All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Rosalie Sommer sommer@suscom.net October 21, 2005, 12:29 pm Written: June 6, 1818 Recorded: June 22, 1818 York County Archives, York, Pennsylvania Deed Book 3C, page 533 Grantee (buyer): John MARSTELLER of Fawn Twp Grantor (seller): John HESS & Sarah his wife date written 6 June 1818 date recorded 22 June 1818 purchase price $200.00 acres: 8 acres [transcribed from the original 15 Aug 2003 Rosalie Sommer] THIS INDENTURE made this sixth day of June in the year of our Lord one thousand and eight hundred and eighteen BETWEEN John HESS and Sarah his wife of Fawn township, York County and State of Pennsylvania of the one part and John MARSTILLAR of the same place of the other part WITNESSETH that for and in consideration of the sum of two hundred dollars to the said John HESS in hand well and truly paid at or before the sealing and delivery of their presents in full for the absolute purchases of the inheritance in fee simple and in all that tract of parcel of land with its appurtenances as herein after mentioned to be hereby bargained and sold the receit where of they and the said John HESS and Sarah his wife doth hereby acknowledge and thereof and from every part thereof doth acqit release and discharge the said John MARSTILLAR his heirs executors and administrators and several of them forever by these presents he the said John HESS and Sarah his wife hath granted gained and sold and by these presents doth grant bargain and sell unto the said John MARSTELLER his heirs and assigns all his right title claim and interest in and to part of that tract or parcel of land situate in Fawn Township, York county that the Commonwealth of Pennsylvania hath granted a patent for the consideration therein mentioned under the great seal to James McCANLES for two hundred and six acres one hundred and thirty seven perches and allowances bearing date the third day of April one thousand and eight hundred & eighteen enrolled in the Kolls office patent Book F (?) Vol 16, page 182 relation thereunto had will more full and .. large appear, the right whereof by lawful conveyances not vested in the aforesit John HESS Bounded and running as follows towards BEGINNING at a stone in the North east corner of the aforesaid tract and running thence North seventy two degrees West nineteen & five tenths perches to a stone thence South four degrees East eight three perches to a stone thence North fifty seven. Eash twenty two and four tenths perches to a Spanish oak thence North four degrees West seventy two and five tenths perches to the Beginning, containing eight acres. TOGETHER with all and singular the right to members and appurtenances thereunto belonging and the revisions and remainder rents issues and profits thereof to have and to hold the said land and all and singular other the premises hereby bargained and sold of motioned or intended so to be with their and or ..of their rights members and appurtenances run to the said John MASTILLER his heirs and assigns to there only proper use of him the said John MARSTILLER his heirs and assigns forever and the said John HESS and Sarah his wife and their heirs shall and will warrant and forever defend the premises aforesiad unto the said John MARSTILLER his heirs and assigns against all and every person and persons whatsoever who my or shall claim from through or under him thee or either of them the said John HESS and Sarah his wife. (unreadable signature Thomas JORDAN York County Ss on the day of the date of the within Indenture personally came before me the subscriber one of the Justices of the peace for said County, John HESS & Sarah his wife and severally acknowledged the within written Indenture as and for their act and deed and desired the same might be recorded according to law she the said Sarah being of full age separate and apart from her said husband by me examined and the full contents thereof made known to her voluntarily consenting them to.
