All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Rosalie Sommer sommer@suscom.net November 1, 2005, 7:21 pm Fawn Township, York county, Pennsylvania Written: June 3, 1815 Recorded: February 28, 1816 York County Archives, York, Pennsylvania Deed Book 3B, page 146 Grantee (buyer): John MARSTELLER of Fawn Twp Grantor (seller): James BROWN of Fawn Twp date written 3 June 1815 date recorded 28 Feb 1816 purchase price $199.00 acres: 4 acres and 156 perches [transcribed from the original 15 Aug 2003 Rosalie Sommer] THIS INDENTURE made third day of June in the year of our Lord one thousand eight hundred and fifteen between James BROWN and Margaret his wife of Fawn township, York County, State of Pennsylvania of the one part and John MARSTELLER of the same place of the other part WITNESSETH that the said James BROWN and Margaret, his wife for and in consideration of the sum of one hundred and ninety nine dollars to them the said James BROWN and Margaret his wife well and truly paid at or before the sealing and delivery of these presents in full for the absolute purchase of the inheritance in fee simple of and in all that tract or parcel of land with its appurtenances & as herein after all that tract or parcel of land with its appurtenances & as herein after mentioned to be hereby bargained and sold the receipt whereof they the said James BROWN and Margaret his wife doth hereby acknowledge and thereof and from every part thereof doth acquit release and discharge the said John MARSTELLER his heirs executors and administrators and every of them for every by these presents they the said James BROWN and Margaret his wife the granted bargained and sold and by these presents doth grant bargain and sell unto the said John MARSTELLER his heirs and assigns all their right title, claim, interest and demand, of whatever name or nature it may be in and to the aforesaid tract or parcel of land it being part of a tract or parcel of land SITUATE in Fawn township York County and State of Pennsylvania call'd Brown's Choice adjoining lands with James SCOT, John MARSTILLER and others bounded and running as followeth to wit BEGINNING at a stone corner of John MARSTILLER other land and runing thence north ten and a half degrees West eight and sixtenths perches a post, in the side of the road then with said road south sixty six and a half degrees West twenty four perches to post in the road and with the road South seventy two West seventy two and four tenths perches to a post in the line of James SCOT land then with said SCOTS land South seventy degrees East seventeen and six tenths perches to a stone corner of James SCOT and John MARSTELLER land north sixty nine and a half degrees East eighty two and a half perches to the beginning CONTAINING four Acres and one hundred and fifty six perches. TOGETHER with all and singular the rights members and appurtenances there unto belonging and the reversions and remainders, rents, issues and profits therof To Have and To Hold the said land and all and Singular other the premises hereby bargained and sold r mentioned a intended so to be, with their and every of theirs, rights members and appurtenances, unto said John MARSTELLER his heirs assigns to the only proper use of him the said John MARSTELLER his heirs and assigns for ever And they the said James BROWN and Margaret his wife and their afore said unto the John MARSTELLER his heirs and assigns and against all and every person and persons whatsoever who may r shall claim from though or under them or any of them they said James BROWN and Margaret his wife. Received the day and year above written from the above named John MARSTELLER the above mentioned consideration money in full by me James BROWN Testes Thomas JORDAN York County Ss. on the third day of June one thousand eight hundred and fifteen before me the subscriber one of the Justices of the Peace for said county personally came the above named James BROWN and Margaret his wife and acknowledged the above Indenture to be their act and deed and desired that the same might be recorded according according (written twice) to law. The said Margaret being of full age and Separate from her husband by me examined as the law directs declared that she voluntarily became a party to the same without any coercion of force.
