Whereas in pursuance of the application of Richard McDONALD No. 1363 the twenty sixth day of September A.D. one thousand seven hundred and sixty six there was surveyed a track to land situate in Shrewsbury (now Hopewell) township York county aforesaid containing the following metes and bounds viz Beginning at a marked chestnut tree thence by vacant land north forty degrees West forty one perches to a chestnut north thirth tree degree East one hundred and twenty five perches to a chestnut North sixty four degrees East one hundred one hundred and nine perches to a chestnut South sixty five degrees East one hundred and sixteen perches to a heap of stones South forty eight degrees West sixty one perches to a marked tree south seventy seven degrees West one hundred and thirty perches to a chestnut South eleven degrees West seventy one perches and a half to a post thence by his other land North eight five degrees West sixty perches to the place of beginning Containing one hundred and thirty one acres forty perches as by the deed patent from the late propriators of Penn Thomas Penn of Rich Penn Exp. bearing date the first day of September A.D. one thousand seven hundred and sixty seven recorded in the office Recording of Deeds for the City and County of Philadelphia in Book AA Vol. 10 page 78 as may appear and whereas the said Richard McDonald since died having made his last will in writing dated the nineteenth day of May A.D. one thousand seven hundred and eighty nine by which he devised the tract of land aforesiad to his wife Mary MdDONALD if fee which will being duely proven remaineth in the Registers office for the probate of wills for the county of York and whereas the said Mary McDONALD since died owner and seized of said tract of land having made her testament and lst will an therein appointed John KELLY and John MANIFOLD executors thereof and directed them to sell and dispose of the said tract of land aforesaid for certain purposes mentioned in said will which testament and last will is dated the sixteenth day of February A.D. one thousand seven hundred and ninety seven and being duly proven remaineth in the offissce for recording of deeds and probate of wills for the County of York and whereas the said John KELLY and John MANIFOLD by virtue of the power in them vested by the said last Will and Testament did by deed duely execute bearing date the sixth day of May A.D. on thousand seven hundred and ninety nine for the consideration therein mentioned grant bargain sell and convey all the said tract of land and apertenances to John MARSHALL his heirs & assignes forever who together with his wife Jean MARSHALL by their deed duely execute bearing date the fifteenth day of October A.D. one thousand and eight hundred and five for the consideration therein mentioned did grant bargain sell and convey the same to John KUNKLE his heirs and assigns forever and where after said John KUNKLE since died having made his last will and testament in writing bearing date the eleventh day of July A.D. one thousand and eight hundred and sixteen which being duely proven remaineth on record in the office for the probate of Wills in and for the County of York and therein appointed Jacob MARKEY executor thereof and directed that he should sell and dispose of said tract of land and that one third part of the vendue of the purchase money (after his debts were paid) should remain a lein on said land using the natural life of his widow and interest to be paid annually thereon to her use. NOW this INDENTURE witnesseth that the said Jacob MARKEY by virture of the powers in him vested by the said last will and testament hath for and in consideration of the sum of two thousand four hundrend and eighty one dollars and twenty five cents lawfull money to him in hand paid at or before the sealing and dlivery of these presents the receipt whereof is hereby acknowledged and the said Levi BADDERS of the same a& every part thereof acquitted released and discharged and also in consideration of the further sum of eight hundred dollars like lawfull money to be paid to him the said Jacob MARKEY executor as aforesaid immediately after the decease of Eve KUNKLE widow of John KUNKLE deceased. Together with lawful interest for the same to be paid annually on the first day of April to the said Jacob MARKEY on to such other person or persons as shall be legally entitled to receive the same during the full term of the natural life of the said Eve KUNKLE widow aforesaid granted bargained and sold the aforsaid described tract of land and premises to the aforesaid Levi BADDERS his heirs and assignes forever subject nevertheless at all times to the payment of the aforesaid sum of eight hundred dollars and interest to be annually paid thereupon as above said by the said Levi BADDERS his heirs or assigns to the said Jacob MARKEY as such other person legally entitled said interest to convenience from the first day of April one thousand eight hundred and seventeen To have and to hold the tract of land aforesaid Together with all and singular the buildings improvements heriditaments & appurtenances thereto belonging or in any wise appertaining and the revisions & remainder rents issues & profits thereof to the only use benefit and behoof of him the said Levi BADDERS his heirs and assignes forever subject neverthless as above subjected and the said Jacob MARKEY as Executor afore aid the said tract of land premises and appurtenances unto him the said Levi BADDERS his heirs and assignes against him the said Jacob MARKEY his heirs or assigns and against all persons lawfully claiming the same or any part thereof by from & under him shall and will forever warrant and defnd subject asforsaid and such right as the said John KUNKLE had at the time of his decease is hereby conveyed and no other.
