Whereas the Honourable Proprietaries of the late Province of Pennsylvania by their Letters Patent under the great seal of the said Province bearing the date at Philadelphia the fifth Day of December in the year of our Lord one thousand seven hundred and sixty three for the consideration and Reservations therein mentioned and aforesaid did grant and confirm unto the said Frederick Roemer the elder and to his Heirs and Assigns a certain Plantation and Tract of Land situate in Manchester Township in the County of York aforesaid Beginning at a marked white Oak, thence by Lands of Christian Oyster, North sixty degrees East one hundred and eighty two perches to a Spanish Oak and North thirty degrees West twenty two perches to a marked Black Oak, thence still with the same of Lands of Conrad Gentzler, North sixty degrees East one hundred and eighty nine perches to a marked Hickory, thence by Lands of Peter Sprenckle South twenty five degrees and a half, East one hundred and ninety Perches to a marked Black Oak & South Sixty five degrees and a half West two hundred & twenty six perches to a Corner thence by Vacant Land North twenty five Degrees , West, twenty two perches to a marked white Oak, and South Sixty five degrees West ninety two perches to the Place of Beginning. Containing three hundred and ten acres and the usual allowance of six Acres ? for Roads. To hold to him the said Frederick Roemer the elder and to his Heirs and Assigns forever. As in and by the said in part recited Patent Recorded in the Office for Recording Deeds in and for the County of Philadelphia in Patent Book A. A. Vol. 5th page 406. Relation being thereunto had at large my appear. And Whereas the said Frederick Roemer the elder lately died so owner and seized of the above described Premises with the appurtenances in his Demesne as of Fee as aforesaid, having first made his Testament and last Will in Writing, under his Hand and Seals duly executed bearing date the thirtieth Day of December Anno Domini one thousand seven hundred and eighty two, wherein and whereby he did (inter aloa) order and direct the Executors therein in named (to wit) the said Jacob Lanius and his son John Roemer(who is since deceased) to make sale of said dwelling Plantation at Public Vendue. As in and by the said in part recited Will since his decease duly proven and remaining in the Registers Office, at York, Relation being thereunto had, more fully may appear. And Whereas the said Jacob Lanius and John Roemer Executors as aforesaid after having taken upon themselves the Burthen of the Execution of the said recited Will, did in Pursuance and according to the directions of the said Will, on the fourth Day of May last past (after having given due and legal Notice of the Day and Place of Sale and the Premises to be sold) expose to Sale by way of Publick Vendue the above described Premises whereof the said Frederick Roemer the elder died owner and Seized so as aforesaid, and the same was accordingly sold and struck off unto the aforesaid Francis Jacob Roemer, Henry Roemer, Frederick Roemer, George Hassler & Catherine Roemer (who is intermarried with the said John Hershinger) for the sum of seven hundred Pounds Lawful money of Pennsylvania in Gold or Silver (they being the highest) highest bidders and that sum being the highest and best price which could be gotten for the same. And Whereas the said John Roemer one of the said Executors having died since the aforesaid sale hath been made before a Title for the aforesaid described Premises could be fully completed. Wherefore the execution of the said recited Will and the making and completion of Title for the same became soly vested in the aforesaid Jacob Lanius. Now this Indenture Witness to that the said Jacob Lanius surviving Executor as aforesaid for and in consideration of the aforesaid sum of eleven hundred pounds, to him in hand well and truly paid or secured to be paid by the said Francis Jacob Roemer Henry Roemer Frederick Roemer George Hassler & John Hershinger and Catherine his wife, at and before the unsealing and Delivery hereof the Receipt whereof is hereby acknowledged and the said Francis Jacob Roemer, Henry Roemer, Frederick Roemer, George Hassler & John Hershinger and Catherine his wife and each of them, and their and each of their Heirs Executors & Administrators thereof and of every part and parcel thereof acquitted, released and forever discharged by these Presents. Hath granted, bargained sold released and confirmed and according to the directions of the said recited Will and in Pursuance thereof and by Virtue of the Power and Trust in him thereby visited and reposed and of the Survivorship aforesaid. Doth hereby grant, bargain, sold release and confirm unto the said Francis Jacob Roemer, Henry Roemer, Frederick Roemer, George Hassler, & John Hershinger and Catherine his wife and to their Heirs and Assigns as Tenants in Common and not as Joint Tenants. All the above described Plantation and Tract of Land whereof the said Frederick Roemer the elder died owner and seized as aforesaid situate in Manchester Township in the County of York aforesaid. Containing three hundred and ten Acres and Allowances as aforesaid. Together with all and singular the House, Outhouses, Edifices and buildings thereon erected and being, Barns, Stables, Orchards, Gardens, Meadows, Pastures, Fields, Fences, Waters, Water Courses, Ways, Woods, Underwoods, Rights, Members, Liberties Privileges, Hereditaments and Appurtenances whatsoever thereunto belonging or in anywise appertaining. And the Reversion and Remainders Rents, Issues and Profits thereof. And also all the Estates Titles, Interest, Property Claim and Demand whatsoever of him the said Frederick Roemer the elder deceased of , in, to or out of the same Premises or any part thereof at and immediately before the time of his Death either at Law or in Equity. To have and to hold the said described Plantation and Tract of Land situate and bounded as aforesaid containing three hundred and ten acres and allowances as aforesaid Hereditements and Premises hereby granted or mentioned or intended to be with the appurtenances unto the said Francis Jacob Roemer, Henry Roemer, Fredrick Roemer, George Hassler, John Hershinger and Catherine his wife their Heirs and Assigns. To the only use and Behalf of the said Francis Jacob Roemer, Henry Roemer, Frederick Roemer, George Hassler & John Hershinger and Catherine his wife their Heirs and Assigns forever as Tenant in Common and not as Joint Tenants as aforesaid, for such Estate of Estates as the said Frederick Roemer the elder held the same in his life time. Subject Never the less to the Widow Dower & also to the Payment of the yearly Quit rent (if any) now due and hereafter to become due and payable on the same to the Chief Lord or Lords of the Fee thereof. And the said Jacob Lanius surviving Executor as aforesaid doth hereby covenant, Promise, grant and agree to and with the said Francis Jacob Roemer, Henry Roemer, Frederick Roemer, George Hassler & John Hershinger and Catherine his wife and with each and every one of them and with each and every of their Heirs and Assigns by their Presents for himself his Heirs Executors and Administrators that he the said Jacob Lanius hath not whatsoever whereby thereby granted Premises or any Part thereof I or may be incumbered or impeach as in Title Charge Estate of otherwise how ?. In witness whereof the said Executor hath hereunto set his Hand and Seal to the Presents the Day and year first above written.
