All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Georgia Morgan geoiamorgan@att.net February 13, 2011, 10:13 pm Source: Orphans Court Docket, F3, P. 330; 356-357 Written: 1789 York County, Pennsylvania, Orphans Court Docket Book F, p.330 PETITION FOR A VALUATION OF REAL ESTATE OF MICHAEL DANNER THE YOUNGER The Petition of Samuel Danner, eldest son and heir of Michael Danner the younger, deceased, was read to the Court setting forth that the petitioner's father lately died intestate leaving a widow named Susanna and lawful issue to survive him, namely, the petitioner, his eldest son and heir at law, Jonathan and Michael, Anna intermarried with Daniel Beckner, Magdalena intermarried with Samuel Brilhart, Barbara intermarried with William Dickey and Elizabeth. That the said intestate died owner and seized of two plantations and tracts of land one of which is situated in Manheim township, York County containing ninety acres more or less adjoining lands of John Ernst, Adam Hoffman and others. One other tract of land containig fifty three acres more or less adjoining lands of John Ernest and others. That the said widow and children of the intestate hold the said plantation and Tracts of land as Tenants in Common and undivided And praying the Court to award an Inquest to and Amongst the widow and Children of the said Intestate if the same will admit of with[out?] prejudice to or spoiling the Whole but if the same will not admit of such partition Then to value the Whole Undivided according to the form of the Acts of Assembly of this State in Such Case made And provided... Whereupon it is Considered by the Court and ordered that The Sheriff in his proper person with twelve good and lawful Men of his Bailiwick in the presence of all parties or the Guardians of Such of them as are Minors, who shall Choose to attend they having respectively had due and Legal Notice thereof Do hold an Inquest on the said plantations and Tracts of Land and make partition to and amongst the widow and Children of the said Intestate if the Same will admit of Partition or Division Without prejudice to or Spoiling the whole, but if the Same will [not] admit of partition Then to Value the Whole undivided according to the form of the Acts of Assembly of this State in Such Case made and provided and that the Said Sheriff Do make return of the Said Inquisition as well under his hand And Seal, as the hands and Seals of the Jurors orAffirmants by whom He shall make Such inquest to the next orphans Court after the same shall be held- --- Book F, pages 356, 357. Conrad Laub Esquire high Sheriff of the County of York Came into Court and made return of an order of a former orphans Court, to wit of the twenty third day of November last past Whereby he was Commanded, To make Parttion of Two Certain Plantations and Tracts of Land, one of which is situate in Manheim Township is this County, Containing Ninety Acres more or Less adjoining Lands of John Ernst, Adam Hoofman & others and one other Tract of Land Containing Fifty three acres More or less; adjoining Lands of John Ernst and Others, Late The Estate of Michael Danner Deceased. To and among the Children and Representatives of the said Deceased, who died Intestate,If the same would Admit of such Partition, without prejudice to or spoiling the Whole Otherwise to Value the whole undivided. And by the said Sheriffs Return, on the said order and an Inquisition thereunto annexed it Appears That the same will not admit of Such Partition in Manner Afforesaid, without Prejudice to or Spoiling the Whole, and that the said first Plantation and Tract of Ninety Acres of Land more or less Situate in Manheim Township aforesaid were of the value of Three Hundred and seventy three pounds Lawful money of Pennsylvania in Specie, and the other said Described Plantation, and Tract of Land Containing fifty three Acres more or less, were of the Value of one Hundred and fifty nine pounds Money Aforesaid. Which valuation the Court do Hereby Confirm. And now came into Court Samuel Danner, Eldest Son and Heir at Law of the said Deceased, and prayed to be permitted to take the said Plantations and Tracts of Land as Before Described with their appurtenances Late belonging to the said Michael Danner Deceased at the said valuation, He Paying unto the Widow and children of the said Intestate their Respecive Shares therof. Whereupon it is ordered and Decreed by the Court that the said Samuel Danner be allowed the sum of Seven pounds twelve Shillings for the Expences and Costs of these Proceedings That he pay unto Susanna Danner the Widow of the Said Intestate Yearly and every year during the Term of her Natural Life, the Sum of Ten pounds Nine Shillings and Nine Pence Infull for the right or Claim of Dower of the said Susanna, Out of the said Improvements & Tracts of Land The first payment whereof to become due in one Year from this Date. That He retain in his own Hands the Sum of Eighty Seven Pounds Eight Shillings and After the Death of the said Widow the farther Sum of forty three pounds fourteen Shillings, in full for his two Shares of the Said Valuation as eldest Son and heir at Law of the said Intestate. That he pay unto Jonathan Danner, Michael Danner & Elizabeth Danner and unto each and every of them, the Sum of Forty three pounds fourteen Shillings, and After the death of the said widow the further Sum of twenty one Pounds Seventeen Shillings, in one Year from this Date, in full for their Respective Shares of the said Valuation as Children of the said Deceased. And that he pay unto Anna Intermarried with Daniel Beckner in right of the said Anna, Magdelina Danner Intermarried with Samuel Brillhard in right of the Said Magdalina & Barbara Danner intermarried with William Dickie, and unto Each and every of them, the Sum of Forty three Pounds fourteen Shillings, and after the Death of the said Widow the Farther Sum of Twenty one pounds Seventeen Shillings each in One Year from this Date; infull for their respective Shares Thereof as Children of the said Deceased, which said several sums of Money are the full amount of the said valuation And it is Further decreed and Ordered by the Court that upon the said Samuel Danner's Making the several payments, aforesaid, or Giving good Security for the same That thereupon the Said Samuel Danner his heirs and Assigns Do hold the Plantations and Tracts of Land and premises with the appurtenances for the Same, and in as full and ample a Manner as The said Michael Danner, his father in his lifetime held & Enjoyed the Same, Exonerated and Discharged from the further Claims of the said Younger Children of the Said Intestate & All persons Claiming or to Claim the Same under them or any of them.
