Cunningham, Charles, Alexander, Insign (Malinda now deceased) and Eliza Armstrong (Page 78) and Whereas the said Charles Henderson did by his last will and testament give and bequeath the said tract of land to his wife Charlotte during her natural life and at her decease the said tract of land to be equally divided or the proceeds thereof or should any of his children die without issue then their part to be divided amongst the surviving heirs of said dec'd. Now know ye that the said Charles Henderson & Mary his wife ohn McBee and Sarah his wife Alexander Henderson & Mary Jane his wife John Henderson and Elizabeth his wife Insign Henderson All heirs at law of the Said Charles Henderson dec'd for and in consideration of the sum of one hundred dollars lawful money to each of them in hand paid by Robert Cunningham of the Township of Fairfield, County of Westmoreland and State of Pennsylvania the receipt whereas is hereby Acknowledged have granted sold remissed released and forever grant claim unto the Said Robert Cunningham his heirs and Assigns forever. All their right title interest property claim & demand whatsoever in law or equity of in and to their distributive Shares of the above described tract of land to which the said Charles Henderson & Mary his wife John McBee & Sarah his wife Alexander Henderson & Mary Jane his wife John Henderson and Elizabeth his wife Insign Henderson their heirs Executors or Administrators are entitled to they all as aforesaid being children at law of of the said Charles Henderson decd so that they said Charles Henderson & Mary his wife John McBee & Sarah his wife Alexander Henderson & Mary Jane his wife John Henderson and Elizabeth his wife and Insign Henderson their heirs Executors or Administrators, nor any other person or persons for them may lay claim challenge and demand or pretend to have claim challenge or demand in and to theid distributive share but thereof and here from shall be utterly excluded and forever debarred by these presents. John Henderson Ensign Henderson Alexander Henderson Charles Henderson John McAbee Witnesses present Thomas Elliott A Graham (of A) Westmoreland county SS Before me one of the Justices of the Peace in and for the County aforesaid personally appeared Charles Henderson and Mary his wife John McAbee and Sarah his Wife Alexander Henderson and Mary Jane his wife John Henderson & Elizabeth his wife and Insign Henderson and acknowledged the aforesaid release to be their and each of their acts and deed and desired the same as such might be recorded according to law She the said Mary Jane, Sarah, Mary & Elizabeth being of full age seperate and apart from their said husbands by me examined and knu full contents of the said release sent them made known whereupon they did declare that they did voluntarily and of their own free will and accord seal and as their act and deed deliver the same without any coercion or compulsion of their said husbands whatever witness my hand and seal this 20th of March in this year of our Lord one Thousand eight hundred and forty two Recorded May 19th 1851 Andrew Graham Release of Armstrong Henderson to Robert Cunningham To all people to whom these presents shall come Armstrong Henderson and Mary his wife of the township of Fairfield and County of Westmoreland and State of Pennsylvania Greeting Whereas charles Henderson of the Township County and State aforesaid died seized and possessed of a certain tract of land situated in Fairfield Township County of Westmoreland and State of Pennsylvania bounded as follows to wit by land of Phillip Haiman dec'd heirs of Joseph Snodgrass dec'd and JAcob Hist And whereas the said Charles Henderson died leaving issue ten children Thomas Sarah John Jane Margaret Charles Alexander Ensign Malind (now dec'd) and Armstrong, And whereas the said Charles Henderson did by his last will and testament give and bequeath this said tract of land to his wife Charlotte during his material life and at her decease the said tract of land to be equally divided or the proceeds thereof Now know ye that the said Armstrong Henderson being one of the children and heirs at law of the said Charles Henderson dec'd for and in consideration of the sum of one hundred dollars to him in hand paid by Robert Cunningham of the Township of Fairfield county of Westmoreland and State of Pennsylvania The reciept whereof is hereby acknowledged have granted sold released and forever quit claim, and by these presents doth grant sell remise release and forever grant claim unto the said Robert Cunningham his heirs and assigns forever all their right title (page 519) Interest property claim and demand whatsoever in law or equity of in and to or out of their distribution claim of the tract of land aforementioned to which the said Armstrong Henderson and Mary his wife are entitled to of the said described tract of land belonging to the said Charles Henderson dec'd nor their heirs Executors Administrators or Assigns nor any other person or persons for them to lay claim challing or demand or pretend to have any claim whatsoever of in and to their distribution of the said tract of land but thereoff and herefrom shall be uttterly excluded and debarred by share of these presents. In witness whereof the said Armstrong and Mary his wife have hereunto set their hands and seals this eight day of May in the year of our Lord one thousand eight hundred and forty eight. Hamill, A Graham of An'd Recieved this date of the foregoing release of and from Robert Cunningham the sum of one hundred dollars the consideration in full Armstrong Henderson Attested A Graham of An'd Westmoreland County S.S. Before me one of the Justices of the Peace in and for said County aforesaid personally appeased Armstrong Henderson and Mary his wife grantors of the foregoing Deed who acknowledged the same to be their act and deed desired that the same might be recorded as such She the said Mary being of full age and by me seperate and apart from her said husband examined, made known to her full contents of the foregoing Deed of Release. She did of her own free will and accord without any coercion or compulsion on part of her husband sign seal and deliver the same.
