CUNNINGHAM of the city of York GRANTEE (buyer): William BADDERS of Cross Roads, Hopewell township, York County Pennsylvania written: March 31, 1902 recorded: March 31, 1902 location: East Hopewell township, York county, Pennsylvania by lands of Joseph Hanigan and Katie M. Miller acres: 69 perches cost: $475 history of deed: The 69 perches was part of an original 2 acres and 135 perches David C. WALTEMYER and Ida his wife sold to Ella J. HANIGAN. Ella J. HANIGAN and Peter her husband by sold to Katie M. MILLER and her husband J. N. MILLER Katie M Miller and her husband sold to Vera E. LUTZ now CUNNINGHAM Feb 13, 1897 Deed Book 11U, 461. ------ This Indenture made the 31st day of March in the year of our Lord one thousand nine hundred and two. (1902) Between Vera E. LUTZ now CUNNINGHAM and William B. CUNNINGHAM her husband of the city of York, County of York and state of Pennsylvania, of the first part and William BADDERS of the borough of Crossroads, Hopewell Township, County and state aforesaid of the second part, witnesseth, that the said parties of the first part for and in consideration of the sum of four hundred and seventy five dollars $475 The lawful money of the United States of America, well and truly paid by the said party of the second part, to the said parties of the first part, at and before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged have granted, organized, sold, received, enscoffed, indeed, conveyed and confirmed and by these presents to grant bargain, sell, alein, enscoff, issue, convey and deliver unto the said the party of the second part his heirs and assigns. All the following enscribed tract of land situate in East Hopewell Township, York County and State of Pennsylvania, bounded and described as follows, to wit – Beginning at a stone in public road, the ---- Lands of Jos. HANIGAN to and along road south sixty eight degrees east to sixteen perches to stone, thence by land of Katie M. MILLER of which this is a part south eighteen and one half degrees west four and four tenths perches to a stone, thence same north sixty eight degrees west fifteen and six tenths perches to a stone, thence by same North sixteen degrees east four and four tenths perches to place of Beginning Containing sixty nine perches of land. It being part of a bigger tract of two acres and one hundred and thirty five perches of land which David C. WALTEMYER and Ida his wife by their deed did sell unto Ella J. HANIGAN and Ella J. HANIGAN and Peter her husband by their deed did sell and convey unto Katie M. MILLER and J. N. MILLER her husband by their deed sell and convey unto Vera E. LUTZ now CUNNINGHAM party to the first part here onto, dated the 13th day at February 1897 her heirs and assigns forever, said and being recorded in the office for recording the deeds and for the county of York in Deed book 11U, page 461, reference thereto being will more fully and at-large - ---. Together with all the singular the buildings improvements, Woods, as ways, writes, liberties, privileges your tenants and appurtenances to the same belonging or in anywise appertaining and the revision and revisions, a remainder and remainders, rents, issues and profits thereof, and of every part, part and parcel thereof, and also, all of the estate, right, title, interest, property, possession, acclaim and demand whatsoever, both in law and equity of the said part of the first part of, in and to the same promises, with the appurtenances. To have and to hold the same premises, with all the singular the appurtenances unto the party of the second part his heirs and assigns, and for the only proper use and behoof of the said party of the second part his heirs and assigns forever. And the said Vera E, CUNNINGHAM and Wm B. CUNNINGHAM her husband their heirs executors and administrators, by these presents covenant, Grant and agree to and with the said party of the second part his heirs and assigns forever, that they the said Vera E, LUTZ, now Cunningham and Wm. E. CUNNINGHAM her husband, their heirs all and singular the hereditaments and premises here and above described and granted or mentioned and intended so to be, with the appurtenances unto the said party of the second part his heirs and assigns against them the said parties of the first part their heirs, and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof shall and will buy these presents warrant and forever defend. In Witness Whereof, the said the parties of the first part to these presents have hereunto set hand and seals, dated today and year first above written. SIGNED: Vera E. CUNNINGHAM William B. CUNNINGHAM her husband and in due form of law acknowledge the above Indenture to be their act and deed and desired the same might be recorded as such, and the said Vera E. LUTZ now CUNNINGHAM being a full age, a separate and apart from her said husband by me thereon to privately examined and the full contents of the above deed being by me first made known to her did thereupon declare and say that she did voluntarily and of her own freewill and accord sign, seal, and as her act and deed deliver the above written Indenture deed or conveyance, without any coercion or compulsion of her said husband.
