We encourage links to the state and county table of contents. ____________________________________________________________ WESTMORELAND COUNTY DEED William HOY to Joseph HOY - 1847 This indenture made the thirteenth day of March in the year of our Lord one thousand eight hundred and fifty two between WILLIAM HOY and SOPHIAH, his wife,of the township of Franklin County of Westmoreland and State of Pennsylvania of the first part and JOSEPH HOY of the township county state aforesaid of the other part. Witnesseth that the said parties of the first part for and in consideration of the sum of eight hundred and niney five dollars ($895) lawful money of the United States of America unto them well and truly paid by the said party of the second part at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted bargained sold aliened enfeoffed released conveyed and confirmed and by these present do grant bargain sell alien enfeoff release convey and confirm unto the said party of the second part his heirs and assigns. All that lot or parcel of land situate on a branch of LYONS RUN in the Township County and State above mentioned and bounded and described as follows. Beginning at a stone thence by land of BECKOUN north sixty eight and one half degrees west ninety four perches to a post thency by land of said JOSEPH HOY of which this is part, north thirteen and three quarter degrees east one hundred and fifty eight perches to a post. Thency by land of WILLIAM STAMATES of which this is a part south sixty one and one quarter degrees east forty eight perches to a post thency by SAMUEL HOY south ten degrees east one hundred and forty five perches to a Hey. Thence south twenty five degrees west thirthy one and five tenths perches to the place of beginning. Containing 71 seventy one acres and one hundred and five perches strict measure. It being from a larger tract patented in the name of JAMES AND ANNE HOY, said Patent bering date 13th April AD 1829 and the said JAMES HOY by his last will and testament bequeathed the above described lot of land to his son, JAMES HOY who died intestate and without issue leaving as his heirs at law, SAMUEL HOY, the above name JOSEPH HOY, JANE HOY intermarried with WILLIAM MILLIGAN, ELIZABETH HOY intermarried with ISAAC GROSCOPE and the aforesaid WILLIAM HOY and the said heirf SAMUEL, JOSEPH, JANE intermarried with William Milligan and Elizabeth intermarried with Isaac Groscope, did on the 3rd day of July AD 1847, execute a deed of release to the said WILLIAM HOY said release being recorded in the office for recording deeds in Westmoreland Co in Book No 30, page 491. Together with all and singular the buildings improvements ways waters water course rights liberties privileges hereditements and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions and remainders ....thereof and all the estate right title interest property claim and demand whatsoever of the said parties of the first part in law equity or otherwise howsoever of in and to the same and every part thereof to have and to hold the said seventy one acreas and one hundred and five perches of land hereditmentas and premises hereby granted or mentioned an dintended so to be with the appurtenances unto the said party of the second part his heirs and assigns to and for the only proper use and behoof of the said party of the second part his heirs and assigns forever, provided that the said JOSEPH HOY shall well and truly par or cause to be paid to his mother, ELEANOR HOY, the sum of twenty eight ($28) dollars lawful money of the united States yearly in each and every year during her natural life the said twenty eight dollars to be paid on or before the first day of April in each and every year it being in lieu of Dower. And the said William HOY and wife their heirs executors and administrators by these present covenant grant and agree to and with the said party of the second part his heirs and assigns that they the said William Hoy and wife are lawfully seized in fee of the aforegranted premises. That they are free from all incumbrances that they have good righ to sell and convey the same to the said JOSEPH HOY as aforesaid that they the said William Hoy and wife their heirs executors and administrators the aforesaid premises to the said JOSEPH HOY his heirs and assigns forever against the lawful demands of all persons claiming or claim the same or any part thereof shall and will warrant and forever defend. In witness whereof the said parties of the first part have to these present set their hands and seals dated this day and year first above written. Sealed and delivered in the presence of us: William Hoy Sophia Hoy J. Murry Carpenter H.N. Harkeless Received on the day of the date of the above indenture of and from the within named JOSEPH HOY eight hundred and ninety five dollars being the consideration money therein mentioned in full. Witness: J.M. Carpenter H.N. Harkless William Hoy, Westmoreland Co is before me a Justice of Peace in and for said county personally came the within named parties of the first part and the severally acknowledged this indenture to be their act and deeds for the purposed therein mentioned and desired that same to be recorded as such. And she the said SOPHIAH being of full age and by me examined separate and apart from her said husband and the full contents of this Indenture being made known to her upon such separate examiniation declared that she did voluntarily and of her own free will and accord seal and as her act and deed deliver the same without any coercion or compulsion of her said husband.
