All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Lynn Beatty klbeatty@redrivernet.com August 21, 2006, 3:39 pm Written: December 16, 1826 Recorded: May 14, 1827 This Indenture made the sixteenth day of December in the year of our Lord one thousand eight hundred and twenty six between William Philips of the Township of Allegheny County of Westmoreland and Commonwealth of Pennsylvania and Mary his wife of the one part and George Klingansmith of the Township County and Commonwealth aforesaid of the other part Witnesseth that the said William Philips & Mary his wife for and in consideration of the sum of one hundred dollars lawful money of the United States to them in hand paid by the said George Klingansmith, at or before the ensealing or delivery hereof, the receipt whereof is hereby acknowledged have granted, bargained, sold, aliened, enfeoffed, released, and confirmed, and by these presents do grant, bargain sell, alien, enfeoff, release and confirm unto the said George Klingansmith and to his heirs & assigns all that certain messuage piece or parcel of land bounded and described as follows, beginning at a heap of stones for a corner thence by land of of [sic] the said William Philips south seventy five & three fourth degrees west ninety four perches to a marked Ironwood north sixty three and a half degrees west forty nine perches to a stone heap north thirty three degrees east seventy six perches & four tenths to a marked whiteoak, thence by land claimed by Morgans heirs south fifty six and one fourth degrees east one hundred and twelve perches to a stone heap and place of beginning Containing thirty four acres seventeen perches and the usual allowance, lying and being in the Township aforesaid, being part of a tract of land surveyed in pursuance of Warrant in the name of Ezekiel Edwards, the title of which is duly vested in Wm U Fisher who by his Attorney A. V. Foster conveyed one hundred and one acres with the usual allowance to William Philips a party hereto his heirs and assigns forever said deed is dated the thirty first day of March 1816 and recorded in the Recorders Office for Westmoreland County in book No.16 page (196?) reference being hereunto had, will more fully appear together with all and singular the buildings, improvements, woods, ways, waters, water courses, rights, liberties, priviledges, hereditaments and appurtenances whatsoever thereunto belonging or in any wise appertaining and the reversions and remainders, rents, issues and profits thereof and also all the estate right title interest property claim & demand whatsoever, of their the said William Philips and Mary his wife in law or equity of in and to the same To have and to hold the said described thirty four acres seventeen perches and the usual allowance of land before described hereditaments and premises hereby granted, or mentioned, or intended so to be, with the appurtenances, unto the said George Klingansmith his heirs and assigns to an for the only proper use, benefeit [sic] and behoof of him the said George Klingansmith (his) heirs and assigns forever and the said William Philips and Mary his wife for themselves and heirs covenant, promise and agree to and with the said George Klingansmith his heirs and assigns, by these presents, that they the said William Philips & Mary his wife and their heirs, the said described thirty four acres & seventeen perches of land hereby granted with the appurtenances unto the said George Klingansmith his heirs and assigns against them the said William Philips and Mary his wife, and their heirs and against all an every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof shall and will warrant and forever defend by these presents In witness whereof the said William Philips & Mary his wife have hereunto set their hands & seals the day and year above written. Before James McCullogh one of the Justices of the Peace in and for said County personally came the above named William Philips and Mary his wife and acknowledged the above Indenture to be their act and deed and desired the same might be recorded as such, the the [sic] said Mary Philips being by me examined seperate [sic] and apart from her said husband and the contents of the said Indenture being by me first made known to her declared that she did at her own freewill and accord, sign, seal, and as her act and deed deliver the same without any coercion or compulsion of her said husband witness the hand and seal of said James McCullough the seventeenth day of December in the year of our Lord one thousand and eight hundred and twenty six.
