Between Daniel Carpenter of Monaghan Township in the County of York and State of Pennsylvania of the one part and Martin Binder of Warrington Township in the County & State aforesaid of the Other part. Whereas the said Daniel Carpenter in and by One One Certain obligation at Writing obligatory under his Hand and Seal bearing Date the Eighteenth day of June A.D. 1794. Standeth bound unto the said Martin Binder in the Sum of Three Hundred Pounds Lawful money of Pennsylvania Conditioned for the payment of One Hundred and fifty Pounds like money aforesaid on the Eighteenth day of June which will be in the Year of Our Lord One Thousand Seven Hundred and Ninety Seven with Lawful Interest for the same As in and by the said Obligation and Condition p188 thereof Relation Being thereunto had more fully and at large appears Now this Indenture Witnesseth that the said Daniel Carpenter for & in Consideration of the aforesaid Debt or Sum of One Hundred and fifty Pounds and for the better securing the payment thereof unto the said Martin Binder his Heirs Executors, Administra- tors and Assigns in Discharge of the said recited Obligation and in Consideration of the further Sum of five Shillings by the said Martin Binder to the said Daniel Carpenter in hand paid at the en___- ling and Delivery of these Presents the Receipt whereof is hereby acknowledged. Hath Granted Bargained sold released and Confirm- ed and by these presents Doth Grant Bargain sell release and Confirm unto the said Martin Binder and to his Heirs and Assigns A Certain Tract of Land Situate in Monaghan Township Aforesaid Adjoining lands of Philip Koons John Crothers William Lease and Matthew Dill Containing Two Hundred and thirty nine acres and Eighty nine perches and allowance of Six per Cent for Roads (It being the same Tract of Land which the above said John Crothers and Ann his wife by their Deed bearing date the twelfth Day of March Anno Domini One thousand Seven Hundred and Ninety five for the Con- sideration therein mentioned did grant Bargain Sell and Confirm Unto Daniel Carpenter party to these presents and to his heirs and Assigns forever as in and by said Deed may more fully & at large appear. Together with all and Singular the Houses Out Houses Buildings Barns Stables Gardens Orchards Improvements Ways Woods Waters Water Courses Rights Liberties Privileges Heredita- ments and Appurtenances whatsoever thereunto belonging or in any wise appertaining and the Reversions and Remainders Rents Issues and profits thereof. To Have and to Hold the said Tract of Land Hereditaments and Premises hereby Granted or mentioned or intended so to be with the Appurtenances unto the said Martin Binder his Heirs and Assigns to the Only proper Use and Behoof of the said Martin Binder his Heirs and Assign forever. Provided always nevertheless that if the said Daniel Carpenter his Heirs Executors Administrators or Assigns to the Only proper Use and Behoof of the said Martin Binder his Heirs and Assign forever. Provided always nevertheless that if the said Daniel Carpenter his Heirs Executors Administrators or Assigns shall and do well and truly pay or cause to be paid unto the said Martin Binder his Heirs Executors Administrators et Assigns the afore- said Debt or Sum of One Hundred and fifty Pounds on the Day and time herein before mentioned and appointed for the Payment thereof with Lawful Interest for the Same According to the Condition of the last Recited obligation without fraud or further Delay and without any Dedication or Abatement to be made of any thing for or in Respect of any lanes Charges or Assessments whatsoever that then and from thenceforth as well this present. Indenture as the Estate hereby granted & the said Recited Obligation shall cease determine & become absolutely void to all Intents & Purposes whatsoever any thing here in Contained to the Contrary in any Wise not withstanding.
