D. 1838. Before the Honorable Daniel Durkee, George Barnett and John L. Hinkle Esquires, Judges of the same court duly appointed. Adam Klinefelter, High Sheriff of the county of York came into court and made returns of the wit of partitions and valuation to him directed whereby he was commanded to make partition and valuation of the Real State of John LUTZ late of Fawn Township deceased selling forth in wards following to wit Inquisition, indented and taken on the premises of John LUTZ deceased in Fawn Township York County Pennsylvania on the 27th day of October Ammo Domini 1837. Before Adam Klinefelter, High Sheriff of the county of York aforesaid by virtue of a writ of partition or valuation to him directed and to this inquest is annexed by the oath and affirmations of Thomas Murphy, James Clark, William Blair, Allen Anderson, Samuel Brennan, Wilson Michael, John M. Anderson, Thomas. Kincaid, James McLaughlin, Salem Manifold, Solomon Kilgore and Robert Blair; twelve free honest lawful men of his Bailwick who do say in the day and year aforesaid, they went to and upon the lands and tenements of which John LUTZ died seized and then and there did find that the same could not be paroled and divided to and among all the heirs in the writ named without prejudice to or spoiling to the whole. And therefore the Inquest have valued and appraised the same to wit – a tract of land in Fawn township of one hundred acres more or less adjoining land of Allan Anderson and others at the sum of five hundred and thirty five dollars Lawful money of Pennsylvania and it for which sum the inquest aforesaid, upon their oaths and affirmations aforesaid do value and appraise the same which valuation the court do hereby confirm and order and decree that the same remainder firm and stable forever And now came onto court Herman LUTZ son of the said John LUTZ, and prayed to be permitted to take the said real estate at the return of the amount of valuation. Whereupon the court decree the same to him, he paying to the widow and other heirs of the said Intestate their several and respective shares and dividends of the valuation thereof, agreeable to the Distribution and decree of this court. It is ordered and decreed by the court, that the said Herman LUTZ be allowed the sum of $53.43, the cost and expenses of these proceedings, that he retain in his own hands now the sum of $40.13 and at and immediately after the death of the widow of the said Intestate, the further sum of $20 and six and one half cents, in full of his share of the valuation of Real estate aforesaid as one of the children of the said Intestate. It is also ordered and decreed by the court that the said, Herman LUTZ do well and truly pay or cause to be paid onto the widow, of the said Intestate date annually during her lifetime, the sum of $9.63 the first payment whereof to be made on the second day of January A.D. 1839. And full of her rights of Dower in and to the said real estate of the said Intestate. It is further ordered and decreed by the court that the said Herman LUTZ do also well and truly or cause to be paid unto Barbara intermarried to Andrew HANEY, John LUTZ, Polly LUTZ, James LUTZ, Betsy LUTZ, Catherine LUTZ, and Lydia LUTZ, or the guardian of such of them as are minors. Each the sum of $40.13 on the second day of January A. D. 1839 with legal interest for the same from this date. And at and immediately after the death of the said widow, that he pay or cause to be paid unto each of them the further sum of $20 and six and ½ cents. In full of their respective shares and dividends of the amount of valuation of the Real Estate aforesaid as seven of the children of the said Intestate. And lastly will upon the said Herman LUTZ, his making this several payments herein mentioned, up or giving good insufficient security for this same, the Court decrees that then and from henceforth, he the same Herman LUTZ his heirs and assigns, to hold and enjoy the said tract of land with the appurtenances, as in for the same Estate and in clear full and ample a manner, as John LUTZ the said Interstate at and immediately prior to his decease held and enjoyed the same. Exonerated and Discharged from the further claim of the widow, and other heirs of the said Interstate, and all the other persons claiming or to claim the same by From or under them, or any or either of them.
