PA. as found at the Greensburg Courthouse, Westmoreland Co. PA. The original Will was not available, this record was taken from the Will Docket Book. Christopher Lobinger was on the Committee for Correspondence for Westmoreland Co 1775-1776, Delegate to the first Constitutional State Convention in Philadelphia July 15, 1776 - Sept 28 1776. He was also a Major in the Westmoreland Co. Militia, and under the Constitution of 1790 he was a member of the House of Representatives 1791-1793. Will of Christopher Labengeyer Deceased 204 Proved 12 Jul 1798 In the name of God amen I Christopher Labengeyer of Mount Pleasant Township in the County of Westmoreland and State of Pennsylvania Yeoman being very sick and weak in body but of sound mind memory and understanding, blessed be God for the same, do make and publish this my last Will and Testament in the manner and form following. To wit, Principally and first of all I commend my immortal spirit into the hands of God who gave it, and my body to the earth, to be buried in a decent and christian like manner at the discretion of my Executors herein after named, and as to such worldly estate, wherewith it hath pleased God to bless me in this life I give and dispose of the same in the following manner to wit. First it is my will and I do order that all my just debts and funeral charges be first and foremost paid and adjusted and that a true inventory and -------able appraisement of all my personal property or Estate be made as soon after my decease as circumstances will admit of. Item I will that my beloved wife Elizabeth may keep my said personal estate in her hands and with my youngest sons carry on business on my dwelling plantation (namely with my two youngest sons Christopher and George) she to have the full management thereof as long as she sees cause (and in case she remains my widow) or at least that she might carry on business for the space of two years after my decease may happen, and at anytime afterwards when she sees cause to give up said (page 145) business, then in such case I will that my Executors shall cause a good decent and complete dwelling house to be erected and built, sufficient for her to live comfortably in, with a good stable and garden, all to be done in such manner and form and on such part of my said dwelling plantation as she, my said wife shall choose and direct, and to be done at the expense of my Estate for her use during her natural life. Item I give an bequeath unto my said beloved wife the third part of all my remaining personal property, she to have privilege to take such articles as she fancies thereof at the appraisement, to the amount of her third part. Item I give and bequeath unto my said wife the third part of the produced of my said dwelling plantation, and also the third part of the produce of my Mill for and during her natural life, or as long as she remains my widow, but in case she marries, again the said third parts of the produce of said plantation and mill to cease. Item it is my will and I do order that about the expiration of two years after my decease shall happen, my here after named Executors so choose eight or twelve reputable neighboring freeholders and by them get all my lands what and wheresoever it may lie judiciously appraised and agreeable to the valuation so made. I give and devise my said Mill and land thereunto belonging situated partly in Mount Pleasant Township aforesaid and partly in Fayette County, Bulskin Township adjoining lands of Ralph Cherry, Barney McCall and others containing about three hundred and seventy acres of land, unto my eldest son John Labengeyer, and to his heirs and assignes forever and whatsoever improvements or buildings the said John may make thereon before its appraised the value of the same to be allowed him. Item I give and devise unto my other two sons Christopher and George Labengeyer (agreeable to the valuation) all my aforsaid dwelling plantation, situate in Mount Pleasant Township aforesaid adjoining lands of Nathaniel Husk, Moses Latta, ------- and others containing about six hundred acres of land to hold to them the said Christopher and George, their heirs and assigns forever subject(both the mill and dwelling plantation) to the respective reservations to my wife as aforesaid. It is my will likewise that my said wife shall also have pasture for her creatures on the said dwelling plantation along with the creatures of my said sons. Item it is my will and I do order that all the remainder of my lands (or real estate) whatsoever shall and may be disposed of by my Executors at such time and in such manner and form as my Executors shall think most proper to the best advantage of my children. It is likewise my will that each of my children namely John, Christopher, Catharina intermarried to Jacob Painter, George, Elizabeth, Mary, Barbara and Susanna shall receive equal even shares of all my estate real and personal (exepting such parts thereof as was hereafore willed to my beloved wife aforesaid) as well sharing the money raised by sales as also the valuation of the dwelling plantation and mill aforsaid. Item the remaining two thirds of my personal estate not yet bequeathed I will that my children aforesaid may distribute and divide it among themselves as the valuation rate. It is also my will that at the appraising of the mill and dwelling plantation the incumbrances laid thereon(as within) might be considered and lastly I nominate, constitute and appoint my said wife my son John Labengeyer, and son in law Jacob Painter to be the Executors of this my last Will hereby revoking all other wills by me heretofore made. In witness whereof I have hereunto set my hand and seal the twenty seventh day of June Anno Domini one thousand seven hundred and ninety eight.
