All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Rosalie Sommer sommer@suscom.net March 29, 2006, 5:09 pm Fawn township Written: December 28, 1867 Recorded: May 30, 1868 DEED 6S, 288 York County Pennsylvania written 28 December 1867 recorded 30 May 1868 Grantor (seller): Samuel Badders and wife Grantee (buyer): Robert Scott locateion: Fawn township acres: 5 acres, 115 perches cost: $300 This Indenture made the 28th day of December in the year of our Lord eighteen hundred and sixty seven, Between Samuel Badders of Fawn Township York County and state Pennsylvania and Agnes T. his wife of the first part, and Robert Scott of the Township County and state aforesaid of the second part, Witnesseth, that the said parties of the first part for and in consideration of the sum of three hundred dollars lawful money, of United States of America, sell and truly paid by the said party this second part, to the said parties to the first part, ended before the ensealing and delivery of these presents, the receipt hereof is hereby acknowledged, have granted, bargained and alien and enscoffed, released, conveyed and confirmed, and by their presence to grant, bargained, sell alien, and enscoffed, release, conveyed and confirm unto the second part of his heirs and assigns. All that certain messauge tenement and track of land, situated in Fawn Township in the county of York and State of Pennsylvania bounded as follows viz; Beginning at a stone set in the ground; thence by land of Robert D. Brown, South thirty seven and one half degrees, East twenty four perches to a stone, fence by the end of Samuel Allen North sixty seven degrees East, thirty nine and two tenths perches to a black oak tree; thence by lands of Thomas Kimes North sixty degrees West, forty and five tenths purchase to a post, thence by Land of Robert Scott South forty degrees West twenty perches to the place of the Beginning, Containing five acres and one hundred and fifteen perches neat measure, It being the same premises which Robert D. Brown and Caroline his wife, by Indenture bearing date this 2nd day of August, 1865, for the consideration therein mentioned did create and confirm to the said Samuel Badders, party hereto his heirs and assigns forever, as an and by the said in part recited Indenture recorded in the office for Record of Deeds in and for the aforesaid County, and Record Book V.V.V.V.page 344. Reference being hereto had more fully appear. Together with all and singular, the buildings, improvements, woods, ways, rights, liberties, privileges, heretiaments and appurtenances, to the same beginning, or in anywise appertaining, and to the revision and revisions, remainder and remainders, rent, issues and profits thereof, and that of every part and parcel thereof. And also all the estate, right, title, interest, property, possession, claims and demand whatsoever, both in all and equity, of the said parties of the first part, of in and to the said premises, with the appurtenances: To have and to hold the said premises, with all and singular the appurtenances, on to the said party of the second part, his heirs, and assigns, to the only proper use, benefit and behoof of the said party of the second part his heirs and assigns forever. And the said Samuel Badders and Agnes T. his wife their heirs, executors and administrators, Do by these presents covenant grant and agreed to and with the said party of the second part, his heirs and assigns that they the said parties of the first part their heirs, all and singular the hereditaments and premises herein described and granted, or mentioned and intended to be with the appurtenances, unto to the said party of the second part, his heirs and assigns against them to the said parties of the first part their heirs, and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof shell and will by their presence warrant and forever defend. In witness whereof, the said parties of the first part to these presents hereunto set their hands and seals, Dated today and year first above written. SIGNED: Samuel Badders Agnes T. Badders Signed, sealed and delivered in the presence of William Grove Samuel Adams Received, today and date of the above Indenture of the above named Robert Scott the sun of three hundred dollars in full of the consideration money herein mentioned. witness Samuel Adams State of Pennsylvania York County, Ss Be it remembered, that on this twenty eighth day of December in the year of our Lord eighteen hundred and sixty seven before me, the subscriber a Justice of the Peace, in and for said County personally came the above named Samuel Badders and Agnes T. his wife who, I am satisfied are the grantors mentioned in the above deed a conveyance, and I having first made known to them the contents thereof, have acknowledged that they signed, sealed and delivered the same as their voluntary act and deed; and the said Agnes T. Badders being a full age on a private examination apart from her said husband before me acknowledged that she, signed, sealed and delivered the same as their voluntary act and deed, without any fear, threats or compulsion of her said husband, All of which is hereby certified.
