I Jacob Zimmerman of Hempfield township Westmoreland County & State of Pennsylvania Being Sick and weak in Body, but of Sound disposing mind and Memory, Thanks be to Almighty God for the Same, being mindful of My Mortality, Do make and Constitute this my last will and Testament. First and principally I commend my soul into the hand of God who gave it in hopes of a joyful resurection, and my body to the erth when it Shall please God to Seperate my Soul and body, and my body to be intered decently, at the discretion of My executors hereinafter Mentioned. And as to Such Worldly estate wherewith it hath pleased God to bless Me with in this World I give and dispose thereof in the following Manner. First I devise and bequeath my Dwelling Plantation Situate in Hempfield township aforesaid, Bounded by lands of Peter Zimmerman & others Containing One hundred & forty seven & one half Acres & allowance More or less to my Son George Zimmerman on the following terms and Conditions, he the Said George Zimmerman is to pay the Sum of Nineteen hundred and Seventeen Dollars for the Same to my respective heirs hereinafter Named in eighteen equal Annal payments. Commencing with the first payment one Year after My decease of the Sum of One hundred six dollars & fifty cents to my Son Daniel Zimmerman, and the like Sum to my Daughter Esther Intermarried with Adam Hetrick, one Year after that payment, and the like Sum to my Son George Zimmerman One Year after that payment And and the like sum to my son Benjamin Zimmerman in one year after that payment, the like Sum to my Son Jonathan Zimmerman in one Year after that payment ^ And the like Sum to my Daughter Lydia now Deceised, who was intermarried with John Friedt to her Children of her Body in one Year after that payment. And the like Sum to my Daughter Polly intermarried with David Baker, in one Year after the payment And the like Sum to my Daughter Sarah Intermarried with John Byers in one Year after that payment. And the like Sum to my Daughter Rebecka intermarried with Isaac Shooster in one Year after that payment, Thence Commencing again with the like Sum of One hundred & six dollars and fifty cents to my Son Daniel Zimmerman and continue Annually as before, with Esther, George, Jonathan, Benjamin, Lydia's children, Polly, Sarah, & Rebecka, being nine heirs which gives each of my heirs out of my real estate Two hundred and thirteen Dollars and if my Said Son George Zimmerman Complyes fully in paying my Several heirs as I have directed, he is to Have and to Hold the Said described Tract of Land to him his heirs and assigns forever. With all my tittle Papers &c &c. And further it is my Will that my Executors hereinafter named or the Survivors of them, immediately after my deciese to dispose of my Personal Estate according to Law and collect all my outstanding debts, only what I hereinafter otherwise direct, and from the proceeds arising therefrom pay all My Just debts and funeral expences, &c. And further it is my Will and I direct that the Two Notes I hold on my Son Daniel Zimmerman Conditioned for one day Under Seal the first thereof Cauling for forty dollars dated 30th Nov. 1840. & the second thereof Cauling for fifty dollars dated 16 April 1841. the amount of these Notes and interest I allow to be taken out of Daniel Share of my Real and person Estate as it Comes payable to him. I also direct that the Note and receipt I hold against my Son in law Adam Hetrick the Note Cauling for forty dollars under seal dated the 14 June 1834 and the receipt dated August 28th 1829 Cauling for twenty five dollars in cash, the Note with interest I also allow to be taken out of their Share of my Real & personal Estate as it comes payable to them &c. I also hold Two Notes under Seal Conditioned for one day Against My Son Benjamin Zimmerman the first thereof Cauling for the sum of One hundred and five dollars dated the 3rd of April 1837, the Second thereof Cauling for the Sum of One hundred and thirteen dollars Dated the 2nd day of April 1838 the payment of both these Notes I allow to be taken out of Benjamin share of my real and Personal Estate, but the said Benjamin not to be Charged with any interest on his Notes only the Credits he had against said notes &c. And further it is my Will that my heirs are to e made exactly Equal in both my real and Personal Estate in the mode and manner that I have herein before directed their Share to be respectively the Personal Estate as Soon as made in Money I allow it to be divided equally amongst my Several heirs before mentioned &c. And I hereby nominate, Constitute and appoint my son Daniel Zimmerman and my son Jonathon Zimmerman both of Westmoreland County of this my last Will and Testament, And do hereby revoke and annul any Will or Wills heretofore by me made at anytime &c.
