Patton & Mathew H. Patton, and the covenants and agreements entered into by them and hereunder written, do hereby leas to the said John R. Patton & Mathew H. Patton, all that part of the farm belonging to the said James Patten, known as the "Hill Field" supposed to contain twenty (20) acres more or less for the term of twenty five years, for the purpose of growing fruit. The said John R. Patton & Mathew H. Patton to have the privilege of planting as many fruit trees on said tract as they may see fit; they to select the kind or kinds of fruit they may wish to raise and it is mutually understood that the said James Patton to have the privilege of using said 'tract' for farming purposes until the fruit trees are grown so large as to interfere with growing crops, but he is not to allow cattle or horses to pasture among the growing trees to the detriment of the orchard, and the said John R. Patton and Mathew H. Patton covenant and agree that they will pay to the said James Patton one fifth part of all fruit grown on the property, leased said fifth to be picked and in Culk? And if at the expiration of twenty five years from the date of this Lease, the orchard is in good condition and profitable then the said John R. Patton & Mathew H. Patton, is to have it ten years longer. They to pay said James Patton or his heirs one fourth of all fruit raised during said ten years, it to be delivered in the orchard in good barrells and all rights and privileges herein granted are to be governed, controlled and limited by the conveyance made by James Patton to John R. Patton and Mathew H. Patton on the first day of January Eighteen Hundred and Sixty Seven (1867). Be it remembered that on this 24th day of November A.D. 1866, before me a Justice of the Peace in & for said county personally James Patton and acknowledged the signing and sealing hereof of the foregoing instrument to be his free act and deed witness my signature & seal Jas A. Potter, JP. Recorded Dec 16, 1867 Additional Comments: James Patton married Ruth Ann Riley June 20, 1833 in Columbiana Co OH. I believe he purchased this entire land Nov 15, 1854 from J.N. Dick174 acres adjoined James Boyd, Widow Smith, Jeremiah Beeham John Riley Patton born 1835 - never married Mathew Henry Patton born 1849 James Patton died Jan 10, 1879.... 12 years after the signing of this lease. 1885 Ruth Ann Patton, widow sells coal and petroleum rights to Coal Natural Gas Co,. 1892 she sells land to Turtle Creek Railroad. These deeds list the names of the children.
