We encourage links to the state and county table of contents. ____________________________________________________________ Samuel Smith's Will, Volume 1, p. 37 July the twenty seventh one thousand seven hundred and eighty eight In the Name of God Amen I Samuel Smith of Fairfield Township in Westmoreland County, being very weak in Body but of Perfect Mind and Memory thanks be to the Almighty God, and calling to mind the Mortality of my Body and Knowing that it is appointed for all men once to die, Do make and ordain this my last Will and testament, That is to say, principally and first of all I Give and recommend my soul into the hands of Almighty God that Gave it and my Body I recommend to the earth to be Buried in a decent & christian like manner Nothing doubting but I shall receive the same again by the Mighty power of God that Gave it And as touching Such worldly estate wherewith it hath pleased God to bless me when in this life I Give demise and dispose of the same in the following manner and form. First I leave to my dearly beloved Wife, Betty Smith whom I ordain and appoint my sould Executrix of all my Estate Real & personal now in my possession during her Natural life Except as follows, I Give her Power to sell fifty acres of land adjoining Alexander Johnston or where the Coal Pit is to help to pay off the Legatees and other Expenses and the remainder part of the land at my wife Betsey's decease I leave to my well Beloved sons John Smith and James Smith Provided John Smith will lay her one hundred and fifty acres to the Warrant taken in my name of which there will be two hundred and fifty acres after fifty being sold if the Warrant can be filled up And the whole to be equally divided between the sd. John and James Smith, John Smith paying part of the legatees in proportion to what land he gets out of my Warrant, and what the fifty acres will not pay. I also leave to my well beloved daughter Nelly Smith fifty Pounds to be paid in Goods and chattles and if so be that Nelly should not get in from her captivity her fifty Pounds to be at the disposal of my beloved wife Betty Smith at her death also I leave to my Grand Son Samuel Smith son of my dearly beloved Daniel Smith one french crown and to my Grand son John Smith I leave forty shillings, also to Daniel Smith forty shillings, also to William Smith Fifteen Pounds. Also to my Grand daughter Betty Smith I leave forty shillings to be paid goods and chattles as each of them comes of age And also I leave to my beloved Daughter Mary Campbell forty shillings, and to Jean McKendrick forty shillings, and to Hannah Glen forty shillings and to be paid in Goods and chattles at the decease of my dearly beloved Wife Except it may suit my wife, or sons John and James Smith, And I do hereby utterly disanull revoke and disallow all and every other former Testaments Wills and bequests legacies and Executors by me in any before this time named willed and bequeathed ratifying and confirming this and no other to be my last will and Testament. McGee * *** the county of Westmoreland and being sworn in due form of Law saith that they were present & saw Samuel Smith the Testator within named sign seal pronounce & declare this to be his last will & testament & at the time of his so doing he was of Sound Mind emory & understanding To the best of their Knowledge. Sworn & subscribed before me Wm. Maghee D. Edward Halferty, John Hamill
