And Frederich Roemer of Manchester Township in the County of York aforesaid yeoman of the other Part: Where as the Honorable Proprietors of the late Province of Pennsylvana by their Letters Patent under the great Seal of the Said Province, bearing date the fifth Day of December in the year of our Lord one thousand seven hundred and sixty three, for the consideration and Reservations particularly therein mentioned and expressed, did grant and confirm unto certain Frederich Roemer the elder a certain plantation and Tract of Land Situate in Manchester Township aforesaid bounded and limited as follows. (to wit) Beginning at a marked white oak thence by Lands of Christian Oysler North sixty degrees East one hundred and eighty two perches to a Spanish Oak, and North thirty degrees, West twenty two perches to a marked Black Oak thence still with the Same and Lands of Conrad Gentlezer North Sixty degrees East one hundred and eighty nine perches to a marked Hickory thence by Lands of Peter Sprenckle South twenty five degrees and a half East one hundred and ninety perches to a marked white oak thence by Lands of Henry Everhart South Sixty five degrees West Sixty three Perches to a marked Black Oak thence by Lands of Philip Low North twenty five degrees West twenty two perches to a marked Black Oak, and South Sixty five degrees and a half West two hundred and twenty six perches to a Corner thence by Vacant Land North twenty five degrees West twenty two perches to a marked white oak and South Sixty five degrees West eighty perches to a Hickory Grub thence by Vacant Land and Lands of George Conrad North thirty degrees, West ninety two perches to the Place of Beginning, Containing Three hundred and ten acres and the usual of six Acres ofcent? for Roads. To hold to him the said Frederich Roemer the elder his Heirs and Assigns for ever, as in and by the Said in part recited Patent Recorded in the office for Recording of Deeds in and for the City and County of Philadelphia in Patent Book A A Vol. 5 Page 406 Relation being thereunto more fully appears. And Whereas the said Frederich Roemer the elder lately died so owner and seized? of the above described Premises with the appurtenances in his Demesne as of Fee as a foresiad having first made his Testament and last Will in Writing under his Hand and Seal duly executed bearing date the thirtieth Day of December in the year of our Lord one thousand and seven hundred and eighty two wherein and thereby he did (interalia) Order and direct his Executors therein named (to wit) Jacob Lanius and his son John Roemer (who is since deceased) to make Sale of his said Dwelling Plantation by way of Publick Vendue, As in and by the said recited Will since his decease duly proven and remaining in the Register Office at York, Relation being thereunto had more fully appears. And whereas the said Jacob Lanius and John Roemer Executors as a foresaid having taken upon theselves the Burthen of Execution of the said recited Will did in Pursuance and according to the directors thereof on the fourth Day of May last past (after having given due and legal Notice of the Day and place of Sale and the premises to be sold) expose to Sale by Way of Publick Vendu the above decribed Plantation and Tract of land whereof the said Frederich Roemer the elder died owner and Seized aforesaid and the same was accordingly sold and struck off unto the aforesaid Francis Jacob Roemer, Henry Roemer, Frederick Roeer, George Hassler, and Catherine Roemer (who is since intermarried with the said John Hershinger) And whereas the said John Roemer one of the said Executors having died since the aforesaid Sale hath been made before a Title for the aforesaid Premises could be fully completed, Wherfore the making and compleating of the Same became sole vested in the said Jacob Lanius surviving executor of the said Will Where upon in order to compleat the Title of the aforesaid described Premises the said Jacob Lanius as well by Virtue of Survivorship as aforesaid as in Pursuance of the said recited Will by his indenture bearing date with these Presents, for the Consideration therein mentioned did grant and Confirm all the Estate, Right Title, Interest, Property Claim and Demand whatsoever the said Frederich Roemer the elder had in his life time of in and to the above described Plantation and Tract of Land unto the aforesaid Francis Jacob Roemer, Henry Roemer, Frederich Roemer, and John Hershinger and Catherine his wife (parties here to) and to their Heirs and Assigns forever as Tenants in Common. As in and by the said in part recited Indenture Relation being thereunto had more at large may appear Now this Indenture Witnesseth that the said Francis Jacob Roemer and Catherine his Wife, Henry Roemer and Judith his wife, George Hassler and Elizabeth his wife and, John Hershinger and Catherine his wife, for and in Consideration of the Sum of one thousand three hundred and fifty pounds Lawful money of Pennsylvania to them in hand paid for said Frederich Roemer at and before the unsealing and Delivery hereof the Receipt and Payment they do hereby and every part and parcel thereof requitted, released and forverver discharged by these presents. Have and each of them Hath granted, bargained, sold, aliened, in fe offed, released and confirmed and by these Presents Do and each and every of them doth grant bargaine, sell, alien, in fe off, release and confirm unto the said Frederick Roemer and to his Heirs and Assigns. All those four equal undivided fifth parts of the above described Plantation and tract of Land (the other equal undivided fifth part thereof having been granted and confirmed into the said Frederich Roemer in Fee by the aforesaid Jacob Lanius) Situate in Manchester Township in the County of York aforesaid containing by Metes and Bounds three hundred and ten Acres and Allowances as aforesaid. Togehter with all and Singular the Houses, Out Houses, Edifices, and Buildings there erected by of being Barns, Stables, Orchards, Gardens, Meadows, Pastures, Fields, Fences, Ways, Woods, Underwoods, Waters, Water courses, Rights Members, Liberties Priveleges, Advantages, Hereditaments and Appurtenances there unto belonging or in any wise appertaining. And the Revisions and Remainders Rents Issues and Profits thereof. And also all the Estate, Right, Title, Interest, Property Claim of Demand whatsoever of them or any or either of them the Said Francis Jacob Roemer & Catherine his wife, Henry Roemer & Judith his wife, George Hassler and Elizabeth his wife, and John Hershinger and Catherine his wife of into or out of the Same Premises or any part thereof either in Land or in Equity. To have and to hold the aforesaid four equal undivided fifth parts of the aforesaid desceribed Plantation and Tract of Land Hereditaments and Premises hereby granted or mentioned or indtended So to be with the appurtenances unto the said Frederick Roemer his Heirs and Assigns. To the only use and Behalf of the said Frederick Roemer his Heirs and Assigns forever. Under subject to the Widows Dower And also to the payment of the yearly Quit Rent now due and hereafter to become due and payable on the same to the Chief Lord or Lords of the Fee thereof(if any such Quit Rent there be) And the said Francis Jacob Roemer Henry Roemer George Hassler and John Hershinger for themselves their Heirs Executors and Administrators and for each and every of them do and each of them doth covenant promise grant and agree to and with the said Frederick Roemer his Heirs and Assigns that they the said Francis Jacob Roemer Henry Roemer George Hassler and John Hershinger and their Heirs the hereby granted Premises and every part thereof with the Appurtenances unto the said Frederick Roemer and to his Heirs and Assigns against him the said Francis Jacob Roemer Henry Roemer George Hassler and John Hershinger and their Heirs and against each and every of them and against all and every other Person and Persons whatsoever lawfully claiming or to claim the same or any part thereof by from or under them or any of them shall and will Warrant and forever defend according to the intent and true meaning of this Presents. In Witness whereof the said Parties have here unto set their Hand and Seals to these presents the Day and year first above written.
