All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Lynn Beatty klbeatty@redrivernet.com August 21, 2006, 3:37 pm Written: May 13, 1818 Recorded: August 20, 1822 This Indenture made this thirteenth day of May & year of our Lord one thousand eight hundred & eighteen by & between Peter Klingensmith Kapel & John Kapel & Catherine his wife & George Klingensmith & Michael Klingensmith all at Washington Township Westmoreland County State of Pennsylvania Witnesseth Whereas John Morgan Late of Philadelphia deceased was justly entitled to three contiguous surveys in the names of John King Nany Grady & George Plenge Situate in the township of Washington County of Westmoreland County State of Pennsylvania & whereas a patent bearing date the fourteenth day of March one thousand eight hundred & seventeen duly issued to to [sic] the devisses & legal representatives of the said John Morgan for three hundred acres of land in the name of the said John King Situate as aforesaid & Whereas Thomas Morgan of Washington in the County of Westmore Washington State aforesaid one of the devises of the said John Morgan owns & is justly entitled to two hundred & forty acres of the land aforesaid and whereas the said Thomas Morgan & Catharine his wife by Indenture bearing date the thirty first day of March one thousand eight hundred & seventeen recorded in the Office for recording of Deeds in & for the County of Westmoreland in Book No 12 page 436 did grant & confirm unto the aforesaid Peter Kepple and John Kepple their heirs or assigns all that last mentioned two hundred and forty acres bounded by lands of Jacob Kingensmith and other reference to the same will more fully appears Now This Indenture Witnesseth that the said Peter Kapel & John Kapel and Catharine his wife for & in consideration of the sum of two hundred & thirty three dollars to them in hand paid by George Klingensmith & Michael Klingensmith the receipt of which is hereby acknowledged hath granted bargained sold released & confirm & by these presents doth grant bargain sell release & confirm unto the said George Klingensmith & Michael Klingensmith all that part of the last mentioned tract aforesaid to wit Beginning at a white oak corner of the same & Jacob Klingensmith Survey at the falls of Roaring Run North fifty eight degrees East seventy two perches to a white oak thence by the same South twenty six degrees East fifteen perches to a white oak South twenty four degrees West forty three perches to a spanish oak & South twenty one degrees East fifty five perches to a post South sixty one degrees West seventy eight perches to a post on the line of Jacob Klingensmiths land thence by the same North one degrees West one hundred & four perches to the Begining [sic] Containing forty acres strict measure To Have & To Hold the same to them the said George Klingensmith & Michael Klingensmith & to their heirs assigns forever & the said Peter Kapel & John Kapel & Catharine his wife for themselves their heirs executors & administrators do contract promise grant & agree to & with the said George Klingensmith & Michael Klingensmith their heirs & assigns by these presents that they the said Peter Kapel & John Kapel & Katharine his his [sic] wife the said last described forty acres of land shall & will warrant & forever defend unto the said George Klingensmith and Michael Klingensmith their heirs & assigns against all persons whomsoever lawfully claiming the same IN Whereof the said Peter Kapel & John Kapel & Katharine his wife have hereunto set their hands & seals the day & year first above written Signed: Peter Kapel (seal), John Kapel (seal), Katharine (her X mark) Kapel (seal) Signed sealed in presence of us: Wm Whatson, John Clingensmith, Peter Antony May 13th 1818 We then received the just & full sum of two hundred thirty three dollars in full of the consideration money before mentioned Signed: Peter Klingensmith, John Klingensmith (Klingensmith is obviously in error. Kapel being in order.)
