Inquest awarded to the honorable Orphan's Court of York County the petition of the Daniel KRAMER and Mary Ann SILK, his wife, late Mary ANN SILK, Susan SILK, Elizabeth SILK, Agnes (blank space allowed) ...... SILK, and John SILK, the last two being minors and petitioning by their guardian Samuel Cross - the said Mary Ann, Susan, Elizabeth, Agnes and John SILK being the heirs and legal representatives of John SILK; latest Hopewell Township, deceased, respectively represents: That their late father, thus said John SILK, lately died interstate at the township and aforesaid, leaving a widow, since deceased, and issue, five children, your petitioners. That he died seized in his demise and of fee of and a certain tract of land situated in the township aforesaid, adjoining land of David DOUGLAS, John BORTNER or and others, and containing about 81 acres, with the improvements and appurtenances. That your petitioners will hold the said tract of land and undivided and in common, as valuation, appraised or partition of the same having been made and that they are divisions that it showed be effected. They therefore pray your Honorable Court to constitute and David DOUGLAS, Wintle TROUT, John GIBSON, John MORRISON, Jacob SNYDER, Abraham MILLER and Michael ZIEGLER, 7 men chosen by your petitioners to part value and appraised to said tract of land according to talk, and to make report to your Honorable cop court of their proceedings therein after the same shall have been done. The petition of Daniel CRAUMER and Mary Ann SILK, Susan SILK, Elizabeth SILK, Agnes SILK, and John SILK the last two being minors and petition being by their guardian Samuel CROSS the same Mary Ann, Susan, Elizabeth, Agnes and John SILK being the Heirs and legal representatives of John SILK the late of Hopewell Township deceased was presented Stating That their late father the said John SILK lately died Intestate at the Township aforesaid leading a widow since deceased and issue five children, your Petitioners That he died Seized in his demise as of fee of and in a certain tract of land and situate in the township aforesaid adjoining land of David DOUGLAS, John BORTNER and others and containing about 81 acres with three improvements and appurtenances that your petitioners still hold the said tract of land on divided and in common no valuation appraised that a partition of the same having been made, and that they are desirous it should be affected. They therefore pray your Honorable Court to constitute and appoint David DOUGLAS, Wintle TROUT, John GIBSON, John MORRISON, Jacob SNYDER, Abraham MILLER and Michael ZIEGLER Seven men chosen by your petitioners two-part value and appraise the said the tract of land and according to law and to make report to your Honorable Court of their proceedings thereafter the same shall have been done. That due and legal notice of the time and place of holding said Inquisition be given to the parties interested so that being warned they may attend and that said men make report of their proceedings herein to do the next Court after they shall have performed the duties assigned to them. by the court, John Albirlson, clerk ------ To the honorable the Orphans Court of York County The undersigned seven men appointed by the accompanying order of your honorable court to make a partition of the real estate of John SILK, late of Hopewell Township, deceased, respectfully report, that knowing first been duly sworn or affirmed respectively accordingly to law, and the parties in interest having first received to notice of the time in meeting, and placed thereof, they did on the 24th day of December A.D. 1850 go up on the premises in said order mentioned, and being of opinion that the property could not be divided into so many parts as wanted to accommodate all the Heirs but that it may be divided into two parts as per the annexed graphs, as follows, viz. ----- No. 1 adjoining land of David DOUGLAS, John BORTNER and others containing 50 acres and 12 purches on which is erected 1 1/2 story log house, log barn and other buildings they have valued and appraised at the sum of $375. ----- No. 2 Adjoining lands of Michael ZIEGLER, John HANNIGAN and others containing 31 acres and 18 perches without any improvements thereon corrected they have valued and appraised at the sum of $200. Witness for John SILK Lydia HANAGAN John CROMMER --------- Orphans Court 6 January 1851 Order to sell the real estate of John SILK deceased 25 February 1851 sale confirmed York County SS At an Orphans court held at York Jan. 6, 1851 whereas that a former Orphans Court and order was issued directed to seven men chosen by the Heirs and legal representatives of John SILK late of the township of Hopewell in the County of York deceased to make partition in valuation of the real estate of said decedent to and among said Heirs and legal representatives according to law. And whereas by the report of said inquest to said report said real estate was separated and divided onto two parts in each part separately valued and appraised which partition in valuation were duly confirmed by said court. And Jan. 6, 1851 said Heirs and legal representatives by their paper files refused to accept said real estate or any part thereof at the evaluation aforesaid and pray the court to appoint Samuel CROSS Esq. trustee to make sale of. Signed by said Heirs the legal representatives. ----- Whereupon the court awarded a sale of said real estate to Samuel CROSS Esq. trustee appointed by the Court for that purpose he having filed his bond with approved surety into some of $1000 then order and direct him to expose said real estate to public sale at the premises No. 1 on Friday the 31st day of January 1851 at 1:00 PM and the following terms and conditions the purchase money to best cash Cash value the first day of April 1851 to the trustee said real estate being No. 1. Adjoining lands of No. 2 David DOUGLAS, John BORTNER and others containing seventy five acres and 12 perches of which is erected a one and half story log house,log barn and other out buildings -- valued and appraised at $375 No. 2 adjoining lands No. 1, Michael ZEIGLER, John HANNIGAN and others containing 31 acres in 18 purches without improvement value at $200 said trustee to make report of sales to the court thereafter.
