We encourage links to the state and county table of contents. ____________________________________________________________ The last will and Testament of me Thomas Hayden of Rostraver Township, Westmoreland County State of Pennsylvania, made this Sixteenth day of February A.D. 1874 as follows To Wit: First I order and direct that all my just debts funeral expenses, proving of this my will, be in the first place fully paid and Satisfied and after payment thereof, I give and bequeath to my Son William Hayden his Heirs and assigns all the Home farm Situate in Rostraver Township county and State above mentioned about one hundred and ten Acres of land (It being the same deeded by me to him) Excepting all the six feet-vein or strata of coal underlaying the same with all necessary mining privileges Except four acres of said vein of coal, underneath the buildings Springs go. Secondly I give and bequeath to my Son Abijah Hayden his heirs and assigns that certain piece of land Situate near Alexander Thompson about twenty four acres of land Excepting the Six feet vein of Coal underlaying the Same together with all necessary mining privileges. Thirdly I give and bequeath to my Daughter Christena Marshall the Sum of two-hundred ($200.00) to be paid to my daugher Elsey Heyden as trustee for her use, I give and bequeath to my son Henry Hayden the sum of five hundred dollars to my son Isaac Hayden the sum of five hundred dollars, To my son Alexander Hayden the Sum of five Hundred Dollars, To my son Thomas Hayden the sum of five hundred dollars, To my daughter Abigail Louisa Fell the sum of five hundred dollars, To my son Samuel Hayden the sum of two ($200) dollars, to my Son Samuel's children the Sum of three hundred dollars, to my son James Hayden the Sum of five hundred dollars to my daughter Elsey Hayden the sum of one Thousand dollars ($1,000.00) To my daugher Mary Melinda Hayden the Sum of Eight Hundred ($800.00) To my son Abijah Hayden the sum of fifteen Hundred dollars in addition to the piece of land herein before mentioned ($1500.00) the above mentioned sums to be paid out of the price of the coal when sold. Fourthly I order and direct that my daughters, Elsa and Mary Melinda have their home with my son William so long as they remain unmarried he to provide for them the necessaries of life. Fifthly I order and direct that the aforementioned Six feet-vein or Strata of Coal be sold by my Executors when they may think the same can be sold to be for the good of all concerned and after the payment the herein before mentioned sums, the remainder if any be Equally divided Between my Son William Hayden, Abijah Hayden Elsa and Mary Melinda Hayden share and share alike. I hereby nominate constitute and appoint my friend J. H. Maffet and my Son William Hayden Executors of this my will to which I the Said Testator have hereunto Set my hand and Seal this 16 day of February A.D. 1874, signed by the said Testator as and for his last will and at his request have subscribed our names as witnesses [signed] Thomas Hayden [signed] John Gamble Jr. [signed] Hiram Gamble Westmoreland county SS. Before me came John Gamble Jr. and Hiram Gamble the subscribing witnesses to the hereto annexed will of Thomas Hayden Decd who upon their oaths do say that they were present and saw the said testator sign his name to the end thereof & heard him publish and declare the same to be his last will and testament & at the time of so doing he was of sound mind memory and understanding & that they signed their names thereto as witnesses at his request in his presence & in the presence of each other.
