All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Lynn Beatty klbeatty@redrivernet.com August 21, 2006, 3:42 pm Written: July 10, 1824 Recorded: August 31, 1824 This Indenture made the tenth day of July in the year of our Lord one thousand eight hundred & twenty four by and between Michael Klingensmith of Allegheny Township in the County of Westmoreland State of Pennsylvania (Stiller?) and Margaret his wife of the one part & George Klingensmith of the Township County & Commonwealth aforesaid Miller of the other part Witnesseth that the said Michael Klingensmith & Margaret his wife for and in consideration of the sum of one hundred & twenty dollars money of the United States to them in hand Paid by the Said George Klingensmith at an before the ensealing and delivery hereof the receipt & payment whereof they Do hereby acknowledge and thereof do forever acquit and discharge the Said George Klingensmith his heirs Executors administrators b y these presents Have Granted bargained & Sold and by these presents Do Grant bargain and Sell unto the Said George Klingensmith and to his heirs & assigns a certain part of a tract of land Situated in the Township County & Commonwealth aforesaid and bounded as follows Viz Begining [sic] at a white oak corner of the Same and Jacob Klingensmiths Survey at the Falls of Roaring River North fifty eight degrees Seventy two perches to a white oak thence by the Same South thirty six degrees East fifteen perches to a white oak South twenty four degrees West forty three perches to a Spanish oak thence South twenty one degrees East fifty five perches to a post thence South Sixty one degrees West Seventy eight perches to a post on the line of Jacob Klingensmiths land thence by the same North one degree West one hundred and four perches to the place of Begining Containing Forty acres Strict measure (whereas the Commonwealth of Pennsylvania by Patent bearing date the 14th day of March 1817 for the consideration therein mentioned did Grant & Confirm unto the legal representatives of John Morgan Deceased late of the City of ------- Philadelphia for three hundred acress [sic] of land In the name of John King and whereas Thomas Morgan one of the diveres [sic] or legal representatives of the aforesaid John Morgan Deceased did by Deed dated the thirty first day of March one thousand eight hundred & Seventeen recorded in the office for Recording of Deeds In the County of Westmoreland in Book No 12 Page 436 Convey two hundred & forty acres of the aforesaid tract of land to Peter Kaple and John Kaple and whereas Peter Kaple & John Kaple by Deed dated the thirtyeth day of May A.D. 1818 Recorded In the County of Westmoreland in Book No 15 Page 137 & 138 Sell and Convey the above described Forty acres of land to the aforesaid George Klingensmith & Michael Klingensmith as tenants in Common) Together with all and Singular the rights priviledges hereditaments and appurtenances thereunto belonging and the remainders rents issues and profits and also all the Estate right title Interest property claim & Demands whatsoever of them the Said Michael Klingensmith & Margaret his wife in Law or equity or otherwise howsoever of in to or out of the Same or any part thereof. To have and to hold the Said Forty acres of land Strict measure (being a part of the Said tract Granted by the Commonwealth to the legal representatives of John Morgan Deceased) hereditaments & premises hereby granted & Sold with the appurtenances unto the Said George Klingensmith his heirs and assigns forever & the Said Michael Klingensmith & Margaret his wife for themselves their heirs Executors and administrators doth hereby Covenant promise grant & agree to and with the Said George Klingensmith his heirs & assigns by the presents that their the Said Michael Klingensmith & Margaret his wife the above described premises hereby Granted & Sealed with appurtenances unto the Said George Klingensmith his heirs and assigns against the Said Michael Klingensmith & Margaret his wife and their heirs and against every other person or person lawfull claiming the same or any part thereof Shall and will warrant & forever defend by these presents. In Testimony whereof the Said Michael Klingensmith & Margaret his wife have hereunto set their hands & Seals the day & year first above written. On the tenth day of July 1824 before me the subscriber one of the Justices of the Peace in and for the Said County Personally came the within named Michael Klingensmith & Margaret his wife and acknowledged the within Indenture to be their act and Deed to the end the Same might be Recorded as Such. She the Said Margaret being of proper age and apart from her Said husband by me examined acknowledged the same to be her voluntary act and Deed.
