Brown and wife to Samuel Badders This Indenture, made to The Second day of August in the year of our Lord one thousand and sixty five, Between Robert D. Brown of Fawn Township York County and state of Pennsylvania and Caroline his wife of the first part, and Samuel Badders of County and State aforesaid, of the second part, witnesseth, that the said parties of the first part, for and in consideration of the sum of one hundred and forty two dollars lawful money of the United States of America, ball into them the well and truly paid by the said party of the second part at or before the sealing and delivery of these presents, the receipt where ofis hereby acknowledge, have granted, bargained, sold, aliened, enscoffed, released and confirmed, and by these presents do grant, bargain, aliened, scoffed, released, and confirmed onto the said party of the second part, his heirs and assigns. All that certain messauge or tentament and tract of land situated in Fawn Township in the county of York and state aforesaid wounded as follows it is, Beginning at a stone, set in the ground thence by the lamd of Robert D. Brown, South thirty seven and a half degrees East twenty perches to a stone, thence by the land of Samuel Allen, North sixty seven degrees East thirty nine and two tenths perches to a black oak tree, Thence by the land of Thomas Kimes, North sixty degrees west forty eight and five tenths perches to a post, fences by land of Robert Scott, South forty degrees west twenty three perches to the place of Beginning Containing five acres and one hundred and fifteen perches neat measure. It being the same premises or a part of the same which the said Robert D. Brown, obtained by decree of court of, the estate of the late John Brown, deceased. Together with all and singular the buildings, improvements, ways, waters, water, courses, rights, liberties, privileges, herditaments and appurtenances whatsoever here unto belonging or in any wise appertaining; and the revisions and remainders, rents, issues and profits thereof; and all the estate, right, title, interest, property, claim and demand whatsoever of them the said the parties of the first part, in law, equity, or otherwise howsoever, both in and to the same and every part and parcel thereof. To Have and To Hold this said the messuage or tenement and track of five acres and one hundred and fifteen perches of land hereditaments an premise is hereby granted, were mentioned and intended so to be, with the appurtenances, unto the said party of the second part, his heirs and assigns, to and for the only proper use and behoof of the said partyof the second part, his heirs and assigns forever. And the said Robert D. Brown and Caroline, his wife, their heirs, Executors and administrators, do by these presents, covenant, Grant and agree to and with the said party of the second part, his heirs and assigns, the they the said parties of the first part, their heirs, all and singular the hereditaments, and premises here and the above described and granted, were mentioned, and intended said to be, with the appurtenances, unto this said party of the second part his heirs and assigns against them this said parties of the first part, their heirs, and against all and every other person or persons whomsoever, lawfully claiming or claim the same or any part thereof, Shall and will warrant and forever defend. In witness or hereof all the same parties of the first part had here are on to set their hands and seals dated that day and year first above written. SIGNED: R. D. Web -------- Received, the day and the date of the above Indenture of the above named Samuel Badders, One hundred and forty nine dollars and ninety six cents, in full of the consideration money therein mentioned. The second day of August on the Domini 1865, before me the subscriber, a Justice of the Peace, in and a for said County, personally appeared that the above named Robert D. Brown and Caroline his wife and in due form of law acknowledge the above Indenture to be their act and Deed, and desire the same might be recorded as such, and she the said Caroline Brown, being of full age, and separate and apart from her said husband by me therein privately examined and the full contents of the above Deed being by me first made known onto her did thereupon declare and say that she did voluntarily and of own free will and record, Sign Seal and as her act and deed, deliver the above Indenture, without any coercion to or compulsion of her said husband.
