HERSHEY (the surname was spelled Hershey) written: March 28, 1804 (the deed was written as 1804, but it appears the 8 may have been left out (1884) recorded: March 28, 1884 location: Fawn township, York county, Pennsylvania by lands of John DAVIS, lands of Henry LANIUS, Sr, now John LANIUS, Jr, by public road, by land formerly of George BADDERS, by land formerly of James BROWN, by land formerly of Jacob GROVE, Sr. acres: 108 acres and two perches cost: $2,500 ---- This Indenture made the 28th day of March in the year of our Lord one thousand eight hundred and four Between Conrad BADDERS of the township of Fawn in the County of York and State of Pennsylvania of the first part and Joseph S. HERSHEY of the same place of the second part. Witnesseth that the said party of the first part for and in consideration of the sum of twenty five hundred dollars, lawful money of the United State of America unto him, well and truly paid by the said party of the second part at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledged has granted bargained, sold, aliened, and enscoffed, released, conveyed and confirmed by these presents does grant bargain sell alien, and enscoff, release, convey and confirm unto the said party of the second part his heirs and assigns all that certain messauge or tenement and tract of land situate will in the township of Fawn in the County of York in State of Pennsylvania bounded and limited as follows to wit; Beginning at a stone at the corner of the land formerly of John DAVIS thence North forty four and three fourths degrees West forth eight and seven tenths perches to a stone; thence by land of Henry LANIUS Sr. and now of John H. LANIUS, Jr. twenty one and three fourths degrees West thirty seven perches to a stone, Thence North nineteen degrees of West fifty and five tenths perches to a stone in Public Road Thence North six degrees West fifty and eight tents perches to a stone, thence North eighty five degrees. East seventy five perches to a chestnut, thence by land formerly of George BADDERS south fourteen degrees East fifty four perches to a black oak, thence North forty seven degrees east thirty seven perches to a black oak thence South thirty six degrees east forty eight perches to a chestnut, Thence North eighty three degrees east fifty three perches to stones, thence by land formerly of James BROWN South 8 degrees last 32 purchased two stones. Thence fifty six degrees West fifty nine perches to a black oak. Thence South east By land formerly of Jacob GROVE Sr Eighty five perches to a stone and place of Beginning. Containing one hundred and eight acres and two perches and the allowance. It being part of the same premises which by sundry deeds of the conveyance duly executed became vested in the right of the said Conrad BADDERS to his heirs and assigns forever. As reference being thereunto had may more fully and at-large appear. Together, with all and singular the buildings improvements ways, waters, watercourses, writes and liberties privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the revisions and remainders rents, issues and profits thereof; and all the estate, right, title, interest, property, claims and demands whatsoever of him the said party of the first part in law equity, or otherwise howsoever of in and to the same and every part parcel thereof To have had to hold the said tract of land of one hundred and eight acres and two perches and the allowance hereditaments and premises hereby granted or mentioned and intended so to be with the appurtenances unto the said party of the second party his heirs and assigns to and for the only proper use and behoof of the said party of the second part his heirs and assigns forever. And the said Conrad BADDERS for himself his heirs, executors and administrators to by these presents, covenant, Grant and agree to and with the said party the second parties heirs and assigns that the said party the first his heirs all and singular the hereditaments the premises herein above described in granted or mentioned and intended so to be, with the appurtenances unto the said party of the second parties heirs and assigns against him the said party of the first part his heirs, and against all and every other person or persons whomsoever lawfully claiming or to claim to same or any part thereof, by from or under him shall and will warrant and forever defend. In Witness whereof the said party of the first part is hereunto set his hand and seal dated the day and year first above written.
