Newhouse Kelanic October 5, 2001 No. 39 of 1879 Will of George Errett died "In the name of God Aman I George Errett of Hempfield Township Westmoreland County and State of Pennsylvania and being in good health of body and of sound and disposing mind and memory Praise be God for the same and being desirous to settle up my worldly affairs while I have strength and capacity so to do make and publish this my last will and testament hereby revoking and making void all former wills by me at any time heretofore made and first and principally I commit my soul into the hands of my creator who gave it and body to the Earth and as to such worldly Estate wherewith it has pleased God to intrust me I dispose of the same as followith that is to say I order that all my just debts funeral expenses and charges of proving this my will be in the first place fully paid and satisfied and after payment thereof and evry part thereof I give and bequeath as follows to Ellmone Shull a grand child the sum of one thousand dollars and the same to be paid him on his attaining the age of twenty one years and should he die before he arrives at that age then my will is that his bequeaths is to be equally divided between Jacob Lewis and Henry Errett three sons and Catharine Miller late Errett and Lydia Shull late Errett two daughters share and share alike I give and bequeath to Ellen Allshouse a step daughter the sum of five hundred dollars to be paid to her two years after my decease but should she not remain with me until she may marry then this bequeath to be void and the same to be equally divided amongst my five heirs aforesaid give and bequeath to my beloved wife Elizabeth during her natural life the house in which I now reside stable and barn room sufficient to keep one cow and feed for one cow the wagon shed hog pen & all under one ruff together with the garden and small fruit orchard adjoining the house and my will is that all my personal effects be fairly appraised by my executors herunafter mentioned and that my wife Elizabeth is to select out of said appraisement property to the amount of Three hundred dollars (to which she is entitled to under the Act allowing the widow $300) also hay or fodder & pasture sufficient to keep one cow Hay or fodder to be delivered, in the barn wood, stone coal to be delivered at the house Meat & flour and groceries and wearing appearles sufficient for her comfortable mentenance I give and bequeath to my son Jacob all my land or Real Estate whatsoever and wheresoever the same may be situated supposed to contain one hundred and sixty acres be the same more or less to his heirs and assigns forever on the following conditions at a valuation of sixty dollars ($60) per acre for each and every acre thereof one half then of to be paid in one year next after the diseased of my wife and the remaining half in two years next after the deceased of my wife retaining one fifth of said valuation as his equal share therein and pay to Lewis Henry and Catharine Miller their respective shares as aforesaid retaining in said real estate the share of Lydiann Shull during her natural lifetime and at her decease pay the principal to her bodily heirs paying the interests thereon annually as above described to said Lydiann Shull and for the consideration of said real estate from and after my decease to the decease of my widow & order and my will is that my son Jacob is to comply with and render full satisfaction in all the foregoing bequeaths and I do hereby nominate constitute and appoint my son Jacob Errett and Reuben Miller soninlaw both of Hempfield Township Executors of this my will hereby revoking and making void all, former and other wills by me at any time heretofore made and declare this only to be my last will and testament in witness whereof I the said Testator have to this my last will and testament set my hand and seal this 2nd day of December AD 1871" [seal] George Errett "Signed sealed published and declared by the said Testator as and for his last will and testament in the presence of us who in his presence and at his request have subscribed our names as witnesses thereto" L. Beck "In supplement to the foregoing I hereby order and direct that so much of the foregoing will as directs to Allen Allshouse a step daughter is hereby made null and void and as to all devices directed and given in the foregoing will to Elizabeth my wife at the date of said will now (deceased) I now devise all of said devices and Legacies which were devised to said Elizabeth my wife to Mary Shumaker Excepting the three hundred dollars which are devised under the $300. act the said Mary Shumaker is to have only one hundred dollars of said devise and I now order and direct that my son Jacob Errett is to account and pay the one half of said valuation in the land in one year next after my decease and the remaining one half in one year next after the decease of said Mary Shumaker and the same to be devided and devised to the heir as set forth in first writing I devise to Allen Allshouse one hundred dollars in one year next after my decease being excess pay for services over what she has received I also charge my son Henry Errett with one hundred dollars and my son Lewis Errett with the payment of two hundred dollar and my daughter Catharine intermarried with Ruben Miller with the payment of one hundred dollars and the same to be accounted for in their respective shares I devise to my daughter Lydiann Shull during her natural lifetime and after her deceas to her bodily heirs all that certain house and lot of ground known as the Mary Shumaker property Containing 2 3/4 ar strict measure situate in Hempfield Tp Co & state aforesaid charging her the said Lydiann Shull therewith in the sum of four hundred dollars as so much of her share out of my Estate witness my hand and seal this 6th day of April AD 1876" (seal) George [his X mark] Errett "signed sealed published & declared by the said Testator as and for a supplement to the foregoing will and testament in the presence of us who in his presence and at his request have subscribed our names as witnesses thereto" Oliver P.
