WESTMORELAND COUNTY MARCH 19, 1790 Edmund Byram This Indenture made the nineteenth day of March in the year of our Lord To one thousand seven hundred & ninety between Edward Byram of Frank- David Logan lin Township & County of Westmoreland & State of Pennsylvania Yeoman of the one part and David Logan of the same place yeoman of the other part Witnessith that the said Edward Byram & Phiby his wife for and in consideration of the sum of two hundred and forty seven pounds ten shillings lawful money of Pennsylvania to them in hand paid by the said David Logan at & before the sealing & delivery of these presents the receipt & payment whereof is hereby Acknowledged & themselves to be therewith well con- tent & fully satisied & thereof & evry part thereof do forever release exonerate & discharge the said David Logan have & each of them hath by these presents doth & each of them doth grant bargain sell alien remise releas enfuof & confirm unto the said David Logan his heirs & assigns all that certain lot or piece of land butted & bounded in two divisions as follows Beginning at a marked white oak of the side next the Kelly land & thence North West twenty four perches to a post by John Ormsbys land North eighty six degrees West forty one perches to a white oak & South one hundred and thirty two perches to a white oak by land now said David Logans South eighteen degrees East one hundred and ninety eight perches to a hickory & South sixteen degrees West thirty two perches to a white oak thence by Thomas Lyons now Eli Coulters land South Seventy two East fifty six perches to a white oak North Seventy one degrees East fifty perches to a line by the other division of said tract North thirteen degrees West three hundred & fifteen perches to the place of beginning Containing one hundred & fifty acres & the allowances this be- ing the firs division & for the second division beginning at a gum by Eli Coulters land North twenty two degrees East ninety four perches to an Ironwood South sixty two degrees East seventy one perches & an half to a post thence along the Henes line North ten degrees East one hundred & forty one perches to a white oak by Sd Davids first di- vision South thirteen degrees East one hundred & eighty perch to the place of begin- ning Containing ninety seven acres & an half & allowances the whole of both divisions Containing three hundred and ninety six acres & nine tenths Named the Refused Tract granted by the Supreme Executive Council of the Commonwealth of the Said State of Pennsylvania to the said Edward Byram & his assigns the second day of April in the year 1788 Inroled in the Roles Office for sd State in Patant Book No 14 Page 77 The tenth of said month of April Referance to the same being had may more fully appear Together with all & singular the houses & buildings thereon erected & built & woods waters water courses profits commodities emolmuments hereditaments & appurtenances unto the said David Logan his heirs & assigns & the remainders there- of & all the right title property claim & demand whatsoever of him the said Edward Byram his heirs & assigns to the only proper use & behoof of the said David Logan his heirs & assigns forever free & clear of all restrictions & reservations as to mines roy- alties quit rents or otherwise Excepting & reserving only the fifth part of all gold & silver ore for the use of this Commonwealth to be delivered at the pitts mouth clear of all charges & the Sd Edw Byram for himself his heirs Exct & Adm & for the said Pheby his wife doth covenant promes & grant to & with the said David Logan his heirs & assigns by these presents that the Sd Edw Byram & his heirs the Sd above mentioned & described tracts or pieces of land & all & singular the premises hereby granted & released with the appurtenan- ces unto the said David Logan his heirs & assigns against him the said Ewd Byram and his heirs legally claiming will warrent & defend especially the last described lot he is to warrent from all & evry other parson or parson Whatsoever legally claiming or to claim the same by my prior right or any part therof by this presents & further that he the said Edw Byram & his heirs shall & will from time to time & at all times hereafter make do execute all & evry such further & other lawful conveyances Whatsoever for the further & more sure granting & Confirming the last two lots or pieces of land aforesaid & all & singular the premises above granted & released with the appurtances unto the said David Logan his heirs & assigns as by his & their council learned in the law shall reasonably devise advise & require I witness whereof the said parties to these presents have hereunto interchangeably set their hands & seals the day & year first
